Abstract

Every individual has the right to decent work and fair employment conditions. However, many Indonesian citizens face difficulties in obtaining employment due to age restrictions imposed during recruitment, despite having adequate skills and productivity. This study aims to analyze the legal politics of age limitations in labor recruitment and examine their implications for employment policies. Using a socio-legal research method, this study combines normative legal analysis with social and non-legal approaches, supported by statutory and legal theory perspectives. The findings indicate that assumptions of lower productivity and higher operational costs often justify age restrictions. Such practices limit employment opportunities and potentially violate constitutional principles of equality and non-discrimination.

Abstract

Reformasi birokrasi dan prinsip good governance menuntut terciptanya sistem pemerintahan yang efisien, transparan, dan akuntabel, dengan peningkatan kapasitas Aparatur Sipil Negara (ASN) sebagai kunci utama. Salah satu aspek penting dari reformasi birokrasi adalah menjaga netralitas ASN, khususnya dalam Pemilihan Kepala Daerah (Pilkada), di mana tantangan besar muncul akibat adanya tekanan politik eksternal yang dapat mempengaruhi keputusan ASN. Penelitian ini bertujuan untuk menganalisis implementasi hak pilih ASN dalam Pilkada dengan mempertimbangkan prinsip-prinsip good governance seperti transparansi, akuntabilitas, dan objektivitas. Hasil penelitian menunjukkan bahwa meskipun peraturan telah ada untuk menjaga netralitas ASN, pelaksanaan di lapangan masih menghadapi banyak hambatan, termasuk lemahnya pengawasan dan penegakan hukum. Oleh karena itu, dibutuhkan penguatan sistem pengawasan, pendidikan etika, dan pemahaman yang lebih mendalam mengenai batasan peran ASN dalam politik untuk memastikan implementasi prinsip-prinsip tersebut secara konsisten.

Abstract

This article aims to analyze the role of constitutional conventions in determining the timing of the inauguration of the President and Vice President, as well as to examine the legal and political implications should the inauguration not be conducted in accordance with established conventions. The focus is on the legal vacuum that results in the practice of holding the inauguration on October 20 being based solely on unwritten conventions without formal sanctions. To address this issue, the author draws upon the theory of constitutional conventions according to Dicey and Jennings, as well as legal-political theory. Data were collected through a literature review using primary, secondary, and tertiary legal sources and analyzed qualitatively using a normative legal research method that employs statutory, conceptual, and comparative approaches. This study concludes that the October 20 inauguration convention functions as unwritten law that is morally and politically binding but lacks formal legal force, and that deviations from this convention have the potential to create legal uncertainty, a crisis of legitimacy, and a threat to the stability of Indonesia's presidential system. This study offers a normative model for codifying constitutional conventions into positive law as an effort to strengthen legal certainty and prevent constitutional crises in national leadership succession, filling the gap in existing literature that has not specifically examined the urgency of codifying the timing of presidential inauguration.
