Abstract

The role of the guardian in marriage is an important pillar that must be fulfilled. In the event that the guardian is unable to attend the ceremony, representation can be made by the Head of the Sub-district KUA or Penghulu. The practice of "taukil wali" in Jati Sub-district is quite common, sometimes for justifiable reasons and sometimes without valid reasons. This research aims to explore the implementation of "taukil wali" in the KUA of Jati Sub-district in accordance with the Regulation of the Minister of Religious Affairs Number 20 of 2019. This research takes a Juridical Empirical approach, involving fieldwork to collect data on the application of "taukil wali" in the jurisdiction of KUA Jati, analyzed based on PMA Number 20 of 2019. The findings show that the application of "taukil wali" in KUA Jati is in accordance with the regulation. However, there are consequences that must be considered if the appointed guardian is not valid. Among them is the potential annulment of the marriage, which results in the absence of legal rights and obligations for the parties involved and the possibility of legal action. Even if the nasab guardian does not know the condition of the prospective bride, taukil wali is still carried out using taukil wali bil kitabah, in accordance with the provisions of PMA Number 20 of 2019.

Abstract

This study aims to examine the significance of maslahah (benefit) as a legal consideration in family inheritance, with a specific focus on the principal issue of how the practices of division and transfer of family inheritance occur in Margoyoso Village, Kalinyamatan District, Jepara Regency, and the relevance of the principle of maslahah as a foundational legal consideration. In alignment with the focus of the problem, this study is classified as field research employing a qualitative approach based on case studies. Data were collected through in-depth interviews using a semi-structured method with eight informants, comprising heirs, religious and community leaders, notaries, and advocates. The findings of the study suggest that the transfer of inheritance rights within the distribution of family inheritance in Margoyoso Village, Kalinyamatan District, Jepara Regency, reflects values of social justice and humanity. The transfer of inheritance rights, conceptualised as a gift from an Islamic legal perspective, indicates alignment with the principle of maslahah. However, the findings also reveal weaknesses in the formal legal aspect, particularly when viewed through the lens of the Indonesian Civil Code, as the process of transferring inheritance rights is predominantly conducted through verbal agreements, which may potentially lead to future conflicts. This study advocates for the development of discourse on the integration of Islamic law and positive law, specifically concerning the transfer of inheritance rights within the distribution of family inheritance. Furthermore, it aims to serve as a reference for the government in formulating legal policies that emphasise the integration of maslahah theory in Islamic law with benefit theory in positive law, in order to uphold justice, legal certainty, and the continuity of family relationships.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap praktik child grooming di Indonesia dengan menyoroti indikator-indikator yang muncul serta tingkat kesadaran hukum masyarakat. Child grooming merupakan bentuk manipulasi psikologis yang dilakukan pelaku melalui media daring untuk membangun kepercayaan dengan anak, sebelum akhirnya mengeksploitasi mereka secara seksual. Fenomena ini seringkali sulit dikenali, baik oleh anak maupun orang tua, sehingga menimbulkan kerentanan yang tinggi terhadap tindak kejahatan seksual berbasis online. Rendahnya kesadaran hukum masyarakat terkait tanda-tanda grooming dan regulasi yang berlaku memperburuk kondisi ini, sehingga diperlukan edukasi dan sosialisasi yang lebih intensif guna meningkatkan kewaspadaan dan perlindungan.Metode penelitian yang digunakan adalah kualitatif dengan pendekatan yuridis-normatif dan empiris. Kajian yuridis- normatif dilakukan dengan menelaah peraturan perundang-undangan, doktrin hukum, serta literatur terkait perlindungan anak dari eksploitasi seksual. Sementara itu, pendekatan empiris dilakukan melalui wawancara dengan pihak terkait, seperti guru, orang tua, dan aparat penegak hukum, serta observasi terhadap penggunaan media sosial oleh anak-anak. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap child grooming masih belum optimal karena belum ada regulasi khusus yang secara tegas mengatur seluruh tahapan proses grooming. Oleh karena itu, diperlukan pembaruan regulasi yang lebih komprehensif serta peningkatan kesadaran hukum masyarakat agar upaya perlindungan anak dari eksploitasi seksual dapat berjalan lebih efektif.

Abstract

Diversion is an out-of-court solution for children in conflict with the law, or children as perpetrators of crimes. The increasing number of crimes committed by children has become an evaluation of the diversion system currently used in the juvenile criminal justice system as stipulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This study aims to evaluate and provide solutions for the juvenile criminal justice system by combining restorative justice and integral policies. This study is library research with primary legal materials in the form of the SPPA Law, the Criminal Code, and secondary legal materials in the form of scientific articles, books, and news related to the research topic. Data were analyzed using statutory, case, and conceptual approaches, and using grammatical legal interpretation. The results of the study indicate that the evaluation of the diversion system includes a lack of adequate resources, a lack of training and awareness of law enforcement officers, especially regarding child psychology, delays in the judicial process, and the existence of social stigma that influences victims' reluctance to report to the authorities. Recommendations for improving the diversion system need to be implemented through penal mediation between victims and perpetrators through a restorative justice approach, as well as integral efforts starting from the role of the family, school, and the environment.

Abstract

This study seeks to describe and analyze the role of local authorities (i.e., village chiefs) in handling divorce, as well as the implications for their involvement for women and households. In so doing, this article investigates how local wisdom-based legal systems are realized. Data were collected through observation, interviews, and a review of the literature. This research shows that divorce occurs when families, as communal and religious units, deal with economic difficulties and social media. The recognition of village chiefs as the sole authorities with the authority to decide legal matters is foundational for the traditional legal system practiced within the community, wherein it is the village chiefs—rather than the religious courts—who may handle divorces. In this capacity, village chiefs act as key mediators for the Madurese people, demonstrating that customary authority operates not merely as a residual practice but as a parallel and socially dominant legal order.This article recommends that future studies employ a formalistic approach to understand the validity of customary law, with a broad range of cases and diverse sources used to create a progressive legal system that is recognized and accepted by society.
