Abstract

The phenomenon of living together, or cohabitation without legal marriage, has attracted increasing attention in Indonesia due to urbanization, population mobility, and changing patterns of social interaction. This phenomenon may also emerge in Padang City, where the philosophy of Adat Basandi Syarak, Syarak Basandi Kitabullah (ABS-SBK) remains a fundamental social value. This study aims to analyze the phenomenon of living together in Padang City from the perspective of Islamic law and examine its implications for the implementation of ABS-SBK values. This research employed an empirical legal (socio-legal) approach integrating Islamic law, sociology of law, and Minangkabau customary law. Data were collected through in-depth interviews, observation, documentation, and literature review, then analyzed using the interactive model of Miles, Huberman, and SaldaƱa. The findings indicate that living together is influenced by urbanization, global cultural influences, digital media, and the weakening of social control. From the perspective of Islamic law, the practice contradicts the objectives of maq??id al-syar?'ah, particularly the protection of religion, honor, and lineage. The declining implementation of ABS-SBK values also weakens the role of customary institutions in maintaining social order. This study recommends strengthening collaboration among local government, customary institutions, religious leaders, and the community to reinforce ABS-SBK values amid contemporary social change.
