Abstract

This study aims to analyze the strategy and impact of revitalizing the Kyais ’ role in achieving sustainable economic Independence in pesantren. In the context of emerging economies, pesantrens possess significant social capital but remain vulnerable due to their financial dependence on external funding. This condition underscores the need to transform traditional spiritual leadership into a more professional, entrepreneurial model to support institutional sustainability. This research employs a qualitative approach with an instrumental case study design at the Islamic Boarding School, using purposive sampling. Data were collected through in-depth interviews, participant observation, and document analysis, and analyzed using an interactive model with triangulation to ensure validity. The findings reveal that the Kyai acts as the central architect of economic governance, integrating moral authority with strategic decision-making. Leadership revitalization is implemented through professional delegation, resource mapping, and vocational integration. This process produces a hybrid governance model combining centralized control and decentralized management.Furthermore, pesantren successfully transitioned into a production-based economic system. This transformation strengthens financial autonomy, student entrepreneurship, and community empowerment. The study contributes theoretically by proposing a charismatic–entrepreneurial leadership model and practically by offering a strategic framework for institutional Independence.

Abstract

This study discusses the implementation of the syirkah agreement in the Z-Chicken program managed by BAZNAS Jember as a form of economic empowerment for mustahik. A syirkah agreement is a form of cooperation between two or more parties to share capital, labor, or expertise in order to run a business with an agreed distribution of profits. The syirkah agreement is used as the basis for cooperation between BAZNAS Jember as the investor and mustahik as the business manager. This program aims to increase the economic independence of mustahik through a fast food fried chicken business by providing business capital, training, and assistance. This study employs a qualitative approach with a descriptive method. Data was collected through primary and secondary sources, including observation, interviews, and documentation. The results indicate that the implementation of the syirkah agreement in this program aligns with Sharia principles such as fairness, transparency, and sustainability. However, there are challenges in its implementation, such as beneficiaries' lack of experience in managing businesses and market access challenges. Despite this, the program has had a positive impact on increasing beneficiaries' income and economic independence. The Z-Chicken program serves as an innovative model for productive zakat with promising potential for the future. To enhance the program's effectiveness, intensive mentoring, market access expansion strategies, and regular evaluations are needed to optimize the results achieved. Abstract

The rapid expansion of financial technology has transformed consumer credit markets in Muslim societies, particularly through the proliferation of Buy Now Pay Later (paylater) services. While these digital deferred payment schemes are often promoted as flexible and Sharia-compliant alternatives to conventional credit, their legal positioning remains deeply contested. This article examines the legal ambiguities surrounding fintech paylater by analysing the tension between Sharia compliance and consumer protection within contemporary regulatory frameworks. Drawing on qualitative doctrinal and regulatory analysis, the study engages with Islamic legal discourse, consumer protection law, and fintech governance literature to explore how legal legitimacy is constructed and contested in digital financial markets. The findings demonstrate that Sharia compliance in fintech paylater is predominantly established through contractual formalism, focusing on permissible legal forms rather than substantive economic and behavioural outcomes. This approach, while facilitating regulatory acceptance, often fails to address consumer vulnerabilities arising from information asymmetry, over-indebtedness, and penalty-based revenue structures. Moreover, the study reveals that fragmented governance characterised by the institutional separation of financial regulators, consumer protection authorities, and Sharia governance bodies plays a central role in sustaining legal ambiguity. Compliance with religious norms does not necessarily translate into effective consumer protection, allowing fintech providers to navigate regulatory boundaries selectively. By foregrounding legal ambiguity and governance fragmentation, this article contributes to scholarly debates on Islamic fintech regulation and consumer law. It challenges the assumption that formal Sharia compliance inherently ensures ethical financial practices and argues for integrated regulatory approaches that reconcile religious legitimacy with substantive consumer protection. The study offers conceptual insights relevant to legal scholars, policymakers, and regulators grappling with the complexities of digital deferred payment systems in Muslim societies.

Abstract

Waqf assets play an important role in sustaining religious, educational, and social activities in rural communities. However, many waqf assets remain vulnerable because their legal status has not been formally documented through a Waqf Pledge Deed (Akta Ikrar Wakaf or AIW). This community service program aimed to strengthen the legal protection of waqf assets in Kemirian Village, Indonesia, by improving community legal literacy and facilitating the administrative formalization of waqf assets. The program employed a participatory assistance approach that integrated legal education, waqf asset identification, document inventory, administrative verification, social mediation, and facilitation with the Waqf Pledge Deed Official (PPAIW) at the local Office of Religious Affairs (KUA). The implementation revealed several barriers to waqf legalization, including incomplete historical ownership documents, limited administrative capacity among nazhir, operational constraints, and concerns regarding potential social tensions with heirs. Through intensive assistance, community administrators were supported in organizing required documents, understanding legal procedures, communicating with relevant institutions, and advancing the waqf pledge process. One identified prayer-room asset successfully progressed through a critical stage of waqf legalization, providing a practical reference for other community-managed religious assets. The program demonstrates that participatory assistance can bridge the gap between religious recognition and formal legal certainty. It also highlights the strategic role of higher education institutions in strengthening nazhir capacity, facilitating institutional coordination, and supporting sustainable community-based waqf governance.

Abstract

Productive zakat is increasingly recognized as a potential instrument for reducing poverty and promoting sustainable community empowerment. However, previous studies have largely emphasized economic outcomes, providing limited explanation of the integrated processes through which productive zakat supports long-term socioeconomic transformation. This study aims to develop an Integrated Community-Based Productive Zakat Model based on evidence from the Kampung Zakat program in Jember Regency, Indonesia. A qualitative case study design was employed. Data were obtained through semi-structured interviews, participant observation, and document analysis involving stakeholders and mustahiq directly engaged in the program. The data were analyzed inductively using the interactive framework of data condensation, data display, and conclusion drawing with continuous verification. The findings indicate that productive capital alone is insufficient to sustain beneficiaries' economic progress. Its effectiveness depends on its integration with entrepreneurship capacity building, continuous mentoring, spiritual development, community participation, and institutional collaboration. These interconnected elements form an empowerment ecosystem that strengthens productive capability, business resilience, social participation, self-confidence, and ethical responsibility, supporting the gradual movement of mustahiq toward greater economic independence and potential future contribution to community welfare. The study contributes to Islamic social finance literature by framing productive zakat as a multidimensional empowerment system rather than solely a redistributive mechanism. Practically, the proposed model offers guidance for zakat institutions and policymakers in designing more integrated and sustainable empowerment programs.
