Abstract

Abstrak: Mahasiswa profesi dokter gigi adalah seseorang mahasiswa yang sedang melaksanakan pendidikan profesi setelah menyelesaikan pendidikan akademik. Berdasarkan Undang-Undang No. 29 tahun 2004 tentang Praktik Kedokteran, mahasiswa profesi dokter dan dokter gigi masih belum diperbolehkan untuk memberikan pelayanan kesehatan karena belum memiliki STR dan SIP. Mahasiswa profesi dokter gigi dalam memberikan pelayanan kesehatan dengan tujuan pembelajaran klinik tetap harus memperhatikan hukum kesehatan dan kode etik kedokteran gigi.Hasil penelitian menunjukkan terdapat perbedaan yang cukup berarti dari mahasiswa profesi dokter gigi di RSIGM SA dalam memahami pengetahuan etik dan hukum kesehatan. Adanya hubungan hukum yang terjadi antara mahasiswa profesi dokter gigi dan dosen/DPJP yaitu adanya pelimpahan wewenang yang diberikan oleh dosen/DPJP untuk dapat melakukan pelayanan kepada pasien yaitu berupa mandat dan tetap dibawah pengawasan serta instruksi dari dosen/DPJP. Mahasiswa profesi dokter gigi masih banyak yang abai terhadap tanggung jawab etik dan hukum,. RSIGM SA telah memberikan upaya perlindungan hukum bagi mahasiswa profesi dokter gigi yaitu berupa perlindungan hukum preventif dan represif.Kata kunci: mahasiswa profesi dokter gigi, etik kesehatan, hukum kesehatan Abstract: A dental co-assistant is a student who is carrying out professional education after completing academic education. Based on Law No. 29 of 2004 concerning Medical Practice, dental co-assistants are still not allowed to provide health services because they do not have STR and SIP. A dental co-assistant while providing health services with the aim of clinical learning must still pay attention to health law and the code of ethics of dentistry. The results showed that the dental co-assistant at RSIGM SA had a significant difference in understanding knowledge of ethics and health law. The legal relationship that happens between dental co-assistant and lecturers/dentist is delegation of authority given by lecturers/dentist to be able to perform services to patients in the form of a mandate and remain under the supervision and instruction of lecturers/dentist. Many dental co-assistants are still ignorant of ethical and legal responsibilities. dalam melaksanakan praktik kedokteran gigi dan mulut dokter gigi umum maupun dokter gigi spesialis harus sesuai dengan kewenangan dan kompetensi yang dimilikinya, namum masih dirasakan adanya ketidakadilan dalam pelaksanaannya. Berdasarkan hal tersebut, maka perlu dilakukan penelitian yang membahas tentang pengaturan kompetensi dan pemberian kewenangan dokter gigi umum dan dokter gigi spesialis sehingga dapat diperoleh gambaran yang jelas tentang asas keadilan bagi dokter gigi umum dan dokter gigi spesialis yang melakukan praktik kedokteran gigi dan mulut.Penelitian ini dilakukan dengan metode penelitian yuridis normatif yaitu dengan cara meneliti bahan pustaka dan data sekunder yang mencakup asas-asas dan norma-norma hukum mengenai dokter gigi umum, dokter gigi spesialis, pengaturan kompetensi dan pemberian kewenanganyang berbasis keadilan.Selanjutnya dianalisa dengan metode kualitatif normatif yang merumuskan tentang pengaturan kompetensi dan pemberian kewenangan dokter gigi umum dan dokter gigi spesialis telah berlandaskan keadilan. Hasil analisa didapatkan bahwa pengaturan kompetensi dan pemberian kewenangan dokter gigi umum dan dokter gigi spesialis telah berlandaskan asas keadilan meskipun adanya keadilan subyektif dan terdapat tumpang tindih dari standar kompetensi dokter gigi umum dan standar kompetensi dokter gigi spesialis yang menyebabkan multi tafsir dari dokter gigi umum dan dokter gigi spesialis . Multi tafsir ini menunjukan adanya ketidakpastian hukum.Abstract: In practicing dentistry and oral medicine, general and specialist dentists must be guided by their authority and competence, but their implementation is still unjust. Based on this, it is necessary to conduct research that discusses the regulation of competencies and granting authority to general dentists and specialist dentists to obtain a clear picture of the principle of justice for general and specialist dentists who practice dentistry.This Research Was Carried Out by a Normative Juridical Research Method, Namely By Researching Literature Materials And Secondary Data That Included Legal Principles And Norms Regarding General Dentists, Specialist Dentists, Competency Arrangements, And The Granting Of Justice-Based Authority.Furthermore, it is analyzed using a normative qualitative method that formulates the regulation of competence and the grant of authority to general dentists and specialist dentists based on justice. The Results of the Analysis found that the regulation of competence and granting authority to general dentists and specialist dentists have been based on the principle of justice, even though there is subjective justice. There is an overlap between the competency standards of general dentists and the competency standards of specialist dentists, which causes multiple interpretations of general dentists and specialist dentists. This multi-interpretation shows that there is legal uncertainty

Abstract

Law Number 17 of 2023 on Health served as a momentum for evaluation of the regulation regarding ethics and professional discipline enactment body for medical personnel, which includes doctors and dentists. The purpose of this research is to provide comparisons from regulations in the United States, Great Britain, Singapore, and Indonesia as an evaluation tool. Through doctrinal law method with analytical and comparative approach toward secondary data, this research found that there were notable regulation differences between the countries which could provide input for Indonesia. Analysis of professional discipline enactment body gave two key messages. One, Indonesia could give provisions on what could be subject to disciplinary actions, including legal violations that may be subject to disciplinary actions, in order to clarify the relationship between professional discipline and law. Two, Indonesia could introduce a tiered mechanism in the investigation of alleged professional discipline violations to strengthen the realm of professional discipline and affirm its position as primum remedium.

Abstract

Since the enactment of Law 17/2023, it has opened a new paradigm and confirmed how the mandate for resolving disputes in the health sector is carried out, which places alternative dispute resolution as the main and first thing before other legal remedies are used by the parties to the dispute. As an a contrario logic in the application of criminal law as the ultimum remidium principle, dispute resolution outside of court for dispute cases as regulated in Article 310 of Law 17/2023 is an application of the primum remidium principle. The concept of Primum Remidium as a legal order in resolving disputes resulting from health services in Law 17/2023 and mediation being the main choice in resolving disputes resulting from health services in a just manner is an important thing. The research method used is normative legal research based on a statute approach and a conceptual approach. The result is this approach to resolving criminal allegations of doctors in providing health services through restorative justice is a primum remidium step to return the function of criminal law to its track, namely as an ultimum remidium function and as a last resort weapon when other legal remedies cannot be used as a deterrent effect for a doctor. In the settlement process by means of deliberation to reach consensus, justice is created by the parties. The discussion of fairness in resolving medical disputes through mediation is based on balance and proportion. In this case the parties will take their respective proportions, justice is created through their own agreement. Starting from this idea of justice, the parties to the dispute use their own criteria for justice.

Abstract

The purpose of this study is to analyze the application of informed consent to dentists' responsibilities under civil law and to analyze the application of informed consent to dentists' responsibilities under criminal law. This study falls into the category of normative legal research. The research approaches used consist of a legislative approach, a comparative approach, and a conceptual approach. The findings in this study indicate that the implementation of informed consent, in the context of civil liability, reflects the application of contractual principles in the professional relationship between dentists and patients. This relationship is based on a valid agreement as stipulated in Article 1320 of the Indonesian Civil Code (KUHPerdata). This study also shows that without valid consent from the patient, medical actions performed by dentists may lose their legal justification and, from a juridical perspective, can be classified as unlawful acts, such as abuse or negligence resulting in criminal consequences. This is in line with the provisions of Article 440 of Law Number 17 of 2023 concerning Health, which regulates criminal sanctions for medical personnel whose negligence causes serious injury or death. This provision is further strengthened by the general provisions in Articles 466 to 469 of Law Number 1 of 2023 concerning the Criminal Code (KUHP) which regulates criminal acts against the human body.
