This study aims to analyze the forms of legal protection available to housing consumers who have fulfilled their obligations under sale and purchase agreements, as well as the efforts to fulfill consumer rights when a housing developer is declared bankrupt. The research applies a normative-empirical legal method through statutory and case study approaches concerning the bankruptcy of PT Aero Multi Karya Makassar. Data were obtained through literature review, interviews with the curator and supervisory judge, and questionnaires distributed to affected consumers. The results indicate that legal protection is provided through mechanisms allowing the exclusion of housing objects from the bankruptcy estate for consumers who have fully paid, occupied the property, and are free from double claims. Consumer rights fulfillment is conducted through recognition as creditors or good-faith buyers, claim verification by the curator, and provision of legal options for consumers. However, implementation still faces obstacles, including asset ownership status, double claims, and limited consumer understanding of bankruptcy procedures. Therefore, improved transparency and legal awareness are necessary to ensure optimal protection and fulfillment of consumer rights.
