Abstract

Penelitian ini bertujuan untuk mengetahui hubungan antara penerapan good governance berbasis reformasi birokrasi, dan E-goverment dalam rangka meningkatkan efisiensi penyelenggaraan pemerintahan di Kabupaten Wonogiri. Penelitian ini juga menggunakan metode penelitian kualitatif dengan teknik pengumpulan data berupa teknik deskriptif analitis yang dijelaskan atau dibahas secara deskriptif dan didasarkan pada tinjauan literatur yang relevan dengan cara mempelajari dan mengumpulkan data yang diambil dari artikel-artikel yang dipublikasikan dalam berbagai jurnal ilmiah dan kumpulan buku. Instrumen yang digunakan berupa data sekunder yang diacu dari tinjauan Pustaka yang relevan. Dalam upaya meningkatkan penyelengaraan pemerintahan, Kabupaten Wonogiri melakukan reformasi birokrasi berbasis kontrak kerja dimana penyelengara pemerintahan seperti kepala daerah, selalu dituntut untuk mencapai target kerja yang telah di tentukan. Hasil penelitian ini menunjukkan dalam penerapan reformasi birokrasinya untuk mencapai good governance pemerintah Kabupaten Wonogiri menggunakan konsep kontrak kerja berjalan baik dengan output berupa evaluasi kerja menggunakan konsep kontrak kerja yang memanfaatkan teknologi (e-government) sehingga dapat lebih transparan. Hal ini dikbuktikan dari beberapa aspek, seperti penggunaan e-government terkait dengan pembentukan praktik tata kelola yang baik, pelaksanaan good governance terkait dengan reformasi kelembagaan birokrasi, terdapat hubungan antara kinerja dan electronic government, kinerja dengan reformasi birokrasi, dan penerapan good governance dengan kinerja. Abstract

This research examines and analyzes the concept and regulation of the trademark dilution doctrine, which has long developed in the United States, as a form of legal comparison, as well as the implementation of the dilution doctrine in the substantive examination of trademark registration in Indonesia. The research method used is normative juridical research employing statutory, conceptual, comparative, and case study approaches. This study uses secondary data in the form of primary, secondary, and tertiary legal materials, which are then qualitatively analyzed. Data collection techniques involve literature study by tracing widely published written information. The results of this study show that trademark violations in Indonesia are dominated by imitation marks, thereby requiring legal reform in trademark law through the adoption of the dilution doctrine similar to that of the United States. Article 21 paragraph (1)(c) of the Indonesian Trademark and Geographical Indication Law mandates the application of the dilution doctrine, although it does not explicitly regulate it. This indicates that Indonesia has the potential to implement the dilution doctrine. However, the significant differences between the United States and Indonesia make full implementation of the doctrine difficult. One of the main challenges in implementing the dilution doctrine is the communal character of Indonesian society. When analyzed using Jeremy Bentham’s Utilitarianism Theory, the result shows that implementing the dilution doctrine would produce greater pain for Indonesia. Therefore, adjustments and legal formulations are needed to accommodate the interests of all parties, including clear and detailed regulations that govern dispute resolution and evidentiary standards in court. The implementation of the dilution doctrine in substantive examination also needs to be tightened to reduce future trademark disputes.

Abstract

The development of digital technology in the construction industry has led to major innovations through the implementation of Building Information Modelling (BIM), which enables cross-disciplinary collaboration within a single integrated digital model. However, this transformation also presents new legal challenges, particularly regarding the allocation of responsibility in the event of construction failures. This study aims to analyse how contractual clauses govern risk distribution associated with BIM use and how digital collaboration practices shape the determination of legal liability in real-world projects. Using a qualitative approach grounded in literature review and normative analysis, it was found that the collaborative nature of BIM blurs the traditional boundaries between designers, contractors, and project owners. The lack of clear regulations and the weak implementation of the BIM Execution Plan (BEP) often make it difficult to identify the liable party in cases of design errors or technical failures. Therefore, reformulation of contracts and regulations is required to explicitly define rights, obligations, and digital audit mechanisms to ensure legal certainty. In conclusion, the use of BIM demands comprehensive legal adaptation to balance technological efficiency and professional accountability in the era of digital construction.
