Abstract

The current development of technology supports the use of e-commerce for fulfillment of public needs. Nowadays, more start-ups and digital companies in Indonesia, including Micro, Small and Medium Enterprises (MSME) are targeting sharia market through selling halal goods on e-commerce shop and provide sharia investment products for Muslims. However, the high usage of e-commerce in Indonesia, which has become a necessity for Muslim societies, is not comparable with halal certification on MSME products in e-commerce. Based on the problems, this paper examines the urgency and mechanism of halal certification in MSME products in e-commerce in Indonesia. This research uses juridical-normative research methods to address this issue. Based on the research result, researchers found that coordination with all parties is needed, ranging from the government to the industrial actors, so that all MSME products from e-commerce can easily carry out halal certification. The government needs to form a digital economic interconnection of sharia so that the sharia economy is also not left behind in terms of financial technology, Islamic financial institutions, online commerce, and social finance. Various parties including the Ministry of Trade, the National Sharia Council (DSN) MUI need to make regulations and fatwa in support of halal certification in e-commerce. Keywords: e-commerce; halal certification; Indonesian economy; MSME; products.

Abstract

Artikel ini memberikan gambaran mengenai wakaf untuk lingkungan hidup dan kaitannya dengan pembangunan berkelanjutan dan keadilan antargenerasi. Wakaf merupakan salah satu instrumen hukum Islam untuk menyelesaikan permasalahan umat, yang mana salah satunya adalah masalah lingkungan hidup yang terkait pula dengan pembangunan berkelanjutan dan keadilan untuk generasi yang akan datang. Penelitian ini adalah penelitian kualitatif dengan desain deskriptif analitis. Hasil penelitian menunjukkan bahwa wakaf untuk lingkungan hidup dapat menyeimbangkan antara pembangunan dan keberlanjutan lingkungan hidup, serta berimbas pelestarian lingkungan hidup yang berkelanjutan dan penciptaan keadilan antargenerasi, di mana generasi yang akan datang akan memiliki tingkat pemanfaatan lingkungan hidup dan sumber daya alam yang setidaknya sama dengan tingkat pemanfaatan dari generasi sekarang, baik dalam hal keanekaragaman pilihan atas sumber daya alam, kualitas lingkungan hidup dan sumber daya alam dan akses atas lingkungan hidup dan sumber daya alam.

Abstract

Peningkatan bonus demografi di Indonesia menyebabkan jumlah permukaan lahan untuk dimanfaatkan ruangnya dalam menggerakan roda ekonomi semakin sempit. Provinsi Daerah Khusus Ibukota Jakarta yang menjadi pusat bisnis dalam menghadapi masalah keterbatasan lahan perlu memanfaatkan ruang bawah tanah yang ada. Keberadaan ruang bawah tanah pada praktiknya dimanfaatkan untuk sarana jaringan utilitas terpadu agar pemanfaatan lahan menjadi lebih optimal. Sebelum adanya Undang-Undang Nomor 11 Tahun 2020 pemanfaatan ruang bawah tanah tidak diatur secara komprehensif. Kemudian barulah Peraturan Pemerintah No. 18 tahun 2021 menegaskan secara yuridis bahwa terdapat pemisahan secara horizontal antara kepemilikan hak atas tanah di atas permukaan dengan di bawah tanah. Namun dalam penerapan peraturan-peraturan dimaksud masih perlu adanya sosialisasi terus menerus agar tercipta keteraturan pemahaman hukum. Lebih lanjut, dengan adanya Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 yang menyatakan UUCK inkonstitusional bersyarat diduga dapat memperlambat proses penerapan peraturan baru ini. Bahwa dalam hal ini diperlukan peranan notaris sebagai pejabat pembuat akta tanah yang akan bersinggungan dengan hal-hal dimaksud. Notaris perlu turut andil dalam peran edukasi terkait khususnya pelaksanaanya selama masa pandemi covid-19 saat ini. Penulis menemukan dalam pemanfaatan ruang bawah tanah menggunakan hak guna bangunan dimana untuk pembuatan aktanya dapat diproses oleh notaris.Keyword: Notaris, ruang bawah tanah, jaringan utilitasAbstractThe increase in the demographic bonus in Indonesia causes the amount of land to be used for economic development purposes has its own limitation. The Province of the Special Capital City Region of Jakarta, which is a business center that dealing with the problem of limited land, needs to take advantage of the existing underground space. The existence of underground space is usually utilized for integrated utility network facilities so that land use becomes more optimal. Prior to Law Number 11 of 2020 the use of underground spaces was not comprehensively regulated. Then the Government Regulation No. 18 of 2021 juridically confirms that there is a horizontal separation between ownership of land rights above the surface and below the ground. However, in the application of these regulations, there is still a need for continuous socialization in order to create a regular understanding of the law. Furthermore, with the Constitutional Court Decision Number 91/PUU-XVIII/2020 which states that the UUCK is conditionally unconstitutional, it is suspected that it can slow down the process of implementing this new regulation. That in this case the role of a notary as an official making land deeds is needed which will intersect with the underground utilization. Notaries need to take part in the role of related education, especially its implementation during the current covid-19 pandemic. The author finds that in the use of the basement using the right to use the building where the deed can be processed by a notary.

Abstract

Cessie or what is known as Hawalah in Islamic financial institutions is a debt transfer agreement that is widelyused by banks because it is a way to transfer the right to collect to another party and/or a third party to guarantee creditfacilities or funds provided by the bank. In making a Deed of Cessie or Hawalah Deed, a Notary must pay attention to the provisions of positive law and Islamic law. This is related to legal certainty regarding the validity of the deed and itsharmony with Islamic law. The research method used in this study is the doctrinal research method. The data used in this study are secondary data obtained from document studies and strengthened by case analysis. The purpose of this study is to understand the legal consequences of a Hawalah Deed that does not meet the applicable legal provisions and the notary's responsibility for a Hawalah Deed that is canceled by a religious court. Based on the study’s result, a Hawalah Deed that does not meet the provisions of the law can be canceled or null and void by law. A Hawalah Deed that is canceled by the court makes the deed no longer have perfect evidentiary power. The notary who makes the deed can be sued for compensation, costs and interest in the aggrieved party.

Abstract

This study examines the urgency of anti-circumvention regulations in Indonesia to address the practice of circumvention that harms the domestic industry and state revenue. Circumvention, or avoidance of anti-dumping import duties in Indonesia, often occurs through diverting export routes through third countries. For example, H&I Section steel from China has entered Indonesia via Thailand. Similarly, after anti-dumping was imposed on Chinese HRC Alloy products, imports from Japan, Taiwan, and Vietnam surged. As a result, the domestic industry experienced significant sales volume and profits declines, while the country lost potential revenue. The broader impact includes reduced anti-dumping policy effectiveness, increased risk of layoffs, and factory closures due to unfair competition resulting from circumvention. This study employs qualitative normative research methods through a literature review, examining primary legal materials (such as laws and regulations from Indonesia and the U.S.), secondary sources (literature, journals, previous research results), and tertiary sources (legal dictionaries, encyclopedias). The analysis uses a comparative approach between the Indonesian and United States legal systems and examines Islamic law's perspective on these practices. The study’s findings indicate that Indonesia lacks specific regulations to address circumvention, unlike the United States, which already has a structured system. Concrete recommendations include: first, there is a need for a clear operational definition of circumvention. Second, an integrated monitoring system should be developed based on national trade data and community involvement through complaint channels. Third, the investigation procedure should allow initiation by both the authorities and external parties, with field verification and a deadline for completion. Fourth, progressive sanctions should be enforced, such as expanding anti-dumping import duties, suspending import permits, and imposing retroactive fines. Regulations can be further strengthened by adopting best practices from countries such as the United States and integrating the principles of maqashid sharia (justice, protection of property, and public welfare) so that regulations are technically effective, fair, and socially sustainable. With these measures, Indonesia can close the regulatory gap regarding circumvention, protect the domestic industry, and optimize state revenues from the international trade sector.

Abstract

Tanah menurut KUH Perdata termasuk golongan benda tidak bergerak. Berdasarkan Pasal 26 Undang-Undang Nomor 5 Tahun 1960 tentang Pokok Agraria pemindahan kepemilikan terhadap Tanah dapat dilakukan dengan cara jual-beli, tukar-menukar, hibah, pemberian menurut adat, wasiat serta pemindahan lain yang pelaksanaannya diatur Peraturan Pemerintah. Pada kenyataannya, peraturan perundang-undangan tidak selalu ter-realisasi pada masyarakat dengan baik. Sebagaimana ditemukan suatu surat pernyataan yang memuat klausul bahwa pihak pertama akan memberikan sebidang tanah beserta rumah sebagai shadaqah kepada pihak kedua. Dari adanya kasus tersebut, menarik untuk dibahas mengenai klausulnya, yaitu bagaimana keabsahan dan pelaksanaannya jika kondisi pada klausul tersebut terpenuhi. Untuk menjawab permasalahan tersebut maka dilakukan kajian literatur, yaitu dengan menggunakan metode penelitian doktrinal. Tujuan dilakukannya penelitian ini yaitu untuk memberikan edukasi mengenai konsep pemindahan hak atas tanah serta memberikan kebaharuan referensi dalam khasanah keilmuan hukum. Hasil penelitian yang didapatkan adalah konsep shadaqah tidak dapat disamakan dengan hibah dan untuk melaksanakan klausul tersebut maka perlu dibuatkan akta hibah.

Abstract

Penelitian ini bertujuan untuk menganalisis potensi dan tantangan penerbitan instrumen syariah berwawasan lingkungan di pasar modal Indonesia, termasuk green sukuk, blue sukuk, dan green reksa dana syariah. Instrumen ini diharapkan dapat mendukung pembangunan berkelanjutan dengan memperhatikan aspek lingkungan. Penelitian ini menggunakan pendekatan deskriptif-kualitatif melalui studi literatur yang meliputi penerbitan green sukuk oleh pemerintah Indonesia pada tahun 2018 dan 2019, serta potensi pengembangan oleh sektor swasta. Hasil penelitian menunjukkan bahwa green sukuk, yang ditujukan untuk proyek-proyek daratan, dan blue sukuk, yang berfokus pada ekosistem laut, memiliki peluang besar untuk berkembang. Namun, terdapat sejumlah tantangan yang dihadapi, seperti keterbatasan identifikasi aset berkelanjutan, kesiapan perusahaan penerbit, dan minimnya pihak yang melakukan penilaian lingkungan. Selain itu, langkah pemerintah dengan penerbitan green sukuk mendapat apresiasi internasional, namun upaya lebih lanjut dibutuhkan untuk mendorong korporasi menerbitkan instrumen serupa. Penerbitan sukuk bertema lingkungan oleh pemerintah telah membuka jalan bagi pengembangan lebih lanjut oleh sektor swasta. Sehingga perlu adanya penguatan kerja sama antara OJK dan pemangku kepentingan untuk menciptakan infrastruktur pendukung, serta pengembangan indeks syariah yang berfokus pada investasi berwawasan lingkungan. Produk seperti green reksa dana syariah juga perlu dikembangkan untuk memberikan pilihan investasi yang lebih beragam bagi investor yang peduli lingkungan.

Abstract

Abuse of circumstances (Misbruik van Omstandigheiden or undue influence) is an interesting and frequent phenomenon in agreements. Abuse of circumstances can be in the form of a contract in an agreement or a contract used in doing business. Misbruik van Omstandigheiden or undue influence . The agreement of unequal cooperation can occur because there are parties who have a stronger position and are at the top to suppress or threaten the weaker parties. The existence of a bargaining position is the reason why a party in a weak position cannot get freedom of opinion and decide something related to their own interests or common interests. The writing of this article uses qualitative research methods. The material for writing this article was obtained by literature study and analyzed using legal interpretation. Sharia treaty arrangements that exist and are related to undue influence elements are a form of agreement that is prohibited and forbidden until it is called ikrah. Ikrah is the coercion of the strong against the weak, while doing ikrah is a deed and disliked by God. To do ikrah is to violate the elements and conditions of trade in Islam. The legal effect of this act is a null and void agreement.

Abstract

Abstract. The inauguration of the stock waqf by the Indonesia Stock Exchange in 2019 and a significant number of Sharia investors have led to considerable potential in stock endowments. This study examines the development of stock endowments for Muslim investors, using a normative-empirical legal study with data obtained from a survey involving stock investors and a literature study. The study concludes that the public had practiced stock waqf or money waqf even before the issuance of the MUI fatwa in 2002 concerning Money Endowments, while stock endowments were officially launched by IDX in 2019. Based on the questionnaire distributed to investors, most knew the stock endowments. Law No. 41 of 2004 on Waqf has been knowledgeable, but the waqf distribution was improperly distributed.Abstrak. Diresmikannya wakaf saham oleh Bursa Efek Indonesia pada tahun 2019 dan jumlah investor syariah yang signifkan menjadi potensi wakaf saham yang cukup besar. Penelitian inimengkaji perkembangan wakaf saham bagi investor Muslim, dengan menggunakan kajian hukum normatif-empiris. Data diperoleh melalui survei kepada investor saham dan studi literatur. Peneliti menyimpulkan bahwa masyarakat telah melakukan wakaf saham atau wakaf uang sejak sebelum keluarnya fatwa MUI tahun 2002 tentang Wakaf Uang. Sedangkan wakaf saham resmi diluncurkan oleh BEI pada tahun 2019. Berdasarkan kuisioner yang dibagikan kepada investor, mereka familiar dengan wakaf saham. Namun, meskipun Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf sudah banyak diketahui, namun penyaluran wakaf tidak tersalurkan dengan baik.
