Abstract

Local government oversight regarding environmental pollution serves as a crucial instrument for ensuring business compliance with environmental protection and management regulations. The operations of the Pangkalan Susu Steam Power Plant (PLTU) have the potential to impact environmental quality, public health, and the livelihoods of local fishermen and farmers. This study aims to analyze the oversight activities conducted by the Langkat Regency Environmental Agency regarding pollution caused by the Pangkalan Susu PLTU, applying George R. Terry’s management functions and the perspective of Al-Shulṭah al-Tanfīdziyyah (executive authority). An empirical legal research method with a qualitative approach was employed, utilizing interviews, document analysis, and literature reviews. The findings indicate that oversight has been carried out in accordance with Article 71 of Law Number 32 of 2009 and Government Regulation Number 22 of 2021 regarding government supervision duties. However, the effectiveness of this oversight remains constrained by limited human resources and budget, the vastness of the area requiring supervision, and suboptimal inter-agency coordination. From the perspective of Al-Shulṭah al-Tanfīdziyyah, the Environmental Agency has fulfilled its governmental role as a policy implementer and legal overseer, yet the goal of ensuring the public good (maslahah) has not been fully realized. Therefore, strengthening oversight, enhancing cross-sector coordination, and ensuring more consistent law enforcement are essential to improve environmental protection.
