Abstract

Despite Constitutional Court Decision No. 97/PUU-XIV/2016 affirming their constitutional rights, fulfilling educational access for youth adherents of indigenous beliefs remains a critical issue in Indonesia. The primary obstacles include administrative discrimination, the absence of relevant curricula, and social stigma limiting inclusive education. This study employs a juridical-empirical method with socio-legal, historical, and statutory approaches, utilizing Progressive Law and Recognition Theory as analytical frameworks. Data were collected through interviews with parents and education officials in Sumba, alongside an analysis of primary and secondary legal materials. Findings reveal a sharp gap between juridical legitimacy and field implementation, where Marapu youth face structural discrimination and social misrecognition. Bureaucratic formalism compels identity coercion, while exclusive curricula alienate students. Consequently, this study recommends progressive legal transformation through policy breakthroughs and strengthened socio-cultural recognition to achieve substantive inclusive education.

Abstract

The increasing complexity of the global environmental crisis necessitates more contextual, culturally grounded, and transformative approaches to environmental education. Conventional models of environmental education often rely on technocratic and universalized frameworks that insufficiently engage with local cultural values and indigenous ecological knowledge systems. This study examines the potential of local ecological rituals in Indonesia, including Nyepi in Bali, Selamatan Laut in the northern coastal region of Java, and Syukuran Panen in agrarian communities, as culturally embedded pedagogical instruments for cultivating ecological ethos and strengthening environmental rights. Employing a qualitative conceptual approach, this research integrates socio-legal analysis, cultural studies, ecopedagogy, legal pluralism, and environmental justice theory to examine the intersection between indigenous ecological rituals, environmental education, and the right to a healthy environment. The study primarily relies on literature review, content analysis, and comparative conceptual mapping, supplemented by limited field observations conducted in coastal communities in Brebes, Northern Java, in 2024. The findings demonstrate that local ecological rituals embody conservation ethics, collective environmental responsibility, reciprocity between humans and nature, and socio-cultural mechanisms for transmitting ecological values across generations. Furthermore, the study argues that integrating ritual-based ecological knowledge into environmental education can strengthen environmental legal consciousness, support culturally responsive sustainability education, and contribute to the recognition of customary ecological practices within Indonesia’s pluralistic environmental governance framework. This study concludes that interdisciplinary collaboration among the fields of law, education, culture, and environmental governance is essential for developing inclusive and culturally rooted environmental policies capable of advancing ecological sustainability and environmental justice.

Abstract

Pengelolaan sampah yang berkelanjutan menjadi tantangan utama dalam pembangunan desa. Penelitian ini menganalisis peran kepala desa dan pemerintah kalurahan dalam mendorong pengelolaan sampah berbasis komunitas di Kalurahan Bawuran, Pleret, Bantul, menggunakan pendekatan sosiologi hukum dan teori kepemimpinan transformasional. Data dikumpulkan melalui wawancara, observasi dan studi literatur yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa kepala desa dan pemerintah kalurahan berperan sebagai fasilitator, inovator, dan penggerak masyarakat dalam menciptakan sistem pengelolaan sampah yang inklusif dan berkelanjutan. Kepemimpinan transformasional, dukungan kebijakan desa, partisipasi aktif warga, dan ketersediaan infrastruktur menjadi faktor kunci keberhasilan program. Selain itu, legitimasi sosial terhadap kebijakan desa dan keterlibatan komunitas lokal merupakan syarat penting untuk efektivitas pengelolaan lingkungan. Penelitian ini memberikan kontribusi pada diskursus pembangunan sosial desa dengan menyoroti pentingnya sinergi antara tata kelola lokal dan partisipasi komunitas dalam mewujudkan tujuan pembangunan berkelanjutan. Temuan ini relevan untuk memperkuat desain kebijakan sosial lingkungan yang responsif dan partisipatif di tingkat lokal.

Abstract

The global climate crisis and the imperative of sustainable development have positioned energy transition as a crucial agenda. In the Indonesian context, despite the constitutional mandate towards a welfare state, the implementation of energy transition policies has not fully reflected these principles. This study aims to analyze the energy law politics of energy transition in Indonesia from the perspective of the welfare state and to explore the potential of the green welfare state as a more comprehensive alternative framework. The research methodology employed is a normative legal study with statutory and conceptual approaches. Data were collected through the analysis of relevant legislation and literature, which were subsequently analyzed qualitatively using content analysis. The research findings indicate that the current implementation of energy transition policies still faces significant challenges in realizing equitable energy access, the protection of vulnerable groups, meaningful public participation, and the proactive role of the state in regulation and oversight. This study concludes that the green welfare state framework, underpinned by the philosophy of ecocentrism and intergenerational justice, and integrating social and ecological justice, offers a more holistic approach to reformulating just and sustainable energy law politics in Indonesia. The implementation of this framework necessitates a strong state commitment, inclusive participation from all stakeholders, and the establishment of regulations that support a just and environmentally friendly transition.

Abstract

The shrimp trade dispute between Indonesia and the United States over the past two decades reflects the complex dynamics surrounding the application of antidumping (AD) and countervailing duty (CVD) measures within the multilateral trading system. This study aims to analyze the implementation of these trade remedy instruments, assess their consistency with World Trade Organization (WTO) legal principles, and formulate policy implications for strengthening Indonesia’s response to trade remedies. The research employs a normative juridical approach, complemented by an analysis of trade data and fisheries sector policies, in order to provide a comprehensive synthesis of legal and economic dimensions. The findings indicate that the imposition of AD and CVD measures by the United States on Indonesian shrimp exports has been recurrent, primarily through investigations and annual administrative reviews. Such practices have generated tariff uncertainty and exerted pressure on Indonesia’s export price competitiveness. Although AD and CVD instruments are recognized under the WTO framework as legitimate tools to address unfair trade practices, their application in this case raises concerns regarding compliance with core WTO principles, including non-discrimination, transparency, due process, and the methodologies used in determining dumping margins and actionable subsidies. The more pronounced fluctuation in export value compared to export volume suggests that the primary impact of these measures lies in reduced profit margins rather than diminished market access. The study further reveals that Indonesia’s defense strategies, through active participation in investigations, trade diplomacy, and WTO-based legal argumentation, have succeeded in reducing dumping margins in certain review periods. However, these efforts remain largely reactive. Structural challenges such as limited data capacity, institutional coordination, and litigation financing require substantial improvement. Policy implications highlight the urgency of developing an early warning system, harmonizing domestic subsidy policies with WTO rules, enhancing exporters’ technical and legal capacity, and diversifying export markets. A comprehensive and preventive approach is essential to strengthen national trade resilience and enhance Indonesia’s bargaining position amid rising global protectionism.
