Abstract

This study aims to analyze the legal position and functional role of Rukun Tetangga (RT) as a preventive actor within the framework of environmental administrative law in densely populated urban areas. This research employs a normative juridical method enriched with limited empirical data obtained through document analysis, observation, and interviews, focusing on RT 08/RW 04 Malaka Jaya, East Jakarta. The findings reveal that RT can be conceptualized as a quasi-administrative actor and a grassroots environmental governance unit performing non-formal preventive administrative functions through internal environmental regulation, participatory decision-making, and community-based monitoring. These practices function as an early-stage preventive mechanism in addressing environmental degradation at the micro level, which is often beyond the reach of formal administrative instruments. The novelty of this study lies in positioning RT as a micro-administrative node that bridges legal norms (das Sollen) and social practices (das Sein), thereby expanding the scope of environmental administrative law to include community-based environmental governance as an integral component of environmental prevention systems. This study contributes theoretically by redefining the subject of environmental administrative law beyond state-centric actors and practically by offering a replicable model of community-based environmental governance as an early warning system.     Penelitian ini bertujuan untuk menganalisis kedudukan hukum dan peran Rukun Tetangga (RT) sebagai aktor preventif dalam kerangka hukum administrasi lingkungan di kawasan permukiman padat perkotaan. Penelitian ini menggunakan metode hukum normatif dengan pengayaan empiris terbatas melalui studi dokumen, observasi, dan wawancara, dengan fokus pada RT 08/RW 04 Malaka Jaya, Jakarta Timur. Hasil penelitian menunjukkan bahwa RT dapat dikonstruksikan sebagai quasi-administrative actor sekaligus unit tata kelola lingkungan berbasis komunitas yang menjalankan fungsi administratif nonformal yang bersifat preventif melalui pengaturan internal lingkungan, pengambilan keputusan partisipatif, dan pengawasan berbasis komunitas. Praktik tersebut berfungsi sebagai mekanisme pencegahan dini terhadap degradasi lingkungan pada level mikro yang belum terjangkau secara optimal oleh instrumen administratif formal. Kebaruan penelitian ini terletak pada konstruksi RT sebagai simpul administratif mikro yang menjembatani norma hukum (das Sollen) dan praktik sosial (das Sein), sekaligus memperluas cakupan hukum administrasi lingkungan dengan mengintegrasikan tata kelola lingkungan berbasis komunitas sebagai bagian dari sistem pencegahan lingkungan hidup. Penelitian ini memberikan kontribusi teoretis melalui redefinisi subjek hukum administrasi lingkungan yang tidak lagi bersifat state-centered, serta kontribusi praktis berupa model tata kelola lingkungan berbasis komunitas yang dapat direplikasi sebagai sistem peringatan dini.

Abstract

This study examines the use of Constitutional Court decisions in the academic manuscript of the Draft Law on the National Capital (RUU IKN) and evaluates its consistency with the 1945 Constitution, while drawing comparisons with governance models of other national capitals. The establishment of Ibu Kota Nusantara raises constitutional concerns because its governance design as an Authority excludes direct elections for regional leaders and the existence of a Regional House of Representatives. This design risks subordinating constitutional norms to political will, thereby undermining democratic principles. Using a normative juridical approach combined with comparative legal analysis, the research finds that the academic manuscript employs Constitutional Court rulings selectively, weakening constitutional guarantees of local democracy. Although the Court has recognized special governance status for certain regions, such as Papua and DKI Jakarta, these precedents have never eliminated democratic institutions, since both regions still maintain electoral and representative mechanisms. A comparison with Putrajaya, Malaysia, shows that centralistic governance may offer administrative efficiency but comes at the expense of political accountability and public participation. The study concludes that implementing the IKN Law without amendment will endanger constitutional legitimacy and set a harmful precedent for democratic governance. The novelty of this research lies in its critical perspective on how constitutional interpretation is instrumentalized in strategic policymaking, combining judicial analysis with comparative insights. Normatively, it recommends revising the IKN Law to align with constitutional principles of local democracy and strengthen safeguards for public participation and accountability.
