Abstract

Advances in information and communication technology have facilitated access to sources of knowledge and scholarly works; however, at the same time, they have also increased the potential for academic plagiarism and copyright infringement in educational settings. The practice of appropriating scholarly works without properly citing sources, as well as the use of others’ works without permission, poses a serious challenge to academic integrity and the development of a culture of scholarship. This study aims to analyze the concepts of academic plagiarism and copyright infringement, examine the status of intellectual property rights in Islamic law, and explain their legal status from the perspective of contemporary fiqh. This study employs a literature review (library research) using a normative-juridical and conceptual approach, while the data are analyzed using content analysis and descriptive-analytical methods. The results indicate that the majority of contemporary scholars and international fatwa institutions recognize intellectual property rights as part of property rights protected by Sharia. Plagiarism is viewed as a form of unjustly appropriating another person’s rights, involving elements of fraud (ghishy) and a breach of academic trust, while copyright infringement contradicts the principle of property protection (hifzh al-mal) and Sharia’s objective of safeguarding human welfare. Therefore, strengthening a culture of academic integrity, providing education on research ethics, and respecting intellectual property rights are crucial steps in preventing plagiarism and copyright infringement in educational institutions
