Abstract

The purpose this study to implementation of the agreement between PT.MIR (MAJU INDO RAYA) and ampolu village community. This research is emprical Field Researeh. With data collection techniquedone by interview and observation. Data were analyzed using qualitative approach method. The result of the research shows that the  implementation of the agreement between PT.MIR (MAJU INDO RAYA) and ampolu village community.  Not in accordance with what  was promised as well as violating the agreement that has been made by PT.MIR (MAJU INDO RAYA). Where  PT.MIR (MAJU INDO RAYA) does   not water the road three  times a  day,  PT.MIR (MAJU INDO RAYA)  does not fill  the road with sertu and  pare maintenance isnotcarried out.

Abstract

            This study discusses the leasing contract carried out by the people of Aek Mual Village, Siabu District, Mandailing Natal Regency in terms of muamalah fiqh. The background of this research is because there are still many people who practice leasing where the contract is not in accordance at the beginning with at the end. The objectives to be achieved in this study are to find out what are the factors that cause people to practice leasing and how to review the muamalah fiqh of leasing that occurs in Aek Mual Village whether it is appropriate according to muamalah fiqh or not. This type of research is field research (field) which is qualitative in nature, namely data collection carried out by direct observation of Aek Mual Village, documentation and interviews with village people who practice leasing rented houses in Aek Mual Village. After obtaining complete data, it is then analyzed using deductive reasoning analysis methods, namely explaining the views of the lease first, then analyzing the applicable regulations, namely Fiqh Muamalah. The results of the study show that the factors that influence the community to lease are the first, population movement, movement of residents from the city to the village or from one village to another, this is what causes someone to rent to get a place to live in Aek Mual Village. Two people who have just married, most people who have just married will rent this out on the basis of not having enough money to build a house. The leasing practice transactions carried out by the people of Aek Mual Village are not fully in accordance with the Fiqh Muamalah agreements that are not suitable at the beginning and end (contract). In Fiqh Muamalah the contract (agreement) at the beginning must be in accordance with the agreement at the end as agreed by both parties.

Abstract

Implementation of the Regulation of the Minister of Home Affairs Number 66 of 2017 Article 8 Concerning the Mechanism of Replacement of Village Heads in Matondang Village, Ulu Barumun District, Padang Lawas Regency". The replacement of the village head is a stage that is carried out when the term of office of the village head has ended, whether it is the end of the term of office because the village head resigns, dies, requests himself or is dismissed. The formulation of the problem in this study is how to implement the Minister of Home Affairs Regulation number 66 of 2017 article 8 regarding the replacement of village heads in Matondang village, Ulu Barumun district, Padang Lawas district?, and what are the factors that hinder the implementation of the Minister of Home Affairs Regulation number 66 of 2017 article 8 regarding the replacement of the village head in Matondang village, Ulu Barumun sub-district, Padang Lawas district?. This research is a type of qualitative research, Qualitative research emphasizes efforts to answer research questions through formal argumentative ways of thinking. This type of research is research in the form of field studies or field research.In this study, the researchers found that the mechanism for replacing the village head in Matondang Village, Ulu Barumun sub-district, Padang Lawas district, was an important thing that must be done in the village government so that there was no vacancy in the village head position. The community considers that the replacement of the village head in Matondang Village, Ulu Barumun District, Padang Lawas Regency has been in accordance with the applicable stages or mechanisms, but the majority of people consider it not in accordance with the Implementation of the Minister of Home Affairs Regulation No.

Abstract

This research is entitled The Role of Democratic Volunteers in Increasing Voter Participation in the 2019 General Election in Padangsidimpuan City. This study aims to determine the role of Padangsidimpuan Democracy Volunteers in increasing voter participation in the 2019 General Election in Padangsidimpuan City, as well as the obstacles experienced by Padangsidimpuan Democracy Volunteers in increasing voter participation in the 2019 General Election in Padangsidimpuan City. Descriptive qualitative research is the research method used in this study. This type of research uses field research, namely research that goes directly to the location that is the object of research or field research, and this research prioritizes a problem that is being studied and obtains more information in the form of words or sentences compared to information in the form of numbers. The results of this study indicate that the role of Padangsidimpuan Democracy Volunteers in increasing voter participation in the 2019 General Election in Padangsidimpuan City is to conduct direct socialization to the people of Padangsidimpuan City, where in conducting socialization of Democracy Volunteers are divided based on 10 bases. Voter and Election Education to the public in the form of, among others; Face to face, group discussions, simulations, lectures, posting socialization materials to social media. And the inhibiting factors for Padangsidimpuan Democracy Volunteers in increasing voter participation in the 2019 General Election in Padangsidimpuan City are obstacles that come from internal Democratic Volunteers, namely there are still many Democratic Volunteers members who are not confident in conveying socialization materials, the background of members of the Democracy Volunteers, No the structure of programs run by Democratic Volunteers, and the short tenure of Democracy Volunteers. And also obstacles that come from external factors, namely, the community's confidence is still lacking in the election, the difficulty of gathering the community to conduct election socialization, the difficulty of communication from the Democratic Volunteers to people with disabilities and also technical obstacles in voting such as registering A5, not having an ID card and assistance when choose.

Abstract

This study discusses the implementation of the electronic identity card service at the Department of Population and Civil Registration, North Padang Lawas Regency.  The method in this study uses a type of empirical normative research, namely an understanding of the law in terms of norms and the implementation of the rule of law in real behavior as a result of the application of legal norms, the approach taken by the researcher is the legal approach and the sociological legal approach, the data source used by the researcher is data  primary (obtained directly from the main source) secondary data (obtained from documents and books).  The data collection techniques carried out by researchers are observation (directly on the object of research), interviews (direct discussions with parties related to the research) and documentation (written or picture).  The data analysis technique used by the researcher is descriptive qualitative analysis, that is, efforts are made by working with data, organizing data, sorting it into manageable units, synthesizing it, looking for patterns, finding out what is important, what is learned, what is told to others.  The results showed that the implementation of the electronic identity card service for North Padang Lawas Regency was not in accordance with Law Number 25 of 2009 concerning Public Services.  And it should be carried out in accordance with a system where the public can obtain an e-KTP by inputting, processing and producing an e-KTP issuance output.  Supporting factors so that the implementation of the electronic identity card service runs well is the existence of an e-ID card, adequate budget and human resources so that the service can run smoothly.  And for the inhibiting factors, namely internet access that is less than optimal, the discipline of office employees who are still not punctual, inadequate facilities and infrastructure, completion times that are not as determined and also lack of public awareness.

Abstract

This thesis is entitled the perception of the general election commission on the representation of women in the list of legislative candidates for the 2014-2019 period in the Mandailing Natal district (study of law number 7 of 2017 article 1 regarding elections. The general election commission has issued pkpu number 20 of 2018 regarding nominations for members of the DPR, the provincial dprd and district or city dprd and have been ratified by the ministry of law and human rights. But the birth of this pkpu did not go smoothly, especially regarding ex-corruptors not being allowed to nominate as members of the legislature. The involvement of women in politics from time to time continues to increase, one of the indicators is an increasing trend of women in the legislature, especially since the 1999 election until the 2009 election. However, in the 2014 election, women's representation has decreased and in law number 7 of 2017 concerning elections, it is necessary to have at least 30% of women's representation in the list of candidates to be legally registered. As a legislative candidate. This research is a type of qualitative research that emphasizes the analysis more on the inductive deductive inference process and on the analysis of the dynamics of the relationship between observed phenomena, using scientific logic. Qualitative research emphasizes efforts to answer research questions through a formal, argumentative way of thinking. This type of research is in the form of a field study. In this study the researcher found the results that the perception of the general election commission that the 30% quota of women's representation in legislative members in Mandailing Natal had not been fully implemented because of the individual factors of each woman and the lack of public trust in women due to negative views about gender

Abstract

This research examines the efforts of the police in preventing traffic violations by minors in Padangsidimpuan City. The research method used is field research with a qualitative approach. The primary data sources are the Traffic Unit (Satlantas) police at the Padangsidimpuan City Police, while secondary data includes books, previous studies and scientific journals that are considered relevant to this research. Data collection techniques with observation, interviews, and documentation, with qualitative descriptive data analysis techniques. The results of this study show that the police's efforts to prevent traffic violations by minors are carried out in three ways, namely first: Pre-emptive efforts by providing socialization to the community, second: Preventive efforts by providing direction and guidance through counseling, and third: Efforts Repressive by conducting raids, giving warnings and fines. Then the obstacles faced by the police in preventing traffic violations by minors are the lack of knowledge and legal awareness of the community so that they cannot understand the applicable laws, the manual ticket sanctions that have been abolished causing the public to commit traffic violations and the bad image of the police. lead to a lack of public trust in the police.

Abstract

This research is motivated by the existence of cooperation in the management of oil palm plantations carried out by oil palm farmers in Rambah Hilir District, Rokan Hulu Regency, namely in the form of garden owners giving their planted gardens to plantation workers to be cared for on the basis of trust without direct supervision with money giving fertilizer money in cash. according to the agreement. The main problem in this study is how the cooperation agreement in the management of oil palm plantations in Pasir Utama Village, Rambah Hilir District, Rokan Hulu Regency is reviewed and how is the review of the Sharia Economic Law Compilation regarding the cooperation agreement in the management of oil palm plantations in Pasir Utama Village, Rambah Hilir District, Rokan Hulu Regency. This study uses the field research method (field research) and sourced primary and secondary data. Data collection techniques used in this study were observation, interviews and documentation. The results showed that the cooperation agreement in the management of oil palm plantations was insecure and did not show an element of honesty where the manager did not buy fertilizer money and did not harvest oil palm fruit not only taking the ripe fruit but also taking the unripe oil palm fruit so that the owner of the oil palm feel aggrieved by the manager. Cooperation agreements in the management of oil palm plantations in the community sometimes do not heed the applicable sharia law, so that they can harm one another. This happens because of ignorance of the community in the cooperation agreement.

Abstract

This thesis discusses the implementation of Law No. 36 of 2009 Article 115 paragraph 1 letter E concerning a smoke-free area on public transportation in Panyabungan District, Mandailing Natal Regency. This research is motivated by the existence of problems that often occur and are found in the Panyabungan sub-district, Mandailing Natal district, namely the habit of smoking in public transportation facilities as well as in village transportation carried out by the community, both the community as a public transport driver and the community as a passenger so that the habit What the community does is clearly violates law number 36 of 2009 precisely in article 115 paragraph 1 letter E which in that article prohibits smoking in non-smoking areas, namely on public transportation. The type of research used by the researcher is descriptive qualitative research. The data used are primary and secondary data. Data collection methods include observation, interviews, and documentation. The data collected were analyzed using editing, verification, and analysis methods. In this study the researchers found the results that the implementation of a smoke-free area in village transportation in the Panyabungan sub-district, Mandailing Natal district, had been implemented but it was still far from the maximum, this was due to the inhibiting factors of its implementation such as: lack of socialization carried out by the government with the community, lack of information and knowledge of the community, its human resources, the narrowness of people's thinking both as passengers and transport drivers, the absence of a special team, the absence of a budget, the absence of supervision, and the lack of support from the local government.

Abstract

The problem in this research is the Sociological Study of the Determination of Sanctions for the Crime of Theft Decision 312/Pid.B/2021/PN Psp at the Padangsidimpuan District Court, this type of research is literature with a qualitative approach. The primary data source in this study is the judge's decision in case No. 312/Pid.B/2021/PN Psp, and the secondary data source is books, journal articles and documents related to this research. data collection technique is document study, data analysis technique is descriptive. The results of this study indicate that the judge's consideration in case No. 312/Pid.B/2021/PN Psp is the first is the element of the owner of the goods, the second is the element of intent in theft and the third is the element of possessing goods against rights and which becomes a factor for the judge's consideration is the firstly juridical factors, philosophical factors and sociological factors.
