Abstract

Hukum keluarga Islam menghadapi tantangan baru ketika perkawinan usia dini, kerentanan ekonomi keluarga, dan lemahnya perlindungan anak pasca perceraian dipahami sebagai mata rantai kerentanan yang memengaruhi keberlanjutan generasi. Dalam literatur kontemporer, hukum keluarga dibahas dalam kerangka reformasi legislasi, perlindungan hak perempuan dan anak, serta implementasi peradilan, sementara pembacaannya sebagai fondasi ketahanan antargenerasi masih relatif terbatas. Artikel ini bertujuan menganalisis dan mengonstruksi argumentasi bahwa hukum keluarga Islam berkedudukan sebagai fondasi penting bagi ketahanan antargenerasi dalam perspektif maqasid al-shariah. Studi ini merupakan penelitian hukum normatif-doktrinal dengan pendekatan filosofis-konseptual, menggunakan literatur yang relevan dengan reformasi usia perkawinan, kewarisan, perlindungan anak, dan ketahanan keluarga. Hasil penelitian menunjukkan bahwa regulasi usia perkawinan menopang kesiapan generatif, hukum kewarisan dan wasiat menjaga kesinambungan ekonomi, sedangkan hadanah dan nafkah anak membentuk kualitas pengasuhan. Ketiga dimensi tersebut menegaskan perlunya penafsiran ulang hifdz al-nasl dari pemeliharaan garis keturunan menuju perlindungan kualitas keberlanjutan generasi. Artikel ini menyimpulkan bahwa hukum keluarga Islam merupakan perangkat normatif yang berorientasi jangka panjang dan merekomendasikan penguatan kebijakan keluarga yang lebih substantif, antisipatif, dan berperspektif ketahanan antargenerasi.

Abstract

This community service activity aims to optimize the role of women in empowering the family economy of street vendors (Pedagang Kaki Lima/PKL) in Sukosari Village, Jatiroto District, Lumajang Regency. The activity is motivated by the limited participation of female PKL in economic development at the village level, despite their significant potential in supporting family economy. The method employed is counseling and mentoring with a participatory approach involving 30 participants, comprising female street vendors, wives of neighborhood heads, and PKK (Family Welfare Empowerment) administrators. The activity was conducted over four months, encompassing stages of survey, entrepreneurship counseling, and evaluation. The results demonstrated an increase in participants' understanding of the importance of women's role in family economy, enhanced motivation to develop businesses, and heightened awareness of PKL rights in legal protection. The program recommends PKL data collection by local government, facilitation of capital access through Corporate Social Responsibility (CSR) programs, and a dialogic approach in PKL enforcement and policy-making.

Abstract

This article examines the governance of khuluk (wife-initiated divorce) in Indonesia’s legal system and its distinction from talak (husband-initiated divorce), or divorce initiated by the husband. Despite similar goal, khuluk requires the wife to pay iwadh (compensation) as economic exchange. Using a critical legal studies perspective, this research argues that khuluk and iwadh may reproduce gender inequality in contemporary Muslim society. The study employs normative legal research, drawing on conceptual and statute-based approaches, and uses documentation as the primary source of data. The data are analyzed through editing, classification, verification, interpretation, and conclusion drawing, with source triangulation used to ensure validity. The findings show that khuluk harms women because iwadh makes women seek khuluk under conditions of violence, pressure, or financial dependence, which weakens the idea of free consent. The article, therefore, calls for a progressive reinterpretation of khuluk to support gender justice and legal equity.

Abstract

Married couples of different nationalities must have a thorough understanding of the Religious Affairs Office's mixed marriage registration process because it has significant legal ramifications for the future of the family, including joint property ownership and the citizenship status of the children. This study looks at how mixed marriages are handled administratively at the Religious Affairs Office in Gumukmas District, Jember Regency, and considers the legal implications for citizenship status. A case study and legal approach are used in this empirical legal research, and interviews and documentation are used as data collection methods. The data is then subjected to a number of analysis techniques, including data editing, classification, verification, and analysis, before being presented in a succinct, clear, and straightforward but still engaging conclusion narrative. The findings of the study indicate that the Office of Religious Affairs is authorized to offer mixed marriage registration services in accordance with Minister of Religious Affairs Regulation Number 24 of 2024, subject to a number of administrative constraints. A permit from the appropriate Embassy, a Certificate of No Impediment, also known as a single letter, a copy of the passport, and, in the event that the foreign national's country of origin is unrelated, all documentation must be translated into Indonesian are additional requirements for mixed marriages. Because mixed marriages can result in such complicated legal implications, the Office of Religious Affairs' marriage registrars have a specific and urgent duty to educate prospective brides and grooms about the significance of the administrative process. Mixed marriages have legal implications for both husband and wife since they provide them the option to keep their individual citizenships or adopt their partner's citizenship. The citizenship status of children from mixed marriages is also affected; for example, children from mixed marriages retain dual citizenship until they turn 18 until they choose to adopt their mother's or father's citizenship.
