Abstract

The phenomenon of the use of the human mind that sometimes exceeded the limits in the terminology of Islamic law became a restlessness of Muhammad Sa`id Ramadhan Al-Buthi. Maslahat (goodness) in the view of Sa`id Ramadhan Al-Buthi was not an argument that was independent but must be supported by other propositions. Therefore, responding to this phenomenon, He created a limitation in the concept of goodness. According to him, as stated in his book Dlowabith al-Maslahah fi al-Shari`ah al-Islamiyyah, Maslahat could be accommodated into Islamic law if it fulfilled several criteria as follows: first, that the goodness was still within the scope of Shariah purposes (Maqashid al-Syar`iyyah). Second, it did not contradict the Holy Qur`an. Third, it was not contrary to sunnah. Fourth, it did not contradict with qiyas. Fifth, it did not conflict with higher maslahat. Thus, in the view of Sa`id Ramadhan Al-Buthi concept of the charity included hifdz ad-din, hifdz an-nafs, hifdz al-aql, hifdz an-nasl, hifdz al-mal. Its implementation was certainly based on the order. The higher maslahat has to be taken precedence over form the lower. Last but not least, Al-Maqashid Al-Syar`iyyah was the goal of Islamic Law to achieve the maslahat of humanity both in the world and the hereafter.

Abstract

Tujuan penelitian ini adalah untuk mengetahui isi perjanjian kerja sama usaha sarang burung walet di Desa Sepakat Baru Kecamatan Kubu Kabupaten Kubu Raya dan mengetahui penyelesaian sengketa dalam kerja sama ini berdasarkan persepsi Al-Shulhu. Kajian ini menggunakan meteode penelitian kualitatif, yang termasuk penelitian riset lapangan dimana peneliti terjun langsung ke lapangan untuk melakukan observasi, wawancara dan dokumentasi dengan masyarakat. Sumber data yang peneliti gunakan adalah data primer dan data sekunder. Data primer adalah data yang didapat langsung dari sumber pertama yaitu pihak yang bersengketa. Sedangkan data sekunder adalah bahan yang diperoleh dari buku-buku dan dokumen-dokumen hukum, serta hasil penelitian yang berwujud karya ilmiah yang berhubungan langsung atau tidak langsung dengan fokus penelitian ini. Sedangkan teknik pengumpulan data berupa wawancara, observasi, dan dokumentasi. Teknik analisis data peneliti menggunakan verifikasi, klasifikasi, dan kesimpulan. Hasil penelitian ini berupa: 1. Perjanjian yang sering kali dilakukan oleh masyarakat Desa Sepakat Baru dilakukan secara lisan dan tidak tertulis karena sudah menjadi kebiasaan masyarakat dari zaman dahulu. 2. Praktik penyelesaian sengketa yang dilakukan oleh pihak pertama dengan pihak kedua dengan memilih jalur kekeluargaan dan berdamai. Adapun porses yang dilakukan dengan cara musyawarah mufakat yang dilakukan oleh pihak pertama dengan pihak kedua dengan menunjuk salah satu orang yang dianggap sanggup untuk menyelesaikan sengketa sebagai pihak ketiga. 3. Praktik penyelesaian sengketa antara pihak dengan melakukan perjanjian damai yang dilakukan telah sesuai dengan perspektif shulhu, seperti rukun dan syarat yang dilakukan oleh para pihak yang bersengketa telah dipenuhi seperti adanya penunjukan hakam sebagai juru damai, adanya ijab kabul dan lafadz sebagai bentuk argumentasi komitmen para pihak untuk berdamai. Abstract

The purposes of this study are to find out how the "scooping" system is used in trading practices in the Pontianak Flamboyan market and to find out the "scooping" system in buying and selling practices in the Pontianak Flamboyan market in a review of Islamic Law. Researchers use the type of field research with descriptive methods and Islamic law approaches. Data collection methods are interviews with sellers and buyers, field observations, and documentation in the Pontianak Flamboyan market. The results of this study indicate that: 1) The "scooping" system in buying and selling at the Flamboyan Pontianak market is a practice of buying and selling using a tool to scoop. Thus, the buyer cannot choose the goods and does not know their brimful quality. The buyer only sees the goods' quality from the top layer without knowing their quality. What is interesting is that there is an element of trust and willingness from both parties. 2) Buying and selling with the "scooping" system at the Flamboyan Pontianak market has fulfilled the Islamic pillars of buying-selling. The ambiguity of the object in buying and selling with the system does not contain an element of fraud because at the time of the transaction or when the seller takes the merchandise, the buyer sees it directly, even though the quality of the goods is only seen on the surface. The "scooping" system in the Pontianak Flamboyan market is included in 'urf sahih, which is something good that becomes a habit of society but does not justify what is forbidden and not vice versa. Abstract

Penelitian ini dilatarbelakangi adanya kerjasama dalam pengelolaan perkebunan kelapa sawit di Desa Madura, namun dalam kerjasama ini terjadi perselisihan antara kedua belah pihak. Maka dari itu, peneliti tertarik untuk meneliti keabsahan dari kerjasama ini. Tujuan penelitian ini adalah untuk mengetahui: 1) kerjasama antara PT. Rezeki Kencana dengan pemilik tanah di Desa Madura. 2) isi perjanjian kerjasama antara PT. Rezeki Kencana dengan pemilik tanah di Desa Madura. 3) isi perjanjian kerjasama antara PT. Rezeki Kencana dengan pemilik tanah di Desa Madura dalam ketentuan akad pada Pasal 20-30 KHES. Penelitian ini menggunakan metode kombinasi, yaitu normatif dan empiris. Hasil penelitian ini menunjukan bahwa: 1) Praktik kerjasama bagi hasil perkebunan kelapa sawit yang dilakukan oleh PT. Rezeki Kencana dan pemilik tanah dilakukan dengan cara pemilik tanah menyerahkan sepenuhnya tanah kepada PT. Rezeki Kencana untuk dikelola dan hasilnya akan dibagi sesuai dengan kesepakatan kedua belah pihak. 2) Perjanjian ini menggunakan akad tertulis dengan pola kemitraan dan plasma yang memuat hak dan kewajiban kedua belah pihak. Bagi hasil dilakukan pada saat panen terjadi dengan pola 30%-70%. 3) Sistem bagi hasil perkebunan kelapa sawit yang dilakukan antara pemilik tanah dan PT. Rezeki Kencana belum memenuhi asas-asas yang ada dalam KHES. Dalam KHES pada Pasal 21 terdapat asas kejujuran, Luzum, asas saling menguntungkan, serta asas transparansi atau keterbukaan dalam akad kerjasama. Namun dalam kerjasama ini belum memuat mengenai asas tersebut, Sehingga dapat dikatakan dengan jelas bahwasannya perjanjian kerjasama antara PT. Rezeki Kencana dan Pemilik tanah di Desa Madura belum sesuai dengan Kompilasi Hukum Ekonomi Syariah.

Abstract

The purpose of this research is to assess the cooperation between fishermen and boat owners in Tanjung Saleh Village by analyzing the rights and obligations in the contract agreement between the two parties. The sources of data in this study are ship owners and fishermen. So, this research was conducted using a descriptive method with a qualitative approach. Techniques and data collection tools were observation, interviews, and documentation that presented data for profit sharing between ship owners and fishermen. Data management and data analysis techniques use an interactive model with the stages of data collection, data reduction, data presentation, and conclusion drawing that are presented in a comprehensive, comprehensive manner. The results of this study indicate that the cooperation between fishermen and boat owners can be said to be mutually beneficial and there is an initial agreement on the profit sharing, which is 50:50. The first 50% is for paying fishermen's wages of 20%, employees or staff get 15%, and the next 15% is for purchasing boat oil to prepare fishermen for the next day. While the next 50% is for the ship owner and if there is damage such as repairing the ship, damaged fishing nets, leaking ships, and purchasing paint, the ship owner will also bear the damage to the ship. The contract made by the owner of the ship and the fisherman was not written but was witnessed by three witnesses.

Abstract

Tujuan penelitian ini untuk mengetahui sistem Binary Option pada platfrom Binomo serta meminta Pandangan MUI Kota Singkawang tentang transaksi Binary Option pada Platfrom Binomo. Penelitian ini menggunakan metode penelitian kualitatif dan pendekatan normatif empiris. Sumber data menggunakan data primer dan data sekunder berupa buku-buku dan tulisan ilmiah hukum dan dapat membantu dalam menganalisa terkait objek penelitian. Teknik pengumpulan data berupa observasi, wawancara dan dokumentasi. Hasil penelitian menyimpulkan bahwa: 1) Sistem trading binary option platform binomo ini trader hanya menganalisa grafik pada platform Binomo. Setelah itu para trader bisa memperdagangkan berbagai aset seperti Crypto, uang asing, dan lain-lain. Dalam sistem Binary Option pada binomo ini para trader hanya melakukan transaksi beli dengan opsi naik dan jual dengan opsi turun dengan waktu penutup yang sudah dipilih oleh trader itu sendiri dan waktu itu di antaranya, 30 detik hingga 1 jam, dan jumlah nominal perdagangan itu dari Rp14.000,00 hingga Rp14.000.000,00, dengan sistem keuntungan ditentukan oleh aplikasi yang mana salah satu opsi trader betul maka akan meraih keuntungan 80% dari hasil yang diperdagangkan dan sebaliknya opsi salah maka akan mendapatkan kerugian 100%. 2) Pandangan Majelis Ulama Indonesia (MUI) Kota Singkawang sepakat bahwa sistem Binary Option pada Binomo ini diharamkan atau dilarang untuk dilakukan karena mengandung spekulasi, untung-untungan, dan mengandung unsur penipuan dalamnya yang mana bisa di bilang maysir dan gharar seperti loutre sehingga dikatakan sebagai permaianan judi yang berdasarkan dalam ayat Al-Maidah ayat 90-91.

Abstract

This study aims to find out the activities of leasing coconut plantations in Teluk Nangka Village, Kubu District, in this case, leasing is carried out with two different contract systems. This study uses a qualitative approach. The primary data source is in the form of interviews from musta'jir (tenants) and mu'ajir (renters). Secondary data comes from various parties such as the results of journals, articles, and theses. The study results show that: 1) In the practice of leasing contracts for coconut plantations in Teluk Nangka Village, two systems are used, namely on a monthly and annual basis. Monthly system by paying rent every month and the object of rent in the beneficiary is only the garden. Meanwhile, the annual system is a one-time payment, usually made in cash or a certain number of days with a bonus of 1 month. Thus, the annual rental period is 13 months. The contract agreement is made orally and has never used a written contract. Pricing is determined based on the condition of the garden, area, and unit of time to be rented and agreed upon at the beginning of the contract. Maintenance of the coconut plantation is the responsibility of the musta'jir i. The end of the lease for coconut plantations in Teluk Nangka Village because the lease period in the agreement has ended; 2) Whereas the practice of leasing contracts contained in the Compilation of Sharia Economic Law (KHES) in Chapter XI Articles 295-320 supports the leasing contract for coconut plantations in Teluk Nangka Village. It is only that the agreement between the two parties must have a clear statement so that the transaction is full of honesty and fairness.

Abstract

The purpose of this study is to determine the practice of buying and selling furniture in Sungai Rengas Village, Sungai Kakap District, as well as the practice of buying and selling furniture from the perspective of the Compilation of Sharia Economic Law (KHES). This type of research is qualitative research, while the technique in data collection uses primary data, namely observation, interviews, and in the form of documentation. The analysis techniques that researchers use are the stages of data collection, data reduction, data presentation, and conclusions. While in the test stage the validity of the data using triangulation. The results of this study concluded that: 1) The practice of buying and selling furniture in Sungai Rengas Village, Sungai Kakap District involves furniture owners and consumers. In buying and selling this order follows the theoretical study of the istisna contract, namely the provisions of the goods ordered are clear in form, content, and information. The payment method is also by the istisna contract contained in KHES, namely, consumers can pay in advance, in the middle, or at the end of the furniture manufacturing process. 2) Regarding the practice of buying and selling in the Sungai Rengas Furniture store, the theory used is by KHES, namely that each party agrees when a contract occurs on the ordered goods and has been explained in articles 104, 105, 106, 107, 108 and these articles are implemented in practice in the field even though the seller has never known before about KHES.

Abstract

Tujuan penelitian ini adalah untuk mengetahui kewenangan notaris dalam hal melegalisasikan surat di bawah tangan, prosedur legalisasi yang dilakukan notaris terhadap akad konvensional di masyarakat Pontianak, dan prosedur legalisasi yang dilakukan notaris terhadap akad konvensional di masyarakat Pontianak ditinjau dari Kompilasi Hukum Ekonomi Syariah. Peneliti menggunakan metode analisis deskriptif bersifat kualitatif. Sumber data menggunakan data primer berupa wawancara Pejabat Notaris di Pontianak. Sedangkan data sekunder adalah Kompilasi Hukum Ekonomi Syariah, dan Kitab Undang-Undang Hukum Perdata. Hasil penelitian menunjukkan bahwa: 1) Notaris berwenang membuat akta autentik mengenai semua perbuatan, perjanjian, dan penetapan yang diharuskan oleh peraturan perundang-undangan dan/atau yang dikehendaki oleh yang berkepentingan untuk dinyatakan dalam akta autentik, menjamin kepastian tanggal pembuatan akta, menyimpan akta, memberikan grosse, salinan dan kutipan akta, semuanya itu sepanjang pembuatan akta itu tidak juga ditugaskan atau dikecualikan kepada pejabat lain atau orang lain yang ditetapkan oleh undang-undang; 2) Para pihak membuat suratnya, di bawa ke kantor notaris, penandatanganan di hadapan notaris, dicatatkan dalam buku daftar legalisasi. Tanggal pada waktu ditandatangani dihadapan notaris adalah, sebagai tanggal sahnya perbuatan hukum yang dibuat para pihak, yang mengakibatkan hak dan kewajiban antara para pihak; 3) akad bertujuan untuk memenuhi kebutuhan hidup dan pengembangan usaha masing-masing pihak yang mengadakan akad, sighat akad dapat dilakukan dengan jelas, baik secara lisan, tulisan, dan/atau perbuatan.

Abstract

This research is motivated by the existence of various additional fees in Shopee Pinjam (SPinjam), but with regard to the meaning of this additional fee, several scholars do not agree on the exact meaning of this additional fee. Therefore, the researcher wants to examine the meaning of additional fees in Shopee Pinjam from the perspective of the fatwa of the National Sharia Council-Majelis Ulama Indonesia whether it is contradictory or not. This research employs normative and empirical research methods. The results of this study indicate that: 1) SPinjamm users know the amount of additional fees from the beginning. The additional fees in SPinjam are a 5% installment fee, a 1% disbursement fee, a 0.3% SPinjam protection fee, and a 5% late fee. These additional fees are not a burden to users. The additional fees charged in SPinjam can relieve the lender party and can provide prudence to the borrowers so that they are disciplined and not negligent in paying loans. 2) The additional fees in SPinjam are not among the additional fees prohibited in the fatwa of DSN-MUI because these additional fees are part of the improvement and maintenance of the company's systems and facilities. Moreover, this additional fee in SPinjam is in accordance with the general provisions of Fatwa DSN-MUI No. 117/DSN-MUI/2018 in point 5 of the general provisions and Fatwa DSN-MUI No. 19/DSN-MUI/IV/2001 in point 3 of the general provisions.
