Abstract

Background: Thyroid cancer is ranked ninth among the most common type originating from the endocrine glands globally, accounting for approximately 59.7% of cases in Asia. According to 2020 health data, thyroid cancer ranked twelfth in Indonesia, comprising 13,114 cases. Despite the number of cases recorded, there is a lack of comprehensive data regarding the condition of thyroid cancer in the country. Therefore, this research aimed to describe the thyroid cancer profile in Dr. Kariadi General Hospital Semarang.Methods: This descriptive research was carried out using 154 medical records selected through consecutive sampling from Dr. Kariadi General Hospital Semarang from January to December 2020. Categorical scale data were described through frequencies and percentages, while numerical scale data were presented as mean and standard deviation.Results: This research discovered that 57.8% of patients belonged to the 40–59-year-old age group, predominantly consisting of 79.9% females. Additionally, 39.6% of patients had normal thyroid function, with Papillary Thyroid Cancer being the most common type, constituting 92.7% of cases. The results showed that 46.8% of cases were bilateral, 37.7% had a condition of T3, 59.7% had N0, and 89.6% had M0, while 66.2% were classified as stage I.Conclusions: The majority of thyroid cancer patients were 45–64 years old and female. The results showed Papillary Thyroid Cancer as the most prevalent type, with the majority of cases diagnosed at stage I and showing bilaterally presentation. Most of the data correlated with previous research, except thyroid function and histopathology-type percentages.

Abstract

Law Number 17 of 2023 on Health served as a momentum for evaluation of the regulation regarding ethics and professional discipline enactment body for medical personnel, which includes doctors and dentists. The purpose of this research is to provide comparisons from regulations in the United States, Great Britain, Singapore, and Indonesia as an evaluation tool. Through doctrinal law method with analytical and comparative approach toward secondary data, this research found that there were notable regulation differences between the countries which could provide input for Indonesia. Analysis of professional discipline enactment body gave two key messages. One, Indonesia could give provisions on what could be subject to disciplinary actions, including legal violations that may be subject to disciplinary actions, in order to clarify the relationship between professional discipline and law. Two, Indonesia could introduce a tiered mechanism in the investigation of alleged professional discipline violations to strengthen the realm of professional discipline and affirm its position as primum remedium.

Abstract

Perundungan dapat terjadi di dunia pendidikan kedokteran. Studi yang melibatkan 6084 mahasiswa kedokteran menemukan bahwa pelaku perundungan adalah konsulen (43,1%), residen (35,7%), perawat (12,4%), dan mahasiswa kedokteran lainnya (8,8%). Penelitian ini bertujuan untuk mengetahui landasan etik yang tersedia untuk melindungi koas dan residen dari perundungan. Penelitian ini menggunakan pendekatan yuridis normatif dengan jenis data berupa data sekunder, seperti peraturan, buku, dan jurnal penelitian. Landasan etik yang tersedia dari organisasi profesi adalah berupa Kode Etik Kedokteran Indonesia dan Surat Keputusan Majelis Kehormatan Etik Kedokteran Nomor 044/PB/K/MKEK/03/2022. Landasan tersebut memberikan pedoman yang jelas terkait perundungan, tetapi tidak mengikat koas. Landasan etik yang tersedia dari perguruan tinggi dapat berupa Kode Etik Mahasiswa dan Dosen, sedangkan dari rumah sakit dapat berupa Pedoman Perilaku. Dari 5 perguruan tinggi, 3 institusi secara eksplisit mencantumkan kata perundungan, dengan 1 perguruan tinggi memiliki aturan tambahan perihal mekanisme pelaporan dan penindakan yang spesifik. Dari 5 rumah sakit yang berafiliasi dengan perguruan tinggi tersebut, hanya 3 institusi yang memiliki Pedoman Perilaku yang tersedia secara digital, dengan 1 institusi tanpa Pedoman Perilaku memiliki peraturan bersama yang mengatur perundungan. Dengan demikian, landasan etik yang bersumber dari organisasi profesi telah cukup jelas dan mengikat. Akan tetapi, landasan etik yang bersumber dari perguruan tinggi dan rumah sakit masih belum tegas, dengan beberapa Kode Etik Mahasiswa, Dosen, dan Pedoman Perilaku Pegawai masih menyikapi perundungan secara tersirat.

Abstract

Law Number 17 of 2023 on Health transformed the Indonesian Medical Discipline Honorary Council (MKDKI) into the Professional Discipline Council (MDP). This development gave rise to three research questions: what is the relationship between professional discipline and law in Indonesia, how do disciplinary sanctions relate to legal sanctions, and how can MDP recommendations assist criminal and civil court proceedings? This research employed a normative legal research method using conceptual and statutory approaches. Law Number 17 of 2023 on Health is the primary legal material, which was analyzed normatively and qualitatively. This research found that professional discipline norms, which ideally should complement and support legal norms, still overlap with them. Article 306 uses the term “disciplinary sanction”, which may be interpreted as a legal measure, given that the term “sanction” carries legal implications. Further analysis is required, as the current study was limited to the aspect of legal diction. Article 308 introduces a new provision requiring MDP recommendations to be requested by investigators in criminal cases and by defendants in civil cases. However, the role of such recommendations in civil proceedings remains unclear, as it involves the principle of liability and potentially raises concerns of judicial subordination to the MDP. In summary, while efforts have been made to establish a connection between professional discipline enforcement and legal processes, further in-depth study is necessary.AbstrakUndang-Undang Nomor 17 Tahun 2023 tentang Kesehatan mengubah bentuk Majelis Kehormatan Disiplin Kedokteran Indonesia (MKDKI) menjadi Majelis Disiplin Profesi (MDP). Kehadiran undang-undang ini mengantarkan kepada tiga rumusan masalah berupa bagaimana hubungan antara disiplin profesi dengan hukum di Indonesia, bagaimana posisi sanksi disiplin terhadap sanksi hukum, dan bagaimana kemampuan rekomendasi MDP dalam membantu proses peradilan pidana dan perdata. Penelitian ini menggunakan metode hukum normatif dengan pendekatan konseptual dan perundang-undangan. Bahan hukum primer ialah Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, yang selanjutnya dianalisis secara kualitatif normatif. Penelitian ini menemukan bahwa norma disiplin profesi, yang secara ideal seharusnya memberikan makna dan dukungan terhadap norma hukum, masih tumpang tindih terhadap norma hukum. Pasal 306 masih menggunakan frasa “sanksi disiplin” yang berpotensi diinterpretasikan sebagai salah satu upaya hukum karena kata “sanksi” mengandung makna hukum. Analisis tersebut perlu diteliti lebih lanjut karena terbatas pada aspek kebahasaan. Pasal 308 membawa kebaruan berupa rekomendasi MDP yang harus dimintakan penyidik dalam konteks pidana dan tergugat dalam konteks perdata. Posisi rekomendasi secara perdata masih belum terang karena membawa asas tanggung gugat dan berpotensi menimbulkan subordinasi pengadilan terhadap MDP. Dengan demikian, terdapat usaha dalam menjelaskan hubungan antara penegakan disiplin profesi tenaga medis dengan hukum yang masih membutuhkan pendalaman.
