Abstract

The legal certainty of land certificates frequently conflicts with heirs' civil rights, particularly when inherited land is unilaterally transferred and faces judicial execution. This conflict emerged in a derden verzet (third-party opposition) case under Supreme Court Decision Number 1170 K/Pdt/2019, where a certificate registered to one heir facilitated a transfer of property rights without the consent of other legitimate heirs. This research focuses on analyzing the legal standing and evidentiary strength of heirs to halt the execution of certified land. Employing a normative legal research method with statutory, case and conceptual approaches, secondary data were qualitatively analyzed to evaluate evidentiary and land registration norms. The findings indicate that heirs' legal standing in derden verzet requires proving concrete property rights, not just based on kinship status. A formal land certificate does not automatically extinguish these rights if evidence reveals discrepancies between formal registration data and valid substantive inheritance distributions. This study recommends strengthening judicial guidelines regarding the evaluation of heirs' material evidence in property executions and demands stricter due diligence by Land Deed Officials regarding inherited land histories.
