Abstract

The post-truth phenomenon has altered public communication patterns, where emotions and personal opinions often overshadow objective facts in shaping societal perceptions. This condition significantly impacts law enforcement institutions, particularly the Indonesian National Police (Polri), which frequently become targets of information distortion in digital spaces. This study aims to analyze how public distortion of police tasks develops in the post-truth era and its effects on legal legitimacy and social stability. Using a normative juridical method, this research reviews relevant legislation, including Law No. 2 of 2002 concerning the Indonesian National Police, Law No. 1 of 2024 concerning the Second Amendment to the Electronic Information and Transactions Law (UU ITE), and Police Regulation No. 1 of 2021 regarding Community Policing. The findings indicate that public distortion often appears as misrepresentation of police actions, dissemination of disinformation through social media, and misinterpretation of legal procedures. Triggering factors include low public legal literacy, dominance of online media algorithms, and conflicts of interest between the public and authorities. This distortion has legal and social implications, ranging from defamation to disruption of investigation processes. Therefore, a responsive strategy is required from Polri through strengthening public relations, synergy with the Ministry of Communication and Informatics (Kominfo), and cross-sector collaboration in building a healthy, data-based information ecosystem. The study concludes that an adaptive and educational legal approach is key to addressing the post-truth challenges faced by the police institution.

Abstract

Conflicts between martial arts groups in the Grobogan Regency pose a serious challenge to maintaining security and public order. This phenomenon not only causes social unrest but also has the potential to damage relations between residents and undermine trust in law and order. This study aims to analyze the role and efforts of the Indonesian National Police in addressing and resolving such conflicts, using a normative legal approach and theoretical analysis of social conflicts. In this context, the Indonesian National Police has a strategic responsibility in accordance with the mandate of Law No. 2 of 2002 on the Indonesian National Police, as well as Law No. 7 of 2012 on the Handling of Social Conflicts, which is reinforced by Government Regulation No. 2 of 2015. This study found that Polri's strategy includes a preemptive approach through education, a preventive approach through patrols and surveillance, and a repressive approach through law enforcement against perpetrators of violence. Apart from that, post-conflict situations are addressed through reconciliation efforts, rehabilitation, and ongoing monitoring. The findings indicate that the effectiveness of the Polri in conflict management is significantly influenced by the involvement of community leaders and the support of local governments. Therefore, synergy among stakeholders is key to successfully mitigating conflicts and building stronger social resilience in the future.

Abstract

The phenomenon of cyberbullying against members of the Indonesian National Police (Polri) on social media, especially Instagram, shows an escalation pattern from public criticism to massive collective digital attacks. This phenomenon is often triggered by a psychological effect known as the bandwagon effect, where netizens tend to join in the flow of mass insults without understanding the context of the event as a whole. This study aims to analyze how the bandwagon effect contributes to the escalation of cyberbullying against police officers and examine the legal protection available based on current laws and regulations. The method used is a normative legal approach by examining Law No. 1 of 2024 concerning the Second Amendment to the ITE Law, the New Criminal Code (Law No. 1 of 2023), and various internal police regulations, including Perpolri No. 7 of 2022 concerning the Code of Professional Ethics. The results of the analysis show that although there are legal instruments that can be used to ensnare perpetrators of cyberbullying, there are no norms that specifically regulate digital collective actions, such as the bandwagon effect. The main challenges in law enforcement include proving the perpetrator's intention, limited resources in digital investigations, and the gap between the development of communication technology and legal responses. Therefore, a more comprehensive cyber regulatory reform is needed, and an increase in the digital literacy of the community to create a healthy, fair, and civilized public space, including in the relationship between society and state institutions such as the Police.

Abstract

Fair and just law enforcement requires that every investigation process is subject to the principle of due process of law, including when coercive measures are taken by Civil Servant Investigators (PPNS). In this context, supervision by the Indonesian National Police through the Supervisory Coordinator (Korwas) mechanism is crucial to ensure that the implementation of investigations by PPNS does not deviate from criminal procedure law and does not violate human rights. This study aims to legally analyze the Korwas POLRI supervision mechanism for the implementation of coercive measures by PPNS and the extent to which such supervision ensures compliance with the principle of due process of law. The research method used is a normative legal approach by analyzing relevant laws and regulations such as Law Number 8 of 1981 concerning Criminal Procedure Law, Law Number 2 of 2002 concerning the Indonesian National Police, and Regulation of the Chief of the Indonesian National Police Number 20 of 2010 concerning Coordination, Supervision, and Guidance for PPNS. The study results indicate that although the supervisory mechanism has been regulated normatively, there are still weaknesses in technical implementation in the field, especially related to reporting, coordination between agencies, and protection of suspects' rights in the early stages of the investigation. It is recommended that there be regulatory reform, increased supervisory capacity, and the use of digital technology to support accountability and transparency of the investigation process by PPNS. Thus, Korwas supervision can function optimally in ensuring a legitimate, fair investigation process that upholds human rights.

Abstract

This study discusses the application of blockchain technology in strengthening the integrity of the electronic investigation management system (e-MP) within the Indonesian National Police (Polri). As demands for transparency, accountability, and data security in the investigation process increase, the e-MP system faces serious challenges related to potential data manipulation, weak internal controls, and limited objectively verifiable digital footprints. Blockchain technology offers a solution with its decentralized, transparent, and immutable characteristics, thus enhancing the validity of digital evidence and preventing illegal intervention in legal processes. This study uses a normative juridical approach by analyzing recent regulations such as Law No. 4 of 2023 on the Development and Strengthening of the Financial Sector (P2SK), Law No. 27 of 2022 on Personal Data Protection (UU PDP), as well as technical provisions from the Financial Services Authority (OJK) and Commodity Futures Trading Regulatory Agency (Bappebti) regarding digital assets. The analysis results show that the implementation of blockchain in e-MP requires regulatory readiness, institutional capacity strengthening, and the development of integrated digital infrastructure. The legal implications include the need for adjustments in criminal procedural law, personal data protection, and national policy strategies in the digital law sector. This study recommends the formulation of cross-sector policies, training for law enforcement officers, and institutional cooperation to ensure the technology's implementation aligns with legal and human rights principles. With the right approach, blockchain has the potential to become a main pillar in the reform of a modern and trustworthy investigation system.

Abstract

The development of artificial intelligence (AI) technology has had a significant impact on the transformation of policing models in Indonesia, particularly in the context of public safety and order (kamtibmas). The concepts of Police 5.0 and Electronic Community Policing (E-Polmas) are responses to the challenges of the 5.0 Industrial Revolution era, which demands that the police operate digitally, predictively, and collaboratively with the community. However, the use of AI technology by police institutions lacks a strong legal foundation. This study found that current regulations, such as Law No. 2 of 2002 on the National Police of the Republic of Indonesia, Law No. 27 of 2022 on Personal Data Protection, and the ITE Law, do not specifically address the governance of AI in law enforcement. This legal vacuum raises a number of issues, ranging from unclear accountability, and the risk of algorithmic discrimination, to potential human rights violations. Through a normative legal approach, this study emphasizes the urgency of reformulating digital policing regulations that must include the principles of algorithmic transparency, institutional accountability, human rights protection, and public participation. Besides, it is necessary to design new regulations that are in harmony with international standards, as well as to establish an independent supervisory commission to ensure oversight of the use of technology in police duties. Recommendations are given to lawmakers and the Indonesian National Police to immediately develop an adaptive, ethical, and progressive legal framework to ensure legal protection and the effectiveness of digital policing in the future.

Abstract

There is a conceptual error in the existence of peaceful fines when viewed from the implementation of peaceful fines itself, especially when applied to minor corruption crimes, which basically can be attached to the police institution, so that the fast track of criminal justice can be realised. Therefore, the purpose of the research conducted by researchers in this study is to find the concept of peaceful fines for the incorporation of restorative justice into Indonesia's evolving criminal code. Descriptive analysis is the research specification, and a normative juridical approach is the research methodology. Primary, secondary, and tertiary legal resources are the sources of the data. This research found that there is a social contract attached to state responsibility for the losses suffered by victims. This state responsibility is substantially and fundamentally attached to the state by attaching environmental losses and community losses in addition to state financial losses. Thus, the concept of punishment for corruption offences will be erroneous when only the state finances that are harmed are the focus. This also leads to amicable fines being the focus of punishment for corruption offences which will also be erroneous. The implementation of the concept of restorative justice in the form of peaceful fines places the Police as the implementer considering the ‘vanguard’ of law enforcement in Indonesia. On the other hand, the police also function as a conduit of information or a copy to the prosecutor's office and judges in court, the final result of which is an amicable fine set by the court.

Abstract

The sexual harassment case involving Agus Buntung, a physically disabled individual in Mataram, Nusa Tenggara Barat, presents intricate legal and social dimensions due to the involvement of both a female victim and a perpetrator with disabilities. A legal and sociological analysis of the case's handling, informed by the Law on Sexual Violence Crimes (UU TPKS) and the Law on Persons with Disabilities, underscores the challenges in upholding the principles of justice and non-discrimination. These challenges include ensuring disability accommodation, achieving a balanced treatment of all parties, and navigating the influence of public opinion. This paper argues for a reform of the criminal justice system to be more inclusive and responsive to individual vulnerabilities, thereby bridging the gap between normative and substantive justice for a contextual and humane application of the law.

Abstract

Enhancing the capacity of police organizations is crucial in the digital age, which is marked by increasingly complex cybercrime. This study analyzes capacity development within the Cyber Sub-Directorate V of the Special Criminal Investigation Directorate of the North Kalimantan Regional Police. Using a qualitative approach, this study explores the capacity enhancement mechanisms that have been implemented and the obstacles faced by the North Kalimantan Regional Police's cyber unit. The study results indicate that despite facing limitations in personnel and resources, various strategic efforts have improved the effectiveness of cybercrime case handling. The implementation of a technology-based case management system strengthened coordination among stakeholders, and ongoing human resource training programs have significantly contributed to enhancing personnel competencies and unit performance. The cyber case resolution rate increased from 60% to 80% within a year, accompanied by a decrease in the average handling time per case. On the other hand, challenges such as budget constraints, a shortage of IT-skilled personnel, rapid technological developments, regulatory constraints, and low public cyber awareness still hinder capacity optimization. This study provides in-depth insights into capacity development strategies in regional police cyber units and compares them with findings from similar research. The findings are expected to serve as a reference in formulating policies to strengthen police organizational capacity in addressing cybercrime threats.
