Abstract

            This study discusses the leasing contract carried out by the people of Aek Mual Village, Siabu District, Mandailing Natal Regency in terms of muamalah fiqh. The background of this research is because there are still many people who practice leasing where the contract is not in accordance at the beginning with at the end. The objectives to be achieved in this study are to find out what are the factors that cause people to practice leasing and how to review the muamalah fiqh of leasing that occurs in Aek Mual Village whether it is appropriate according to muamalah fiqh or not. This type of research is field research (field) which is qualitative in nature, namely data collection carried out by direct observation of Aek Mual Village, documentation and interviews with village people who practice leasing rented houses in Aek Mual Village. After obtaining complete data, it is then analyzed using deductive reasoning analysis methods, namely explaining the views of the lease first, then analyzing the applicable regulations, namely Fiqh Muamalah. The results of the study show that the factors that influence the community to lease are the first, population movement, movement of residents from the city to the village or from one village to another, this is what causes someone to rent to get a place to live in Aek Mual Village. Two people who have just married, most people who have just married will rent this out on the basis of not having enough money to build a house. The leasing practice transactions carried out by the people of Aek Mual Village are not fully in accordance with the Fiqh Muamalah agreements that are not suitable at the beginning and end (contract). In Fiqh Muamalah the contract (agreement) at the beginning must be in accordance with the agreement at the end as agreed by both parties.

Abstract

This research examines how the determination of workers' wages in the village of Sawah Mudik is reviewed according to the Compilation of Sharia Economic Law. The research method used is field research with a qualitative approach. Primary data sources, namely primary data sources in this study are male workers, female workers and land owners while secondary data is from books and scientific journals that are considered relevant to this research. data collection techniques with observation, interviews and documentation, with qualitative descriptive data analysis techniques. The results of this study are that the wages given by the employer to farm laborers in Sawah Mudik Village, Ranah Batahan District, West Pasaman Regency, if they work all day are IDR 70,000.00, if the workers are given lunch by the employer and if the workers bring their own lunch, the workers receive a wage of IDR 80,000.00. Meanwhile, the wages that female workers get if they work all day are IDR 50,000.00, if the workers are given lunch by the employer and if the workers bring their own lunch, the workers receive IDR 60,000.00. The wages made by the Sawah Mudik village community are in accordance with the review of the compilation of Sharia economic law if Mu'ajir has made a difference in wages between male and female farm workers on the basis that female farm workers often arrive late, men are more responsible for earning a living for his family and the majority of men do their jobs faster. If the mu'ajir gives a difference in wages between male and female farm workers on the basis of following customs that have become the customs of the local community without considering the above factors even though the type of work and the workload of male and female farm workers are the same. So in Sharia Economic Law it is not allowed because the Koran does not recognize differences between men and women because before Allah men and women have the same degree of position and what distinguishes between men and women is only their faith and piety. So this will be detrimental to farm workers and can cause harm.

Abstract

This thesis discusses the implementation of Law No. 36 of 2009 Article 115 paragraph 1 letter E concerning a smoke-free area on public transportation in Panyabungan District, Mandailing Natal Regency. This research is motivated by the existence of problems that often occur and are found in the Panyabungan sub-district, Mandailing Natal district, namely the habit of smoking in public transportation facilities as well as in village transportation carried out by the community, both the community as a public transport driver and the community as a passenger so that the habit What the community does is clearly violates law number 36 of 2009 precisely in article 115 paragraph 1 letter E which in that article prohibits smoking in non-smoking areas, namely on public transportation. The type of research used by the researcher is descriptive qualitative research. The data used are primary and secondary data. Data collection methods include observation, interviews, and documentation. The data collected were analyzed using editing, verification, and analysis methods. In this study the researchers found the results that the implementation of a smoke-free area in village transportation in the Panyabungan sub-district, Mandailing Natal district, had been implemented but it was still far from the maximum, this was due to the inhibiting factors of its implementation such as: lack of socialization carried out by the government with the community, lack of information and knowledge of the community, its human resources, the narrowness of people's thinking both as passengers and transport drivers, the absence of a special team, the absence of a budget, the absence of supervision, and the lack of support from the local government.
