Abstract

This study aims to identify the acts classified as the criminal offense of pedophilia and to examine the legal regulations governing such offenses in Indonesia. A normative-descriptive research method was employed, utilizing statutory, case, and conceptual approaches. The findings indicate that acts falling under the category of pedophilia-related crimes include sexual intercourse, obscene acts, grooming, non-physical or verbal sexual harassment, and child pornography, all committed with the intent of obtaining sexual gratification. Furthermore, the legislative framework applicable to prosecuting pedophilia offenders in Indonesia comprises Law Number 1 of 2023 concerning the Criminal Code; Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection; Government Regulation of the Republic of Indonesia Number 70 of 2020 concerning Procedures for the Implementation of Chemical Castration, Installation of Electronic Detection Devices, Rehabilitation, and Public Disclosure of the Identities of Perpetrators of Sexual Violence Against Children; Law Number 12 of 2022 concerning Sexual Violence Crimes; and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions.
