Abstract

Kewajiban pendaftaran penyelenggara sistem elektronik bagi  seluruh pelaku usaha e-commerce di indonesia menjadi salah satu program pemerintah dalam Peta Jalan Sistem Perdagangan Nasional Berbasis Elektronik (Road Map E-commerce) Tahun 2017-2019. Oleh karena itu, Tujuan penulisan ini untuk menguraikan pentingnya pendaftaran penyelenggara sistem Elektronik bagi pelaku usaha e-commerce di Indonesia. Penelitian ini merupakan penelitian yuridis normatif yang menggunakan pendekatan perundang-undangan, pendekatan konsep dan pendekatan perbandingan. Hasil dari penelitian ini adalah pentingnya pendaftaran penyelenggara sistem elektronik bagi pelaku usaha e-commerce ialah memudahkan konsumen dalam mengidentifikasi pelaku usaha, serta dapat membantu pemerintah dalam program pengenaan pajak bagi pelaku usaha e-commerec.

Abstract

People's welfare is the goal of the State of Indonesia which is contained in the official state document, namely the opening of the 1945 Constitution paragraph IV, this can be interpreted to enjoy an affluent life, free from poverty and is a human right for every citizen in Indonesia. The grouping process is carried out to see the level of people's welfare for each Regency/City in East Java. In this study, before grouping, the number of clusters was selected using the Elbow method. After that do the grouping with the K-Prototype Algorithm. Furthermore, using Kruskal Wallis and Chi-Square, the test was carried out to determine the variables that influence grouping. The results of the study obtained the 3 best clusters using the Elbow method, grouping with the K-Prototype Algorithm where cluster 1 consisted of 4 Regencies/Cities, Cluster 2 consisted of 18 Regencies/Cities and cluster 3 consisted of 16 Regencies/Cities. Furthermore, the results of Kruskal Wallis and Chi-Square get 4 influential variables in the grouping, the 4 variables are the Number of Poor Population, Expenditures Per Capita, Open Unemployment Rate and Sources of Water for Drinking.

Abstract

Indonesian criminal law adheres to various principles that form the basis for solving problems, especially in problems related to two or more countries. One of the principles recognized and in line with the research, in this case, is the territorial principle, which is a useful principle in determining the limits of validity of criminal law provisions based on place or location. This study aims to analyze the application of the territorial principle to perpetrators of pedophilia crimes committed by foreign nationals. The method used in this study is a normative type of research that uses the law approach and case studies. The results of this study indicate that should be based on the principle of criminal law, namely the territorial principle, Indonesian law will be applied to anyone who commits a crime in Indonesia, including in this case foreign citizens who commit pedophilia crimes, especially a sovereign state has exclusive jurisdiction in the environment. the territory itself is called territorial sovereignty so that the state has full jurisdiction to punish people who commit crimes against the law in the territory of the country. In reality, this territorial principle cannot be applied to this case because the suspect is still in the process of waiting for the results of approval or rejection of extradition by the Ministry of Law and Human Rights of the Republic of Indonesia, considering that the suspect is a foreign citizen and is also a fugitive in his home country, namely the United States of America. so that the country of origin sends a letter of request for extradition and this extradition request is still in the process of being followed up.

Abstract

This study aims to determine enhancing the function of the election supervisory body through participatory supervision. The method used in this research is empirical research methodology and uses a qualitative approach as well as descriptive and qualitative analysis techniques. The results of this study indicate that increasing participatory supervision of the functions of the election supervisory body is carried out with two kinds of programs, the first is socialization which aims to build public awareness that they have an obligation to guard their right to vote in elections by participating in supervising the stages of the election administration. While the second is the corner of supervision can be interpreted as a center for the development of science and knowledge about democracy and election supervision.

Abstract

This article examines data and facts related to implementing and functionalizing traditional institutions as living laws in society. It presents the concept of revitalizing traditional institutions in the criminal law system to realize restorative justice. According to indigenous peoples, justice is a complex concept because formal courts and other forums, such as customary courts, can administer it. This study aims to analyze the contribution of traditional institutions and restorative justice in the criminal law system in Indonesia. The approaches used in this research are conceptual, historical, statutory, and case approaches. The study results from show that customary institutions and restorative justice in Indonesia have been carried out through the participation of community members with traditional legal characteristics, cultural pluralism, moral values, and religion to solve problems through consultation to reach an agreement. Customary institutions and restorative justice in Indonesia are carried out by mediation for an agreement to reach an agreement in the best interests of victims, perpetrators, families, and other parties related to the traditional characteristics of law, cultural pluralism, moral values, and religion.

Abstract

Law/regulation on mining play a significant role, because mining sector is a potential sector for developing the economy of Indonesian. Law on Mining underwent several amendments, namely the era of Law Number 11 of 1967, Law Number 4 of 2009 and Law Number 3 of 2020. This article will analyze shiftss in mining sector regulations from each of these eras. This article uses normative juridical methods, with statutory, contextual, historical, and comparative approaches, and is analyzed qualitatively. The results of the study show that between Law No. 11 of 1967 to Law No. 4 of 2009 and Law no. 3 of 2020 underwent a change, namely from a centralized arrangement, where the mining sector holding power became a matter for the central government to decentralization, handed over to local governments. Another change is in the field of relations between the government and capital or investors, the contract of work model becomes licensing. The impact on the contract of work model is that the state is positioned as a 'party' to the contract, while in terms of licensing the government has a position that tends to be stronger. This Amendment Contract is adapted to Indonesian conditions and the protection of Article 33 of the Indonesian constitution.

Abstract

This research focuses on the role and responsibility of the state in controlling and regulating electronic information resources, especially in the scope of e-commerce in Indonesia. In the digital era, the rapid development of e-commerce requires effective and comprehensive regulation to ensure the integrity, security, and growth of this industry. This research discusses several necessary regulations adopted by the Indonesian government, including Law Number 11 of 2008, which was changed to Law Number 19 of 2016 concerning Information and Electronic Transactions, Government Regulation No. 82 of 2012 concerning the Implementation of Electronic Systems and Transactions, Law Number 7 of 2016 concerning Trade, and Bank Indonesia Regulation No.11/12/PBI/2009 concerning Electronic Money. This research shows that these regulations and policies have established a Solid legal framework for e-commerce in Indonesia. However, given the rapidly changing technology and industry dynamics, these regulations and policies must be continuously updated and adapted to new needs. Therefore, the state's role in monitoring industrial developments, adjusting regulations, and educating the public is essential in establishing a fair, safe, and sustainable e-commerce ecosystem. Overall, this research shows that balancing consumer protection and industry growth is critical for the future of e-commerce in Indonesia.

Abstract

Indonesia and Singapore were the founding members of an economic and geopolitical organization of countries in the Southeast Asian region called the Association of Southeast Asian Nations (ASEAN). ASEAN mandates each member country to create regulations and policies related to e-commerce transactions through the 1999 ASEAN Summit. This paper is a normative study and aims to analyse the development of e-commerce regulations in Indonesia and Singapore by utilizing comparative and statute approaches. The result of the study finds out that Singapore has designed its e-commerce master plan since 1998, meanwhile, Indonesia started to develop the master plan related to e-commerce a decade late than Singapore through the Acceleration and Expansion of Indonesian Economic Development program (MP3EI), which launched in 2011. Indonesia has regulated a few components related to e-commerce, but some are still partial and spread in a few regulations. This paper recommends governments unify all e-commerce components regulations into one act that can cover legal protection and become the basis of procedure regulation related to e-commerce in Indonesia. The usage of the Trustmark stamp and online registration procedure for the e-commerce activities required by Singapore can be enforced in Indonesia as a solution to problems that occur in e-commerce activity in Indonesia.

Abstract

Keberadaan lembaga penyelesaian sengketa di tingkat desa merupakan hal  yang penting dalam upaya menyelesaikan berbagai sengketa yang terjadi di tengah-tengah masyarakat, selain sebagai sarana guna meminimalisir dampak sosial yang timbul pasca terjadinya sengketa. Maka dari itu, kegiatan ini dilakukan untuk menjawab (1) Bagaimana konsep Mediasai di Desa Molowahu, Kecamatan Tibawa, Kabupaten Gorontalo  ? dan (2) Bagaimana implementasi proses Mediasi oleh Mediator yang di perankan Lembaga Mediasi Desa ?. metode yang digunakan dalam kegiatan ini berupa penyuluhan dan sosialisasi. Hasil kegiatan menunjukkan dibutuhkan berbagai regulasi di antaranya berupa peraturan desa agar eksistensi lembaga penyelesaian sengketa terutama dari segi kelembagaan dan minat atau tingkat kepercayaan masyarakat terpelihara dengan baik di masa mendatang. Pengabdian ini dilakukan dengan cara mendeskripsi berbagai aspek tentang topik monitoring dan evalusai yang kemudian diakhiri dengan sesi diskusi. Diperoleh hasil bahwa draft peraturan Desa Desa Molowahu, Kecamatan Tibawa, Kabupaten Gorontalo tentang Lembaga Mediasi.

Abstract

The age limit for children is very important in juvenile criminal cases, because it is used to find out whether a person suspected of committing a crime is included in the category of a child or not. Limitation of the age of children, there is also diversity in various countries that regulate the age of children who can be punished. Some countries also provide a definition of a person being said to be a child or an adult in terms of age and activity or ability to think. The approach method in this study uses an approach to legislation (statue approach), fact approach, case approach and analysis of legal concepts. The results in this study are the non-uniformity of the qualifications for the age limit of children between one law and another, giving rise to various existing legal conflicts regarding the limits of children's responsibility. According to the Criminal Code Number 1 of 2023 in article 40, it states that criminal liability cannot be imposed on children who are not yet 12 (twelve) years old at the time of committing the crime, while in Law Number 11 of 2012 it states that children who are in conflict with The law hereinafter referred to as a child is a child who is 12 (twelve) years old but not yet 18 (eighteen) years old who is suspected of committing a crime.
