Abstract

Investment plays a crucial role in promoting economic growth and maintaining national economic stability, especially in the context of globalization, which demands legal certainty and a conducive investment climate. This study is driven by the need to evaluate the effectiveness of Law Number 25 of 2007 concerning Investment as a legal instrument for strengthening the foundation of national economic development. The main issue examined is how the normative role of the Investment Law contributes to creating a healthy and sustainable investment climate. This research employs a normative juridical method using the statute approach and conceptual approach, focusing on the analysis of applicable regulations and relevant legal doctrines. The results of the study indicate that, normatively, the Investment Law provides legal certainty for investors. However, its implementation still faces several challenges, including regulatory overlap across sectors and weak institutional coordination. Therefore, regulatory harmonization and institutional strengthening are essential to ensure that the law effectively supports sustainable economic growth and national stability.

Abstract

This study aims to analyze the legal position and evidentiary degradation of authentic deeds within the Indonesian civil evidentiary system and to formulate a structured theoretical framework for judicial assessment parameters. The research addresses the inconsistency between Articles 1868 and 1870 of the Indonesian Civil Code, which normatively grant authentic deeds perfect and binding evidentiary force, and judicial practice that demonstrates variable interpretations potentially leading to legal uncertainty. This study employs a normative legal method with statutory, conceptual, and case approaches, particularly through ratio decidendi analysis of Supreme Court decisions. The findings reveal that the evidentiary strength of authentic deeds is not absolute but relatively presumptive, functioning as prima facie evidence subject to judicial evaluation through formal, material, and evidentiary consistency tests. The novelty of this research lies in the formulation of a typological model of evidentiary degradation that distinguishes between normative factors (formal defects and lack of authority) and evidentiary factors (conflicting evidence and counter-proof), integrated into an operational judicial assessment framework. This study contributes theoretically by reconstructing the doctrine of civil evidentiary law through positioning authentic deeds as rebuttable proof, and practically by providing systematic guidance for judges in ensuring consistent legal reasoning, as well as for notaries and legal actors in maintaining compliance with formal and substantive requirements to preserve evidentiary validity in civil dispute resolution.   Penelitian ini bertujuan untuk menganalisis kedudukan hukum dan degradasi kekuatan pembuktian akta autentik dalam sistem pembuktian perdata di Indonesia serta merumuskan kerangka teoretis yang sistematis mengenai parameter penilaian hakim. Permasalahan penelitian berangkat dari ketidaksesuaian antara ketentuan Pasal 1868 dan Pasal 1870 KUHPerdata yang secara normatif memberikan kekuatan pembuktian sempurna dan mengikat, dengan praktik peradilan yang menunjukkan variasi penilaian hakim sehingga berpotensi menimbulkan ketidakpastian hukum. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus melalui analisis ratio decidendi putusan Mahkamah Agung. Hasil penelitian menunjukkan bahwa kekuatan pembuktian akta autentik bersifat relatif-presumtif dan tidak absolut, melainkan sebagai alat bukti awal yang tunduk pada pengujian yudisial melalui uji formil, uji materiil, dan uji konsistensi alat bukti. Kebaruan penelitian ini terletak pada perumusan model tipologi degradasi kekuatan pembuktian yang membedakan faktor normatif (cacat formil dan kewenangan) dan faktor pembuktian (konflik alat bukti dan pembuktian sebaliknya), yang diintegrasikan dalam parameter penilaian hakim yang operasional. Kontribusi penelitian ini secara teoretis memperkuat rekonstruksi doktrin hukum pembuktian dengan menempatkan akta autentik sebagai alat bukti yang dapat dipatahkan (rebuttable proof), serta secara praktis memberikan pedoman bagi hakim dalam membangun konsistensi pertimbangan hukum dan bagi notaris serta para pihak dalam menjaga validitas pembuktian dalam penyelesaian sengketa perdata.
