Abstract

This study analyzes the legal consequences of notaries’ non-compliance with the Know Your Customer Principle and the forms of legal protection available to notaries for consequences arising from such non-compliance. The research employs a normative juridical method using statutory, conceptual, analytical, and case approaches. The legal materials consist of primary, secondary, and tertiary sources collected through identification, inventory, classification, and literature review, and analyzed using grammatical and systematic interpretation as well as analogy and legal refinement. The case analysis focuses on Supreme Court Decision No. 2281 K/Pdt/2017, Supreme Court Decision No. 68 K/PID/2019, and Gianyar District Court Decision No. 259/Pdt.G/2020/PN Gin. The findings show that non-compliance may result in the alteration or termination of legal status and legal relationships, loss of the binding force of notarial deeds, and administrative, civil, criminal, and professional ethical liability. Legal protection for notaries is not absolute but depends on the scope of authority, good faith, degree of fault, and causal relationship between the notary’s conduct and the legal consequences arising from it.
