Abstract

The word marriage comes Arabic namely nakaha and zawaja, and the meaning is to join and nakaha means marriage while aqad means agreement. So a marriage contract means a sacred agreement to bind yourself in marriage between men and women to form a happy family that is in accordance with Islamic law as devout moslims we will not be separated from Islamic law as a law that must obeyed by all moslims throughout the world.One of Islamic law is to regulate marriage, talak, divorce and refer to, these four things have been regulated in Islamic law, both in the quran and in the hadith. Marriage is an event that we often encounter in society even every day the Islamic community does marriage.

Abstract

Beragamnya agama yang ada di Indonesia, menyebabkan perkawinan beda agama rentan terjadi. Perkawinan beda agama akan berimplikasi kepada adanya kewarisan beda agama jika salah satu pasangan meninggal dunia, sehingga akhirnya akan menjadi sengketa waris. Para ulama fikih telah sepakat bahwa antara muslim dengan non muslim tidak saling mewaris, meskipun sebagian ulama membolehkan terjadinya peralihan harta melalui wasiat wajibah. Secara normatif tidak ada hukum positif yang mendasari pemberian wasiat wajibah kepada istri yang tidak beragama Islam. Kompilasi Hukum Islam hanya mengatur wasiat wajibah kepada anak angkat atau orang tua angkat.  Kekosongan hukum tersebut kemudian mendorong Mahkamah Agung Republik Indonesia memberikan putusan untuk memberikan bagian harta dari suami/istri non muslim melalui mekanisme wasiat wajibah. Berdasarkan konsideran tersebut, maka perlu dipertanyakan bagaimana wasiat wajibah terhadap non muslim dalam perspektif KHI, serta apa yang menjadi dasar Putusan Mahkamah Agung RI memutuskan pemberian wasiat wajibah kepada istri non muslim. Penelitian ini adalah penelitian hukum normatif dengan sumber data berasal dari data sekunder. Hasil penelitian ini adalah bahwa pertimbangan yang menjadi dasar terbitnya Putusan Nomor 16 AK/G/2010 itu adalah rasa keadilan serya kemanusiaan, disebabkan istri telah mengabdikan dirinya selama 18 tahun dan bergaul dengan suami secara rukun dan baik.

Abstract

Allah Almighty created humans as beings who cannot live without helping each other. One of the human activities in Muamalah is wages, in Fiqh it is called Ujrah. Wages are an issue that cannot be solved through discussion by parties or organizations, both private and government. It's as if wages are a task that always makes management think about setting policy. Islam offers the best solution to the wage problem to protect the interests of workers and employers without violating the legal rights of employers. The concept of Wages is established in the most appropriate way without putting pressure on any party. This type of research is descriptive qualitative and uses secondary data collection techniques. The results showed that  the pillars and wage requirements were as follows:  Wages and Workers (Mu'jir and Musta'jir), Shighat (Ijab Qabul), wages or rewards, and the existence of expediency.  Wages can be grouped into two parts, namely as follows: The wages already mentioned (Ajrul Musamma) Y i.e. the wages mentioned at the beginning of the transaction, the condition is that when it is mentioned it must be accompanied by a willingness (received) by both parties, Commensurate wages (ajrul mistli) Is a wage that is commensurate with its work and commensurate with the conditions of work.  In general, the provisions of islamic law regarding the determination of the payment of wages are as follows:  Wages are paid as soon as possible, Wages are given according to their ability and achievements, Wages are mentioned before work begins, and Wages are paid appropriately

Abstract

Kompas kiblat adalah alat yang digunakan untuk menentukan arah kiblat dengan memanfaatkan medan magnet bumi.  Alat tersebut dapat mengukur arah kiblat dengan mudah. Pengabdian bertujuan untuk melatih mahasiswa Fakultas Agama Islam Universitas Muhammadiyah Sumatera Utara dalam membuat kompas kiblat. Kegiatan ini dilakukan dalam tiga tahap yaitu tahap pendahuluan, tahap pembuatan, dan tahap evaluasi. Mahasiswa beranggapan bahwa pelatihan ini mudah dan menyenangkan. Selain itu, pelatihan ini dapat membuat mahasiswa lebih memahami bagaimana cara menentukan arah kiblat dengan mudah. Kendalanya hanya pada proses perhitungan arah kiblat menggunakan trigonometri bola karena tidak semua mahasiswa baik dalam melakukan perhitungan. Keyword : Kiblat, Kompas kiblat, Ilmu Falak.

Abstract

Penelitian ini bertujuan untuk melihat support system yang dilakukan oleh lembaga keuangan syariah kepada UMKM halal yang ada di kota Medan. Selama ini banyak Lembaga keuangan yang memberikan pembiayaan kepada UMKM tanpa adanya pembinaan kepada pengusaha untuk melakukan pengembangan usaha. Dimana Lembaga keuangan hanya memberikan uang dan nasabah wajib mengembalikan, tetapi Ketika pengusaha ingin mengembangkan produknya, bank atau Lembaga keuangan tidak mampu untuk memberikan edukasi terkait pengembangan yang akan dilakukan pengusaha. Penelitian ini merupakan penelitian kualitatif deskriptif, dimana peneliti melakukan wawancara kepada objek yang dinginkan, kemudian menarasikannya dan mengambil kesimpulan dari hasil wawancara yang dilakukan. Dari hasil penelitian yang didapatkan, bahwa bank syariah atau Lembaga keuangan syariah, ada yang memberikan pelatihan tentang pengembangan usaha, ada juga yang hanya sekedar memberikan pembiayaan. Pembiayaan yang digunakan dalam penelitian ini menggunakan akad murabahah bil wakalah.

Abstract

This study aims to see the support system carried out by Islamic financial institutions to halal MSMEs in the city of Medan. So far, many financial institutions have provided financing to MSMEs without any guidance to entrepreneurs to carry out business development. Where financial institutions only give money and customers are obliged to return, but when entrepreneurs want to develop their products, banks or financial institutions are unable to provide education related to the development that entrepreneurs will make. This research is a descriptive qualitative research, where the researcher conducts an interview with the object that is cooled, then narrates it and draws conclusions from the results of the interview conducted. From the results of the research obtained, that Islamic banks or Islamic financial institutions, some provide training on business development, some are just providing financing. The financing used in this study used the murabahah bil wakalah contract

Abstract

This study aims to analyze the influence of technology, trust and risk, and Sharia compliance on the adoption of Sharia-based cashless payment systems among the people of Medan City. A quantitative approach was employed using a survey method through questionnaires distributed to respondents who were familiar with or had experience using Sharia-based cashless payment services. The data were analyzed using Structural Equation Modeling-Partial Least Squares (SEM-PLS) with SmartPLS software. The results indicate that technology has a significant effect on the adoption of Sharia-based cashless payments, with a p-value of 0.027. Meanwhile, trust and risk (p-value = 0.462) and Sharia compliance (p-value = 0.166) do not have a significant effect on adoption. The R-Square value of 0.143 indicates that the independent variables explain 14.3% of the variance in Sharia-based cashless payment adoption, while the remaining variance is influenced by other factors outside the research model. These findings suggest that technology is the primary factor influencing users’ decisions to adopt Sharia-based digital payment services. The study provides practical insights for Islamic banks, digital payment providers, and regulators in developing a more effective, inclusive, and sustainable Islamic digital payment ecosystem.

Abstract

Introduction to The Problem: Despite North Sumatra’s large Muslim population and economic capacity, its Waqf Index ranking remains among the lowest in Indonesia. This paradox raises questions about the underlying behavioral, institutional, and social factors that shape individual intention to participate in cash waqf. Purpose/Objective Study: This study aims to investigate the determinants of waqf behavioral intention by examining the influence of the Theory of Planned Behavior (TPB), Institutional Theory (IT), and Social Exchange Theory (SET). Design/Methodology/Approach:Using regression-based path analysis, this research analyzes responses from 100 individuals in North Sumatra collected via Google Form. Each construct (TPB, IT, SET) is operationalized through its subdimensions. Behavioral intention serves as the dependent variable. Findings: The results reveal that TPB significantly predicts waqf behavioral intention, while IT and SET do not show direct significance. TPB alone accounts for the most substantial influence, suggesting that attitudes, perceived social norms, and perceived behavioral control are key drivers of waqf participation in the region.
