Abstract

This study aims to analyze legal certainty in the transfer of land rights accompanied by the issuance of certificates without rights. This study uses a qualitative method with an empirical normative approach. Data collection techniques through interviews and descriptive analysis. The results of the study indicate that the land rights owner was initially offered by another party to assist in the process of registering his land rights, but the certificate issued was not in the name of the land owner but rather a certificate issued in the name of another party and his children. The certificate was fragmented into several names. Based on the results of the analysis of the research data, the transfer of rights was proven to be invalid because it was not based on the consent of the legitimate rights owner, so that this act was an unlawful act that created legal uncertainty in land ownership.
