<![CDATA[The absence of specific regulations governing the criminal offense of sextortion in Indonesia has resulted in fragmented provisions across the Criminal Code, the Electronic Information and Transactions Law, the Pornography Law, and the Law on Sexual Violence Crimes, creating legal uncertainty, inconsistent law enforcement, and inadequate victim protection. This study aims to formulate an ideal legal framework for regulating sextortion in Indonesia. The research employs a normative legal method using statutory, conceptual, and comparative approaches by examining the legal frameworks of Utah (United States) and the Philippines. The findings indicate that an ideal regulatory framework should encompass five key elements: a comprehensive definition of the offense, an expanded concept of benefit covering non-material gains, gender-based victim protection, strengthened digital forensic capacity, and integration of legal norms into the national legal system. The study concludes that establishing a specific offense of sextortion is essential to ensuring legal certainty, effective victim protection, and responsive criminal law reform for gender-based digital crimes. ABSTRAKKetiadaan pengaturan khusus mengenai tindak pidana sextortion di Indonesia menyebabkan fragmentasi pengaturan dalam KUHP, UU ITE, UU Pornografi, dan UU TPKS yang berdampak pada ketidakpastian hukum, inkonsistensi penegakan, dan belum optimalnya perlindungan korban. Penelitian ini bertujuan merumuskan konsep pengaturan hukum yang ideal terhadap tindak pidana sextortion di Indonesia. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan hukum terhadap regulasi di Utah (Amerika Serikat) dan Filipina. Hasil penelitian menunjukkan bahwa konsep pengaturan yang ideal mencakup lima elemen utama, yaitu perumusan delik sextortion yang komprehensif, perluasan makna keuntungan hingga mencakup aspek nonmaterial, penguatan perlindungan korban berbasis perspektif gender, peningkatan kapasitas forensik digital, serta integrasi norma ke dalam sistem hukum nasional. Penelitian menyimpulkan bahwa pembentukan delik khusus sextortion merupakan langkah strategis untuk mewujudkan kepastian hukum, perlindungan korban, dan pembaruan hukum pidana yang responsif terhadap kejahatan digital berbasis gender.]]>
