Abstract

This study aims to reconstruct the juridical understanding of cooperatives as pillars of the Indonesian economy amid regulatory dynamics and to analyze procedural obstacles in member-dispute litigation against the state critically. The research method used is normative jurisprudence, with a statutory approach and a case approach. The results show that the legal aspects of Indonesian cooperatives are undergoing a crucial transition, returning substantively to the family-based regime of Law Number 25 of 1992 following the annulment of Law Number 17 of 2012, while administratively transforming digitally through the Minister of Law and Human Rights Regulation Number 13 of 2025 concerning Cooperative Legalization. This study also found that, in the case study of ‎the Ponorogo District Court Decision Number 19/PDT.G/2024/PN/PNG, the failure of cooperative members to claim damages was caused by formal defects in applying the Persona Standi in Judicio doctrine and non-compliance with Class Action requirements. The conclusion emphasizes that legal protection for cooperative members requires integrating an understanding of cooperative identity, digital administrative compliance, and appropriate litigation strategies, while reaffirming the limits of state liability, which does not automatically serve as a guarantor of dissolved cooperative debts.‎

Abstract

Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan (UUAP) memperluas objek pengawasan peradilan melampaui beschikking tradisional hingga mencakup Tindakan Faktual (feitelijke handelingen). Artikel ini mengkaji rasio legis dan reposisi Asas Contrarius Actus terhadap Tindakan Faktual, serta implikasi yuridis perluasan kompetensi absolut PTUN atas penghentiannya. Melalui metode yuridis normatif, ditemukan bahwa penerapan asas ini pada Tindakan Faktual menghasilkan tegangan normatif karena sifat irreversible tindakan tersebut tidak dapat direspons sekadar dengan skema pencabutan formal-retroaktif. Selain itu, kompetensi absolut PTUN (Pasal 87 UUAP) memunculkan ambiguitas struktural saat berhadapan dengan Tindakan Faktual yang telah selesai, sehingga membutuhkan rekonstruksi remedial yang berorientasi pada penghentian dan pemulihan, bukan sekadar pembatalan.

Abstract

This study aims to critically examine the potential violations of the constitutional right to a good and healthy environment arising from the government’s policy of granting Special Mining Business Permit Areas (WIUPK) to religious community organizations. The urgency of this research is based on concerns that these organizations, lacking adequate technical competence, may exacerbate environmental degradation, perpetuate violations left by previous permit holders, hinder the transition to renewable energy, and obstruct access to justice for victims of environmental harm. Using a normative juridical method with legislative and conceptual approaches, this study analyzes the policy from the perspective of environmental human rights, a focus absent in prior research. The findings reveal that the policy has a strong potential to violate the right to a good and healthy environment and contradicts the state’s obligation to protect human rights as guaranteed by the 1945 Constitution. The novelty of this research lies in its emphasis on the conflict of interest between the traditional role of religious organizations as community advocates and their new role as mining operators. Therefore, it is recommended that the government review and revoke the priority granting scheme for WIUPK and consider alternative participation models for religious organizations through non-operational mechanisms such as community development funds or minority non-controlling share ownership.
