Abstract

The National Health Insurance (Jaminan Kesehatan Nasional/JKN) program guarantees the right to healthcare; yet, claims disputes between hospitals and Badan Penyelenggara Jaminan Sosial (BPJS) Health expose persistent imbalances in their resolution. Despite normative pathways encompassing deliberation, mediation, and litigation, objections to claim verification are resolved internally by BPJS Health, while judicial recourse is rarely pursued even in the presence of substantial pending claims. This study analyses existing dispute resolution mechanisms through rechtsstaat and machtsstaat perspectives and formulates an integrated Online Dispute Resolution (ODR) model to ensure party equality and protect participants' rights. Employing a normative juridical method with statutory, case, conceptual, and comparative approaches alongside empirical searches of the Supreme Court Decision Directory the study draws on rule of law theory and Nonet and Selznick's responsive law theory. The findings indicate that the current mechanism falls short of substantive rechtsstaat standards and reflects machtsstaat residues, as the principle of nemo judex in causa sua is not fully upheld. The proposed integrated ODR model consolidates negotiation, mediation, clinical panel review, and arbitration into a single independent digital platform. Rather than creating new institutional authority, the model unifies mechanisms already recognized under Indonesian law into a more transparent, equitable, and accountable process, thereby restoring party parity and protecting participants' constitutional rights as a realization of substantive rechtsstaat.

Abstract

Sejak kemerdekaan, Indonesia menganut politik luar negeri bebas aktif untuk menjaga perdamaian dunia tanpa subordinasi pada kekuatan hegemonik. Namun, keikutsertaan dalam Board of Peace (BoP) menimbulkan persoalan terkait kesesuaian dengan prinsip kedaulatan negara dan konsep Rechtsstaat serta Machtsstaat. Penelitian ini bertujuan untuk menganalisis implementasi politik luar negeri bebas aktif Indonesia dalam BoP, dan menganalisis struktur BoP dengan hak veto absolut ditinjau dari perspektif Rechtsstaat dan Machtsstaat. Penelitian ini menggunakan metode normatif dengan pendekatan perundang-undangan dan konseptual, serta bahan hukum primer berupa UUD 1945, UU No. 24 Tahun 2000, dan Piagam BoP. Analisis dilakukan secara kualitatif dengan deskriptif-analitis dan preskriptif. Hasil penelitian menunjukkan bahwa keikutsertaan Indonesia dalam BoP mencerminkan unsur aktif politik luar negeri melalui partisipasi dalam rekonstruksi pascakonflik Gaza. Namun, unsur bebas tidak sepenuhnya terpenuhi karena struktur BoP memberikan hak veto absolut kepada ketua, sehingga berpotensi mengurangi kesetaraan dan independensi negara anggota. Struktur BoP lebih mencerminkan karakteristik Machtsstaat dibanding Rechtsstaat karena adanya pemusatan kewenangan, lemahnya akuntabilitas, serta belum optimalnya penerapan prinsip sovereign equality of states. Dalam kerangka politik bebas aktif, keterlibatan Indonesia di BoP hanya dapat memperkuat posisi kedaulatan apabila prinsip kesetaraan, independensi diplomasi, dan akuntabilitas organisasi dijunjung tinggi.

Abstract

The rapid digitalization of the financial services sector has improved efficiency, but it has also increased the risk of personal data breaches, which may result in financial losses, including the emergence of fake debtors. This study aims to analyze the scope of corporate legal liability as a Personal Data Controller in cases of personal data breaches and to identify obstacles in supervising personal data protection. This research employs a normative juridical method using secondary legal materials, supported by empirical data obtained through interviews. Data were analyzed using qualitative normative analysis. The findings indicate that corporate entities remain legally liable under Articles 67 and 70 of Law Number 27 of 2022 concerning Personal Data Protection, even when violations are committed by internal personnel. Such liability is based on the principles of vicarious liability and strict liability, requiring corporations to ensure data security through effective supervision and risk management systems. However, the implementation of personal data protection faces significant challenges, including weak compliance culture, low employee awareness, limited technological monitoring, and inconsistent internal policies. Therefore, strengthening data governance through technological enhancement, mandatory employee training, and consistent regulatory supervision is essential to ensure legal certainty and the protection of consumer privacy rights in the financial services sector.
