Abstract

This study aims to analyze the implementation of industrial relations for Indonesian Migrant Workers (PMI) in Malaysia using a decent work indicator approach, both prioritized and marginalized in the migration decision-making process. This study uses a normative-empirical legal research method, which combines an analysis of labor laws and regulations in Indonesia and Malaysia, including bilateral Memorandum of Understanding (MoU), with empirical findings in the field. Empirical data were obtained through in-depth interviews with 30 PMIs working in the formal sector in Malaysia, who were selected purposively. The results show that decent work indicators that are the main priority for PMI include legal employment opportunities, relatively higher income, more regular working hours, and access to basic social security for legal migrant workers. These indicators are perceived to provide direct economic benefits and certainty of employment status, thus becoming the dominant factors driving migration to Malaysia. In contrast, decent work indicators related to long-term social protection and worker participation—such as job stability and security, work-life balance, a preventatively safe work environment, and social dialogue and worker representation—tend to be marginalized by migrant workers. Although both countries have legal frameworks that are relatively aligned with International Labour Organization (ILO) standards, their implementation remains selective and does not fully protect the interests of migrant workers. This study concludes that Indonesia–Malaysia transnational industrial relations function more as a migrant worker management mechanism than as a comprehensive protection instrument. Abstract

Penelitian ini bermaksud untuk mengetahui, menganalisis, dan menjelaskan penerapan Pasal 52 Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan, khususnya mengenai peran pengadilan dalam menetapkan perubahan nama akibat kesalahan pencatatan identitas serta implikasi hukum yang muncul setelah penetapan diberikan. Kesalahan data pada akta kelahiran yang tidak sesuai dengan dokumen resmi lainnya sering menimbulkan hambatan administrasi bagi masyarakat, sehingga diperlukan mekanisme hukum yang dapat memberikan kepastian. Pada penelitian ini digunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan serta kajian konseptual melalui analisis terhadap ketentuan hukum, literatur, serta putusan pengadilan. Hasil penelitian menunjukkan bahwa penetapan pengadilan merupakan langkah yang harus ditempuh agar perubahan nama dapat dicatatkan secara sah, sekaligus menjadi dasar pembaruan seluruh dokumen kependudukan. Implikasi hukumnya antara lain terciptanya kesesuaian identitas pada seluruh dokumen resmi, terjaminnya kepastian dan perlindungan hukum bagi pemohon, serta berkurangnya potensi sengketa administrasi di kemudian hari. Penelitian ini menyimpulkan bahwa mekanisme perubahan nama melalui pengadilan tidak hanya menetapkan perubahan identitas, tetapi juga memastikan tertib administrasi dan perlindungan hak-hak keperdataan warga negara.

Abstract

The digitalization of business in Indonesia has brought significant changes to transaction patterns and consumer–business relationships. However, this rapid growth has also raised several new consumer protection issues, including online fraud, violations of privacy rights, and unclear legal responsibilities for digital businesses. This study aims to analyze the importance of consumer protection in Indonesia’s digital business landscape and identify issues and solutions to strengthen it. The research method applied is the normative juridical method through case studies, a review of related literature, and an examination of statutory regulations. The findings reveal that current consumer protection frameworks, such as the Law on Electronic Information and Transactions and Law Number 8 of 1999 on Consumer Protection, still contain many gaps in adapting to the evolving dynamics of online transactions. Regulatory reforms and the enhancement of consumer digital literacy are required to ensure legal protection is more effective and responsive to technological developments. In conclusion, collaboration among the government, businesses, and society is urgently needed to strengthen consumer protection in the digital era and to create a safe and equitable digital business environment.
