Abstract

This study is driven by the necessity of upholding the ethical guidelines for those organizing elections to maintain the professionalism and integrity of electoral processes, especially regarding Decision of the Election Organizer Honorary Council (DKPP) Number 150-PKE-DKPP/VII/2024 related to suspected ethical breaches by the Chairperson and Members of the Karanganyar Regency General Elections Commission. The goal of this research is to evaluate the considerations made by DKPP in resolving the reported ethical breaches and to investigate the legal effects of this judgment on the Chairperson and Members of the Karanganyar Regency General Elections Commission. This research utilizes normative legal research along with both a statutory and case approach. The legal materials analyzed include primary, secondary, and tertiary resources gathered through library research, which were examined using deductive reasoning. The findings indicate that the DKPP's considerations were founded on an evaluation of the allegations made by the complainant, the responses from the respondents, testimonies from involved parties, and evidence, all assessed according to the principles of integrity, professionalism, independence, and accountability expected of election organizers. DKPP partially upheld the complaint, reinstating the reputations of Daryono, Santosa, Siti Halimatus Sa’diyah, and Andis Yuli Pamungkas, while issuing Devid Wahyuningtyas a Final Stern Warning. This decision is conclusive and obligatory, requiring the General Elections Commission to implement it within a week following its announcement. These legal implications reflect that the enforcement of ethical standards functions not merely as a means of penalties but also as a tool to uphold the dignity, integrity, and accountability of those who manage elections.

Abstract

The amendment concerning the placement of active members of the Indonesian National Armed Forces (TNI) in civilian positions through Article 47 of Law Number 3 of 2025 raises legal issues concerning the implementation of civilian supremacy within the Indonesian rule-of-law state. The expansion of civilian positions available to active military personnel may blur the boundary between defense functions and civilian governmental administration, while also creating concerns regarding military professionalism, the merit system within the civil service, legal accountability, and civilian oversight of military authority. This study aims to juridically analyze the implications of the amendment to Article 47 of the TNI Law for civilian supremacy and examine the legal consequences arising from the broader placement of active military personnel in civilian positions. This research employs a normative juridical method using a statutory and conceptual approach. The legal materials consist of primary, secondary, and tertiary legal materials analyzed descriptively and qualitatively through library research. The findings indicate that expanding civilian positions for active TNI personnel has the potential to weaken civilian supremacy by increasing military involvement in governmental affairs beyond the defense sector. Such circumstances may result in overlapping authorities, dual accountability, potential inequality in law enforcement, and disruption of the merit-based civil service system. Regulatory restructuring through legislative review, strengthened civilian oversight, and judicial review mechanisms is necessary to ensure that the involvement of active military personnel remains limited, objective, and consistent with the principles of the rule of law and democracy.

Abstract

The transfer of land rights through a sale and purchase transaction may give rise to legal problems when the seller fails to fulfill the obligation to complete the certificate transfer process. This situation occurred in Surakarta District Court Decision Number 282/PDT.G/2023/PN.Skt, where the Plaintiff had fully paid the purchase price and received the land certificate, but the transfer of rights could not be completed due to the Defendant’s absence. This research aims to examine the judge’s legal considerations in determining the form of legal violation and to analyze the legal consequences arising from the resolution of the case. This research employs normative legal research using a statutory approach and a case approach. Legal materials were obtained through library research and analyzed qualitatively. The results indicate that the Panel of Judges considered the legal relationship between the parties to arise from a land sale and purchase agreement. Therefore, the Defendant’s failure to complete the certificate transfer process was classified as a breach of contract (wanprestasi) rather than an unlawful act. The legal consequences of the decision include granting the Plaintiff authority to transfer the name of Certificate of Ownership Number 02399 through the Surakarta City Land Office without the Defendant’s presence, while the claim for compensation was rejected because material losses were not proven. The decision provides legal protection for the good-faith buyer and strengthens legal certainty in land administration.
