Abstract

Labor disputes are a common issue arising from employment relationships between workers and employers, particularly concerning civil labor rights and obligations. Non-litigation dispute resolution mechanisms play an important role as an alternative to court proceedings, as they emphasize efficiency, consensus, and the preservation of harmonious industrial relations. This article aims to describe and analyze community legal counseling activities on non-litigation mechanisms for resolving civil labor disputes. The counseling focused on introducing and explaining various non-litigation methods, including bipartite negotiation, mediation, conciliation, and arbitration, as regulated under Indonesian labor law. The activity was conducted through interactive lectures and discussions to enhance participants’ understanding of their legal rights and available dispute resolution options. The results indicate an increase in participants’ legal awareness and comprehension regarding non-litigation labor dispute resolution, which is expected to reduce reliance on litigation and encourage more constructive and peaceful settlement of labor conflicts. Therefore, legal counseling on non-litigation labor dispute mechanisms is essential in strengthening access to justice and promoting sustainable industrial relations.

Abstract

This study aims to analyze the efficiency of civil case handling through the implementation of the e-Court system in Indonesia, which was introduced under Supreme Court Regulation No. 1 of 2019. The research background stems from the need for judicial reform to achieve a simpler, faster, and more cost-effective process, as well as a response to the growing demand for digitalization in public services. The research method employed is normative juridical with a statutory and case approach, supported by secondary data such as regulations, court decisions, and academic articles published between 2020–2025. The findings reveal that e-Court has had a positive impact on accelerating case administration, reducing litigation costs, and improving transparency in civil procedures. Services such as e-Filing, e-Payment, and e-Summons have significantly shortened the time and expenses compared to conventional procedures. Nevertheless, the study also identifies several challenges, including limited technological infrastructure in certain regions, low digital literacy among both society and court officials, as well as inconsistent judicial understanding regarding the evidentiary strength of electronic documents. These conditions indicate that the efficiency of e-Court remains partial and not yet fully inclusive. Theoretically, this research reinforces the relevance of the law and economics efficiency theory (Posner) in assessing procedural effectiveness, while also highlighting the challenges of access to justice (Cappelletti & Garth) in the context of judicial digitalization. In practical terms, the study implies the need for strengthening digital evidence regulations, enhancing human resource capacity, and expanding equitable infrastructure development so that e-Court can truly embody the principles of simple, fast, and low-cost justice. Further research is recommended to explore quantitative empirical data in order to deepen comparative analysis before and after the implementation of e-Court.

Abstract

Upah merupakan hak normatif pekerja dan memainkan peran mendasar dalam memastikan standar hidup yang layak bagi pekerja dan keluarga mereka. Namun, dalam praktik ketenagakerjaan, berbagai masalah sering muncul, seperti keterlambatan pembayaran upah, pemotongan upah sepihak, dan ketidakpatuhan terhadap standar upah minimum oleh pengusaha. Kondisi ini menciptakan ketidakpastian hukum bagi pekerja, yang secara struktural berada di posisi yang lebih lemah dalam hubungan kerja. Studi ini bertujuan untuk menganalisis kepastian hukum dalam perlindungan upah pekerja dari perspektif hukum perdata ketenagakerjaan di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan hukum perundang-undangan dan pendekatan konseptual. Materi hukum terdiri dari sumber hukum primer berupa undang-undang ketenagakerjaan dan sumber hukum sekunder, termasuk buku teks hukum, jurnal ilmiah, dan pendapat ahli. Temuan menunjukkan bahwa, secara normatif, pengaturan perlindungan upah telah diatur secara komprehensif dalam undang-undang ketenagakerjaan; namun, masih terdapat kesenjangan dalam implementasi, yang berpotensi menyebabkan ketidakpastian hukum. Oleh karena itu, penguatan norma hukum dan penegakan hukum yang konsisten diperlukan untuk menjamin perlindungan upah yang adil dan memberikan kepastian hukum dalam hubungan kerja.
