Penelitian ini bertujuan untuk: (1) mengetahui efektivitas penyelesaian sengketa tanah melalui mediasi di Kantor Pertanahan Kota Makassar; (2) mengidentifikasi faktor-faktor yang menyebabkan kegagalan dalam proses mediasi di Kantor Pertanahan Kota Makassar. Penelitian ini dilakukan di Kota Makassar pada Kantor Pertanahan Kota Makassar, menggunakan metode penelitian kualitatif dengan pendekatan empiris, Sumber data primer diperoleh melalui wawancara. Teknik analisis data yang digunakan yaitu deskriptif kualitatif. Hasil penelitian menunjukkan bahwa: (1) mediasi telah diterapkan sebagai salah satu alternatif penyelesaian sengketa tanah, namun pelaksanaannya belum berjalan secara efektif. Dari 21 kasus sengketa tanah yang tercatat selama periode 2022–2024, hanya 4 kasus yang berhasil diselesaikan melalui mediasi, sementara sisanya diselesaikan melalui jalur litigasi; (2) Faktor-faktor penyebab kegagalan mediasi antara lain: ketidakhadiran salah satu pihak dalam forum mediasi, ketidaklengkapan dokumen administratif, kesulitan menyatukan waktu kehadiran para pihak, ketidakpahaman terhadap prosedur mediasi, serta sikap tidak kooperatif dan merasa paling benar dari salah satu pihak yang menghambat proses kompromi. meskipun mediasi merupakan sarana penyelesaian sengketa yang murah dan cepat, efektivitasnya sangat bergantung pada kesediaan dan itikad baik para pihak untuk mencapai kesepakatan bersama. This study aims to (1). determine the effectiveness of land dispute resolution through mediation at the Makassar City Land Office. (2). identify factors that cause failure in the mediation process at the Makassar City Land Office. This study was conducted in Makassar City at the Makassar City Land Office. The research method used is empirical qualitative, Primary data sources were obtained through interviews. The data analysis technique used is qualitative descriptive. The results of the study indicate that (1). mediation has been implemented as an alternative resolution of land disputes, but its implementation has not been effective. Of the 21 land dispute cases recorded during the 2022–2024 period, only 4 cases were successfully resolved through mediation, while the rest were resolved through litigation. (2). Factors causing mediation failure include: the absence of one of the parties in the mediation forum, incomplete administrative documents, difficulty in unifying the attendance times of the parties, lack of understanding of mediation procedures, and an uncooperative attitude and feeling of being the most right from one of the parties that hinder the compromise process. Although mediation is a cheap and fast means of resolving disputes, its effectiveness depends heavily on the willingness and good faith of the parties to reach a mutual agreement.
