Abstract

Reformasi hukum administrasi negara di Indonesia ditandai dengan lahirnya Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan yang memperluas ruang lingkup kontrol terhadap tindakan pemerintahan. Penelitian ini bertujuan untuk menganalisis perubahan peran Peradilan Tata Usaha Negara (PTUN) dalam mengawal akuntabilitas penyelenggaraan pemerintahan pasca berlakunya undang-undang tersebut. Pendekatan yang digunakan adalah yuridis-normatif dengan dukungan data sekunder dari putusan pengadilan, literatur hukum, serta regulasi terkait. Temuan utama menunjukkan bahwa PTUN tidak lagi hanya berfungsi sebagai pengadil legalitas keputusan administratif, tetapi telah berkembang menjadi lembaga korektif yang turut menilai prosedur, substansi, dan unsur penyalahgunaan wewenang. Terdapat peningkatan jumlah perkara yang melibatkan tindakan pejabat tata usaha negara non-keputusan formal, menunjukkan bergesernya orientasi perkara TUN dari formalistik ke substantif. Peran korektif ini menandai terjadinya transformasi fungsi PTUN sebagai penjaga prinsip good governance dan rule of law dalam praktik administrasi negara. Kesimpulannya, PTUN kini berperan strategis dalam membentuk standar akuntabilitas administratif yang lebih progresif. Implikasi dari temuan ini menuntut pembaruan kelembagaan dan peningkatan kapasitas hakim administrasi agar mampu merespons kompleksitas perkara tata usaha negara secara adaptif dan berkeadilan.

Abstract

This article examines the long-term challenge of national integration in Indonesia through the historical development of constitutional arrangements and their interaction with contemporary governance practices. It explains how federalism, unitarism, and center–region relations continue to influence political stability and national cohesion. The study applies normative legal research supported by historical and conceptual analysis. Primary materials include constitutional documents and state policies, while secondary materials cover scholarly works on decentralization, separatism, governance, and disaster management. The findings show that Indonesia’s integration problems are rooted in structural inequality, unresolved historical legacies, and governance practices that reinforce perceptions of regional marginalization. The article also finds that federalism operates less as a realistic constitutional alternative than as a symbolic political discourse that re-emerges during crises, including the 2025 hydrometeorological disaster in Sumatra. It concludes that constitutional design alone is insufficient to sustain national integration without inclusive governance, equitable development, institutional responsiveness, and stronger public trust

Abstract

This study aims to analyse the regulation of termination of employment in Indonesia following the enactment of Law No. 6 of 2023 on Job Creation, compare it with the legal framework in South Korea, and propose a reconstructed model that ensures a more balanced and equitable employment termination system. Termination of employment (PHK) remains a central issue in labour law because it directly affects workers’ rights, the stability of industrial relations, and sustainable economic development. The enactment of Law No. 6 of 2023 on Job Creation has introduced significant changes to Indonesia’s employment termination framework, reflecting a shift toward greater labour market flexibility while raising concerns regarding legal certainty and the adequacy of worker protection. This study employs normative legal research using statutory and comparative law approaches through an analysis of legislation, judicial decisions, and relevant scholarly literature. The findings reveal that Indonesia’s current regulatory framework primarily focuses on post-termination compensation, while providing insufficient safeguards regarding substantive grounds for dismissal and preventive procedural protections. In contrast, South Korea adopts the principle of dismissal for just cause, supported by strict and participatory dismissal procedures, comprehensive unemployment insurance, and active labour market policies. Based on this comparative analysis, the article proposes a reconstructed model for Indonesia that incorporates clear limitations on dismissal based on valid and objective grounds, strengthens preventive and transparent dismissal procedures, and expands comprehensive post-termination social protection. The proposed model is expected to achieve a more balanced relationship between labour market flexibility and worker protection while enhancing legal certainty and fairness within Indonesia’s industrial relations system.
