Abstract

This article examines online gambling addiction (gambling disorder) in the criminal responsibility of murder offenders under Indonesia’s New Criminal Code, focusing on mens rea, capacity for responsibility, causation, and sentencing. This normative legal study applies statutory, conceptual, case, and comparative approaches using grammatical, systematic, and teleological interpretation and deductive reasoning. The Ahmad Fahrozi case is used only as a factual illustration, not a final judicial precedent. The analysis shows that gambling disorder does not automatically negate intent or criminal responsibility. Its legal significance depends on functional impairment at the time of the offense and its relevance to Articles 38-39, requiring forensic psychiatric assessment. Gambling addiction is therefore better treated as a criminogenic or motivational background factor unless a functional effect on capacity is established. The study’s novelty lies in integrating gambling disorder, criminal causation, diminished responsibility, forensic psychiatric evidence, and individualized sentencing. It contributes a structured framework that avoids treating addiction as an automatic excuse while preserving its relevance when clinically established.

Abstract

Gambiran Village in Prigen District, Pasuruan Regency, East Java, possesses significant horticultural potential; however, its utilization remains suboptimal due to limitations in post-harvest processing, packaging, and marketing, alongside low community awareness regarding environmental law. To address these issues, a community service program titled Gambiran Sociopreneur Hub: Realizing High-Value Horticulture and a Village Environmental Law Awareness Movement was implemented using a Participatory Action Research (PAR) approach. The program focused on three key areas: Horti-Socio Business Classes to foster innovation in product development, packaging, and digital marketing of horticultural produce; education and practical training on waste management to support a circular economy; and legal education combined with assistance for conflict resolution at the community level. Program outcomes included enhanced resident capacity to develop marketable processed horticultural products, the creation of a digital business catalog, the establishment of a pilot waste-sorting cluster, and the formulation of village-level conflict mediation Standard Operating Procedures (SOPs). This initiative demonstrates that community empowerment can drive sociopreneurship-based economic growth while simultaneously strengthening long-term compliance with environmental laws.
