Abstract

This paper aims to determine the function of village legislative at post-reform. Based on historical data as well as critical analyzes of UU No. 22/1999 tentang Pemerintahan Daerah, UU No. 32/2004 tentang Pemerintahan Daerah, and UU No. 6/2014 tentang Desa, it can be concluded that the function of village legislative at post-reform is ups and downs. BPD 1999 has such a dominant function, so that the village government is unbalanced. The function of BPD 2004 is stripped down, so that the village executive can run his will without any supervision. The BPD 2014 is equipped with control function, so that the expected mechanism of checks and balances in village governance can be realized. Thus, it can be said that the function of BPD 1999 is dominant, the function of BPD 2004decreased, while the function of BPD 2014 is placed in a matched.

Abstract

Besarnya kekuasaan kepala desa sejak masa Orde Baru direspon dengan terbitnya peraturan perundang-undangan tentang desa setelah reformasi dengan membatasi masa jabatannya. Tulisan ini menganalisis perbandingan pembatasan kekuasaan kepala desa melalui masa jabatannya pada UU No. 22/1999, UU No. 32/2004, dan UU No. 6/2014. Penulis menyimpulkan bahwa berdasarkan pendekatan undang-undang, pembatasan tersebut mengalami kemerosotan terutama pada UU No. 6/2014. Adapun berdasarkan pendekatan konstitusionalisme, norma tentang diperkenankannya seseorang menjabat sebagai kepala desa selama tiga periode (18 tahun) dalam UU No. 6/2014 bertolak belakang dengan arah politik hukum dalam UUD NRI 1945 sekaligus dinilai inkonstitusional.

Abstract

Community participation in national and state life today is an important study. This is because in a democratic country, public policy cannot be separated from public participation. This study seeks to discuss the relationship between community participation, the making of Act and the implementation of judicial review. The results showed that: (1) Public participation in the making of Act and the implementation of judicial review can: (a) Provide a better basis for public policy making in creating good governance. (b) Increase citizens' trust in the executive and legislative branches. (c) Save human resources, because with the involvement of the community in public policy making, the resources used in public policy socialization can be minimized. (2). Community participation in evaluating Act becomes an important activity, in order to establish control whether an Act is in accordance with its objectives or not. The public can submit a judicial review to the Supreme Court (MA) or the Constitutional Court (MK) if they judge that their rights have been impaired by certain Act. (3). The relationship between community participation and the making of Act and the implementation of judicial review is very close. Without community participation, the Act produced does not reflect the interests of the community and only prioritizes the interests of certain groups. The Constitutional Court (MK) and the Supreme Court (MA) will not conduct a judicial review if there is no request from the public.

Abstract

The issuance of POJK RI. No. 37/POJK.04/2018 is one of the efforts of the OJK in responding to the development of equity crowdfunding in Indonesia. This regulation basically requires legal certainty, so as to provide security and comfort for every citizen in running the fintech industry. In an effort to assess the fulfillment of the principle of legal certainty in the RI POJK. No. 37/POJK.04/2018, the author uses the theory of legal certainty according to Gustav Radbruch's theory. The preparation of this article uses a philosophical approach and a statutory approach. The author concludes that the principle of legal certainty has been fulfilled in the POJK RI. No. 37/POJK.04/2018, because it has been stated through its philosophical basis and norms. This is in accordance with what has been stated by Gustav Radbruch, where in addition to justice and expediency, the provisions outlined through laws and regulations must be able to provide legal certainty for every citizen.

Abstract

This study aims to examine the overlapping authority between the Ministry of Home Affairs and the Ministry of Village and Development of Disadvantaged Regions, Transmigration and Ministerial Regulations issued can disrupt the constitutional system of the Republic of Indonesia, especially related to the system and hierarchy of applicable laws and regulations. At the local level, such conditions create difficulties for village governments as technical implementers of policies issued by several ministries at once. The conflict between Ministerial Regulation norms and PDTT Amendments makes village governments as stakeholders feel confused about which laws and regulations will be used as guidelines. The type of research used is normative juridical research with a conceptual approach. The results obtained are based on the perspective of legal politics and legal harmonization analyses of two things. First, overlapping authorities and ministerial regulations occur because the Ministry of Home Affairs and the Ministry of Village Affairs have different perceptions about who has more authority to manage village affairs. Second, harmonization of the law of the Ministerial regulation that regulates villages can be realized through the political law of amending Law Number 6 of 2014 concerning Villages and the issuance of a new Presidential Regulation that specifies that there is only one ministry that handles villages. In this context, the author considers that village affairs should be more appropriately under the authority of the Ministry of Villages and Development of Disadvantaged Regions, Transmigration.

Abstract

Salah satu masa dalam pemikiran terkait negara ialah masa Abad Pertengahan. Abad Pertengahan, yang berlangsung dari abad ke-5 hingga ke-15, ditandai dengan dominasi gereja, sistem feodal, dan pemikiran teokratis, di mana pemikiran politik sangat dipengaruhi oleh ajaran agama. Artikel ini membahas pemikiran tentang negara pada masa Abad Pertengahan, dengan fokus pada perkembangan pemahaman kenegaraan dari perspektif berbagai tokoh, seperti Agustinus, Thomas Aquinas, dan Marsilius dari Padua. Penelitian ini menggunakan studi kepustakaan yang bersumber dari buku serta jurnal. Hasil penelitian menunjukkan bahwa Agustinus mengontraskan dua jenis negara: Civitas Dei (negara Tuhan) dan Civitas Terrena (negara duniawi), sementara Aquinas menekankan pentingnya hukum alam dan moralitas dalam pemerintahan. Marsilius, di sisi lain, menekankan kekuasaan rakyat dan pembuatan undang-undang sebagai inti dari pemerintahan yang baik. Makalah ini juga membandingkan pemikiran tersebut dengan konteks kenegaraan modern, menyoroti transisi dari dominasi agama menuju konsep negara-bangsa yang lebih sekuler dan demokratis. Melalui analisis ini, pemikiran kenegaraan di Abad Pertengahan diidentifikasi sebagai landasan penting yang mempengaruhi perkembangan teori politik selanjutnya, serta sebagai refleksi dari kondisi sosial dan politik pada zamannya.

Abstract

The discussion about Village Regulation arrangements in legal products is closely related to theory of legal politics. Based on a legal politics review, the Village Regulation arrangements in legal products are different. At one time, the Village Regulation was regulated in a Decree of the People's Consultative Assembly (Tap MPR). However, at other times, Village Regulation was regulated in acts (Undang-Undang). The Village Regulation arrangements always changes. There are times when the legal product regarding the formation of legislation regulates Village Regulation in a number of norms. However, there are times when the legal product regarding the formation of legislation does not regulate it. Furthermore, there are differences in Village Regulation arrangements in legal products concerning the formation of statutory regulations. There are legal products that state Village Regulation explicitly in the types and hierarchies of statutory regulations. However, there are also legal products that mention it implicitly through the articles. In addition to it shows that the Village Regulation arrangements in legal products depends on the wishes of the compiler, the position of Village Regulation in the national legal system can also be seen from the regulation in legal products. If the Village Regulation is regulated explicitly through its articles, the position of the Village Regulation will be stronger. If the Village Regulation is regulated implicitly, the position of the Village Regulation is weaker. If acts or other legal products do not regulate Village Regulation, their position is very weak.

Abstract

Dalam perkawinan, calon suami dan istri harus telah siap jiwa raganya, mempersiapkan fisik dan mentalnya sehingga perkawinan dapat terwujud dengan sakinah, mawaddah, warahmah tanpa adanya perceraian. Ukuran tingkat kedewasaan seseorang dalam pernikahan diimplementasikan sebagai batasan umur seseorang, yang harus dipenuhi sebagai syarat seseorang melakukan perkawinan tersebut. Meskipun telah ada regulasi yang mengatur terkait batasan umur tersebut, tidak sedikit juga terjadi penyimpangan dengan berupa pernikahan dibawah umur dengan berbagai macam alasan. Pola pikir masyarakat terhadap pernikahan dini menjadikan penyimpangan tersebut sering terjadi di daerah Kecamatan Kejayan. Metode penelitian yang digunakan dalam tulisan ini adalah metode observasi, wawancara dan studi pustaka. Dengan mengambil data primer berupa sampel pertanyaan dari tokoh masyarakat di Kecamatan Kejayan seperti; Kepala KUA Kejayan, bapak modin, ditambah dengan kepustakaan sebagai data sekunder sehingga dapat diketahui beberapa tinjauan terkait pernikahan dini, khususnya di daerah Kecamatan Kejayan. Implikasi dari tulisan ini, yaitu para Hakim di Pengadilan Agama diharapkan memperketat sesuai SOP terkait permohonan pernikahan dini, sehingga regulasi perkawinan bagi para calon suami atau istri yang ingin menikah dini tidak dianggap sepele, terkait persyaratan dalam permasalahan pernikahan dini.
