Abstract

Analisis Putusan Nomor 359 K/TUN/TF/2023 ini mengangkat satu permasalahan hukum, yaitu penerapan prinsip in dubio pro natura sebagai pertimbangan hakim dalam memutus sengketa tata usaha negara lingkungan hidup. Penelitian dilaksanakan dengan menelaah data sekunder berupa bahan hukum primer dan bahan hukum sekunder. Kedua bahan hukum ini diperoleh melalui studi dokumen. Oleh karena objek penelitian adalah putusan pengadilan, digunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan asas menggunakan teori prinsip in dubio pro natura dan teori pertimbangan hukum. Hasil penelitian menyimpulkan bahwa penerapan asas in dubio pro natura di dalam Putusan Nomor 359 K/TUN/TF/2023 didasarkan pada keyakinan awal hakim tentang adanya perbuatan melanggar hukum oleh tergugat. Para tergugat tidak melaksanakan perlindungan hutan yang berada di wilayah Hutan Konservasi Kawasan Taman Nasional Tesso Nilo, sementara potensi kerusakan lingkungan hidup akibat perbuatan melanggar hukum mereka adalah nyata. Di sisi lain, hakim tidak menemukan alat bukti yang cukup berupa saksi dan/atau ahli atau akibat terbatasnya ilmu pengetahuan yang dapat menentukan besaran ganti rugi kerusakan lingkungan hidup akibat perbuatan melanggar hukum para tergugat. Dalam kondisi ini, prinsip in dubio pro natura dapat diterapkan.

Abstract

This research examines the legal implications of changing the nomenclature from “environmental permits” to “environmental approvals” in Indonesia’s environmental licensing law. Moving beyond a conventional public law focus, it highlights the role of private law instruments in advancing climate change mitigation and adaptation. The core question addressed is whether this terminological shift aligns with the principles of ecological justice and how environmental licensing law should be reconstructed to uphold these values. Using a doctrinal legal research method, the analysis integrates statutory, conceptual, and philosophical perspectives, employing techniques of interpretation and construction. The findings indicate that while certain reforms under the Job Creation Law support ecological justice, others undermine it. The research concludes that the current framework requires comprehensive reconstruction to more effectively embody ecological justice and strengthen climate action.

Abstract

This study aims to analyze the disparity in judges’ legal reasoning in adjudicating petitions for marriage validation (isbat nikah) filed by couples who married before attaining the minimum age requirement without first obtaining a marriage dispensation. The study focuses on two distinct court rulings, namely Judgments Number 155/Pdt.P/2024/PA.JB and Number 41/Pdt.P/2024/PA.Lbg. This disparity stems from the varying methods of law-finding (rechtsvinding) applied by judges in addressing to the absence of a marriage dispensation petition before the marriage was solemnized. This study employs normative legal research using case and comparative approaches. The findings reveal a fundamental difference in the interpretation of the legal requirements for a valid marriage and the minimum age limit under Law Number 16 of 2019. On the one hand, the judges adopted a formal-legalistic approach by rejecting the petition to ensure legal certainty. On the other hand, the judges tended to validate the marriage to protect the private- law rights of the child and the wife. The novelty of this study lies in the finding that such disparity is not merely a technical difference in the interpretation of legal provisions but rather reflects a paradigmatic conflict between normative legalism and judicial progressivism within the religious court system. This study contributes theoretically by highlighting the tension between substantive justice and the rigidity of positive-law norms in adjudicating family law cases. These findings affirm that the standardization of judicial guidelines at the administrative level remains inadequate, thereby necessitating a reconstruction of legal thought capable of bridging state legal protection with the welfare of legal subjects who have not yet met the minimum age requirement for marriage.
