Abstract

This study aims to analyze the legal protection provided to consumers against businesses that use hazardous materials in food products. The research method used is normative legal research. The results indicate that consumer legal protection is not optimal, considering that some businesses still list food ingredients that do not meet standards, thus harming consumers. Consumers have received protection through various regulations prohibiting the use of hazardous materials in food products and providing administrative, civil, and criminal sanctions for violators. However, even though the product is delicious, it does not guarantee safety for consumer health. Furthermore, suboptimal law enforcement also hinders the deterrent effect on violators. Therefore, increased supervision by relevant agencies, firm and consistent law enforcement, and increased public awareness and education regarding the dangers of hazardous materials in food are needed. Thus, legal protection for consumers can be effectively realized to guarantee consumers' rights to safety and security in consuming food products.

Abstract

The circulation of cigarettes that do not meet product standards remains a persistent issue in commercial activities in Palu City. One product that has attracted particular attention is Smith-brand cigarettes, which are suspected of failing to comply with legal requirements, particularly regarding excise stamps, product information, and health warnings on packaging. This study aims to analyze the legal responsibility of business actors for the distribution of Smith-brand cigarettes that do not meet product standards. The research employs an empirical legal method using statutory, conceptual, and case approaches. Data were obtained through field research conducted at the Customs and Excise Supervision and Service Office (KPPBC) Pantoloan, Palu City, and supported by library research. The findings indicate that business actors bear legal responsibility for ensuring that the products they distribute comply with applicable legal standards. The circulation of Smith-brand cigarettes without excise stamps and without adequate product information and health warnings constitutes a violation of consumer protection regulations and excise laws. Business actors may therefore be held liable through legal compliance measures, compensation for losses, and product withdrawal from the market. The large number of Smith-brand cigarettes confiscated by Customs and Excise authorities demonstrates that the distribution of such products remains widespread within retail networks. Therefore, stronger supervision and law enforcement are required to protect consumers and ensure legal certainty in commercial activities.

Abstract

This study aims to analyze the legal protection of consumers in online sale and purchase transactions involving the distribution of illegal slimming products, specifically DHA Beauty Slim Capsule, as well as to analyze the liability of business actors and government supervision in ensuring consumer safety in electronic transactions. This study employs normative legal research using a statutory approach and a conceptual approach. The legal materials consist of laws and regulations concerning consumer protection, electronic transactions, personal data protection, health, and electronic commerce. The legal materials were analyzed qualitatively and presented using a descriptive-prescriptive approach. The results show that consumers engaged in online sale and purchase transactions are legally protected through their rights to comfort, security, safety, and accurate, clear, and honest information concerning products. The distribution of DHA Beauty Slim Capsule without a valid distribution permit and containing sibutramine poses risks to consumer health and safety and potentially violates consumer protection provisions. Business actors are responsible for ensuring the legality, quality, safety, and accuracy of product information and for providing compensation when consumers suffer losses in accordance with applicable laws and regulations. The government, particularly through supervision of product distribution and electronic commerce, plays an important role in preventing the circulation of illegal products. In conclusion, consumer protection in online transactions requires consistent implementation of regulations, strengthened government and marketplace supervision, business actor accountability, and increased legal awareness and literacy among consumers to establish safe and responsible electronic commerce.
