Abstract

The cause of the damage and pollution of the Citarum river is the development of factory activities that produce waste from these production activities, if not processed properly it can disrupt the environmental ecosystem and cause natural pollution because the waste contains hazardous and toxic substances. Apart from causing contamination and damage to the river ecosystem, this is certainly endangering human life. Therefore, the West Java government is trying to improve the condition of the Citarum river by holding various Citarum river maintenance programs. Not only focusing on the government, the community must also be involved in repairing the Citarum river. In criminal law enforcement related to environmental issues related towaste water quality standards, emission quality standards, or disturbance quality standardsmost cases are resolved through administrative or civil channels. This law enforcement uses the principle of ultimum remedium which means that criminal law is the final case to resolve a case, or is called the final application. This writing aims to analyze the criminal law arrangements regarding the criminal act of pollution of the Citarum river and law enforcement against the criminal act of environmental pollution in the Citarum river in the form of waste disposal by reviewing Law no. 32 of 2009. This research method uses the method of juridical normative law. The results of this study are industrial waste that is not managed properly will be very detrimental to society, especially if the disposal of this waste is carried out to vital resources for the general public such as the Citarum river so that strict law enforcement is needed to provide a deterrent effect on perpetrators.

Abstract

Corruption is a legal issue that always comes up. The level of corruption in the private sector is quite high. Based on Corruption Eradication Commission (KPK) data, in 2004-2021, private parties who were convicted of corruption reached 359 people or 26%. This paper discusses the regulation regarding corruption, especially related to the private sector, before and after the enactment of Law Number 1 of 2023 concerning the Criminal Code. This paper uses normative writing methods with statutory and comparative approaches. Corruption is regulated in the Criminal Code Articles 209, 210, 378, 388, 418, 419, and Article 420. These articles were revoked after the enactment of Corruption Law. Corruption regulation in Law Number 1 of 2023 concerning the Criminal Code are contained in Articles 603, 604, 605(1), and Article 606 (1). There have been changes in the regulation of corruption, including the abolition of the threat of the death penalty. The criminal act of corruption in the New Criminal Code does not make corruption cases lose its category as a special crime and extraordinary crime, because the existence of corruption articles in the New Criminal Code aims to compile a codification of criminal law, where corruption articles are generally formulated as core crimes, which function as bridging articles between the New Criminal Code and laws outside the New Criminal Code. The corruption law as a lex specialis requires a lex generalis in criminal code, this codification does not eliminate corruption from it’s characteristic as a special crime, and the Corruption Law in general is still in force, as well as the KPK (Corruption Eradication Commission) is still authorized to deal with corruption.

Abstract

Sistem Peradilan Pidana Anak memberikan perlindungan kepada anak pelaku tindak pidana. Pengaturan pidana mengenaiAnak mengalami perubahan ke arah restorative justice dengan adanya alternatif penyelesaian. Penelitian ini bertujuan untuk mengkaji restorative justice dan penjatuhan pidana pada perkara Anak. Penelitian ini menggunakan metode yuridis normatif dengan analisis data secara normative kualitatif menggunakan pendekatan perundang-undangan. Hasil penelitian ini adalah prosedur diversi digunakan untuk mewujudkan restorative justice dalam menangani perkara Anak. Keberhasilan proses diversi dipengaruhi oleh: itikad baik dari Anak dan Orang Tua/Walinya untuk meminta maaf kepada Korban; kerelaan Korban untuk memaafkan dengan atau tanpa persyaratan; dukungan positif dari pihak-pihak yang terlibat dalam proses diversi, pemenuhan persyaratan oleh Anak dan/atau Orang Tua/Walinya, serta aparat penegak hukum yang menjiwai dan mendukung keberhasilan proses diversi. Keberhasilan diversi ditentukan oleh kehendak subjektif yang positif, dan pemenuhan persyaratan. Apabila diversi tidak dilaksanakan atau tidak tercapai kesepakatan, Anak dapat dijatuhi pidana atau tindakan. Tindakan yang dijatuhkan terhadap Anak berupa pengembalian kepada orang tua/wali, penyerahan kepada seseorang, perawatan di rumah sakit jiwa, perawatan di LPKS, kewajiban mengikuti Pendidikan formal dan/atau pelatihan yang diadakan oleh pemerintah atau badan swasta, pencabutan surat izin mengemudi; dan/atau perbaikan akibat tindak pidana. Pidana yang dapat dijatuhkan kepada Anak adalah Pidana Pokok dan Pidana Tambahan. Pidana pokok terdiri atas: Pidana peringatan, Pidana dengan syarat (terdiri atas syarat pembinaan di luar lembaga, pelayanan masyarakat, atau pengawasan), pelatihan kerja, pembinaan dalam lembaga, dan penjara. Sedangkan Pidana Tambahan yang dapat dijatuhkan kepada Anak terdiri atas: Perampasan keuntungan yang diperoleh dari tindak pidana; atau Pemenuhan kewajiban adat.

Abstract

The development of criminal law is now beginning to recognize corporations as entities subject to criminal law, so that corporations suspected of committing criminal acts can also be held criminally responsible. This study aims to analyze the concept of criminal liability for corporations that commit corruption in the field of procurement of goods and construction services. The method used in this paper uses normative juridical law research by conducting a study of literature materials in the field of law related to the research topic. This research uses a statute approach and a case study. The results showed that in looking at criminal liability for corporations suspected of committing criminal acts, they must first see and know a mistake from the corporation. The imposition of penalties and determination of the amount of substitute money to be paid to corporations proven to have committed corruption should require new arrangements because existing legal regulations currently have limitations in certain cases prohibited from containing more arrangements than the provisions contained by law.

Abstract

Dugaan pelanggaran Kode Etik dan Perilaku Hakim Konstitusi menjadi perhatian masyarakat, ketika terjadi perubahan frasa dalam pertimbangan hukum pada Putusan Mahkamah Konstitusi No. 103/PUU-XX/2022 mengenai tindakan penggantian Hakim Konstitusi oleh Dewan Perwakilan Rakyat. Tindakan merubah frasa dari semula "dengan demikian" menjadi "ke depan" tersebut telah diperiksa oleh Majelis Kehormatan Mahkamah Konstitusi (MKMK). Penelitian ini bertujuan untuk menganalisis putusan Majelis Kehormatan Mahkamah Konstitusi (MKMK) No. 01/MKMK/T/02/2023 terkait dugaan pelanggaran Kode Etik dan Perilaku Hakim Konstitusi. Penelitian menggunakan metode yuridis normatif dengan pendekatan kasus dan perundang-undangan. Hasil penelitian adalah Mahkamah Konstitusi secara kelembagaan memiliki komitmen untuk menjaga kehormatan lembaga dengan menindaklanjuti dugaan pelanggaran kode etik, melalui pembentukan MKMK. Berdasarkan pemeriksaan yang telah dilaksanakan oleh MKMK, perbuatan merubah frasa dalam pertimbangan putusan merupakan pelanggaran Kode Etik, yaitu melanggar Sapta Karsa Hutama dalam hal “penerapan prinsip integritas”. Berkaitan dengan asas kepastian hukum, putusan yang berlaku dan memiliki kekuatan hukum adalah putusan yang diucapkan dalam sidang pleno terbuka untuk umum yang mendapat persetujuan bersama dari hakim konstitusi atau mayoritas hakim konstitusi dalam hal terdapat perbedaan pendapat. Implikasi dari penelitian ini adalah memahami komitmen kelembagaan Mahkamah Konstitusi dalam menyikapi pelanggaran kode etik, yang dapat mengurangi potensi pelanggaran kode etik hakim konstitusi di masa yang akan datang, serta dapat menjaga kepercayaan publik terhadap Mahkamah Konstitusi.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) have been recognized as crucial components and dynamic driving forces for various economies. The Indonesian government has paid serious attention to the MSME sector. One of the strategies for developing MSMEs to upgrade is through increased access to financing. However, the serious attention from the Indonesian government has not been maximized by MSMEs because it is not balanced with the ability related to financial management and taxation. Creative Space is an MSME Community, most of whose members are start-up companies that still lack knowledge of finance and taxation. The purpose of this community service is to provide financial education and tax obligations for Creative Space members. The method used is by providing guidance in preparing financial statements and tax reports. The results of the implementation of this financial and tax education are that all members of Creative Space can prepare financial statements and report the tax obligations that must be fulfilled by MSMEs.

Abstract

A considerable number of correctional facilities and detention centres in Indonesia are currently grappling with overcrowding issues, primarily driven by inmates involved in narcotics-related cases. This research aims to investigate the inconsistencies within narcotics regulations that lead to diverse interpretations of the law by law enforcement officials. The pressing aim of this study is to reduce the population of narcotics offenders serving prison sentences, thus alleviating the problem of overcrowding. This research adopts a qualitative methodology focusing on legislative and conceptual analysis. The research findings underscore the necessity for a revision of narcotics legislation. More specifically, this involves categorizing narcotics offenders based on their intent, making a clear distinction between "narcotics users," encompassing individuals who use drugs, suffer from addiction, or have become victims of narcotics abuse, and "narcotics profiteers," which includes those engaged in selling, facilitating transactions, manufacturing, or inducing others into narcotics abuse and victimization. In summary, this research highlights that consistency is needed in the regulation of narcotics articles by creating clear categories of behavior that are included in narcotics crimes to eliminate the various interpretations of the law, ultimately ensuring a fair and legally certain criminal justice system.

Abstract

This study aims to analyze the forms of criminal liability of illegal online loan providers and to formulate a legal protection model for victims within the framework of national criminal law. The method used is normative juridical with a legislative and conceptual approach, through an examination of various related regulations, court decisions, and criminal law and consumer protection doctrines. The novelty of this research lies in its comprehensive mapping of the criminal liability regime for illegal online lending across laws-including the Criminal Code, the Electronic Information and Transactions Law, the Personal Data Protection Law, the Consumer Protection Law, the Trade Law, OJK regulations, and the Money Laundering Law-as well as its affirmation of the function of criminal punishment as a preventive legal protection instrument for potential victims. The results of the study show that illegal online lending practices fulfill the elements of various criminal acts, including fraud, extortion, defamation, threats, dissemination of false information, misuse of personal data, misleading promotion, unlicensed business activities, and money laundering, so that the perpetrators can be held cumulatively criminally liable. In addition, criminal law enforcement against perpetrators serves as a form of preventive and repressive protection for the community. The conclusion of this study confirms that strengthening integrated criminal law enforcement that is victim-oriented and supported by public legal and financial literacy is a key prerequisite for suppressing illegal online lending practices and protecting the public from the trap of technology-based financial crime.

Abstract

This research examines the regulation of restorative justice under National Police Regulation (Perpol) No. 8 of 2021 on Handling Criminal Acts Based on Restorative Justice, and its implementation in a sexual violence case in Karawang. This research is motivated by the disharmony between Perpol No. 8 of 2021, Law No. 12 of 2022 on Sexual Violence Crime, and Law No. 20 of 2025 on the New Code of Criminal Procedure, which creates a legal loophole allowing sexual violence cases to be resolved through a deviant application of restorative justice. This research employs a normative-empirical legal method with a descriptive character using case, statutory, and sociological approaches. Primary legal materials were obtained through interviews with the victim's legal counsel, while secondary legal materials were gathered through literature study. The analysis was conducted using Aristotle's theory of justice and Lawrence M. Friedman's theory of legal certainty. The findings show that Perpol No. 8 of 2021 does not include sexual violence among criminal offenses excluded from restorative justice, contradicting Article 23 of the Sexual Violence Crime Law and Article 82 point (d) of the new Criminal Procedure Code. The application in Karawang was carried out through forced unregistered marriage without investigation, official case registration, or special case review, violating Perpol, the Sexual Violence Crime Law, and the new Criminal Procedure Code simultaneously. From Aristotle's theory of justice, this failed to achieve distributive or corrective justice. From Friedman's theory of legal certainty, uncertainty stems from weaknesses in legal substance, legal structure, and legal culture.

Abstract

Tumpukan limbah kulit jeruk Bali (Citrus maxima) di Desa Klampisan dapat mencemari lingkungan, namun limbah ini memiliki potensi untuk diolah menjadi produk bernilai tambah. Kegiatan Kuliah Kerja Nyata (KKN) bertujuan mendorong pemanfaatan limbah tersebut sebagai inovasi Usaha Mikro, Kecil, dan Menengah (UMKM) untuk pemberdayaan ekonomi. Metode yang digunakan adalah kualitatif deskriptif-eksplanatif melalui observasi dan demonstrasi partisipatif dari perwakilan ibu-ibu warga Klampisan pada 22 Januari 2026 di Balai Desa Klampisan. Keberhasilan program diukur melalui instrumen angket terhadap 30 responden untuk mengevaluasi aspek pengetahuan, keterampilan, dan minat keberlanjutan usaha. Hasil menunjukkan bahwa limbah kulit jeruk Bali dapat diolah menjadi “manisan Kulit Jeruk Bali” yang kenyal dan bercita rasa manis-asam. Hasil tingginya antusias masyarakat, dengan 80% responden menyatakan kesediaan untuk melanjutkan usaha ini sebagai inovasi produk lokal yang dapat memperkuat ekonomi kreatif di Desa Klampisan.   The accumulation of pomelo (Citrus maxima) peel waste in Klampisan Village poses a potential environmental pollution risk; however, this waste has the potential to be processed into value-added products. This Community Service Program (Kuliah Kerja Nyata) aims to encourage the utilization of such waste as an innovation for Micro, Small, and Medium Enterprises (MSMEs) to foster economic empowerment. The method employed is a descriptive-explanatory qualitative approach through observation and participatory demonstrations involving representatives of the women of Klampisan Village on January 22, 2026, at the Klampisan Village Hall. The program's success was measured using a questionnaire distributed to 30 respondents to evaluate aspects of knowledge, skills, and interest in business sustainability. The results indicate that pomelo peel waste can be processed into "Candied Pomelo Peels" with a chewy texture and a sweet-and-sour flavor profile. The findings highlight high community enthusiasm, with 80% of respondents expressing a willingness to pursue this venture as a local product innovation that can strengthen the creative economy in Klampisan Village.
