Abstract

Indonesian Migrant Workers (TKI) is one of the country's largest foreign exchange. Along with the number of TKI who work abroad, the increasing treatment that is not in accordance with what is expected by the workers. The treatment of employers or employers is often contrary to applicable law. The provisions in Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers Abroad regulates how the protection of Indonesian Migrant Workers working abroad, labor law or employment (Labor Law) is part of the law regarding the regulation of labor relations, both individual and collective. Research is a basic tool in the development of science and technology. This is because research aims to reveal the truth in a systematic, methodological, and consistent manner. The data and information that the author uses in writing this thesis are obtained or obtained through normative research.Research is a basic tool in the development of science and technology. The 1945 Constitution of the Republic of Indonesia Article 27 paragraph (2) states that every Indonesian citizen has the right to work and a decent living for humanity. In fact, limited job opportunities in the country have caused many Indonesian citizens to seek work abroad. Juridically the laws and regulations in the field of placement and protection of Indonesian Migrant Workers (TKI) are not synchronized vertically or horizontally. While sociologically the level of legal awareness of prospective Indonesian Migrant Workers (TKI), lack of supervision from labor inspectors, weak law enforcement. Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis implementasi kepastian hukum dan perlindungan anak dalam penerapan dispensasi kawin. Untuk mengetahui dan menganalisis analisis yuridis penetapan dispensasi kawin di Pengadilan Agama Batam dalam perspektif kepastian hukum dan perlindungan anak. Penelitian ini menggunakan metode yuridis normatif melalui studi kepustakaan dan menggunakan pendekatan yuridis empiris melalui studi lapangan. Hasil penelitian menunjukkan bahwa Suatu perkawinan adalah sah apabila dilakukan menurut hukum masing-masing agama dan kepercayaan dan tiap-tiap perkawinan dicatat menurut peraturan perundang-undangan berlaku (Pasal 2 ayat (2)), adapun syarat-yang harus dipenuhi untuk melangsungkan perkawinan adalah adanya persetujuan kedua mempelai, izin dari kedua orangtua/wali bagi calon mempelai yang belum berusia 21 tahun, usia calon mempelai sudah mencapai 19 tahun, antara calon mempelai pria dan calon mempelai wanita tidak dalam hubungan darah/keluarga yang tidak boleh kawin, tidak berada pada ikatan perkawinan dengan pihak lain, bagi suami istri yang telah bercerai, lalu kawin lagi satu sama lain dan bercerai lagi untuk kedua kalinya agama dan kepercayaan mereka tidak melarang mereka kawin untuk ketiga kalinya, dan tidak berada dalam waktu tunggu bagi calon mempelai wanita yang janda. Pada Undang-Undang Nomor 16 Tahun 2019 ditentukan batasan minimal seseorang boleh mulai melangsungkan perkawinan sebagaimana Pasal 7 ayat (1), bahwa Perkawinan hanya diizinkan apabila pria dan wanita sudah mencapai umur 19 (sembilan belas) tahun. Namun Dalam hal terjadi penyimpangan terhadap ketentuan umur tersebut, orang tua pihak pria dan/atau orang tua pihak wanita dapat meminta dispensasi kepada Pengadilan dengan alasan sangat mendesak disertai bukti-bukti pendukung yang cukup. Bahwa proses pengajuan dan mengadili permohonan dispensasi kawin berdasarkan Peraturan Mahkamah Agung Nomor 5 Tahun 2019 tentang Pedoman Mengadili Permohonan Dispensasi Kawin. Permohonan dispensasi kawin dengan disertai alasan-alasan tertentu, permohonan dispensasinya dikabulkan pengadilan dengan alasan melihat dari sisi kebaikannya, dimana dalam memberikan pertimbangan, seorang Hakim selain mengacu pada ketentuan sebagaimana tercantum dalam Undang-Undang Perkawinan dan ketentuan perundangan yang lain, juga didasarkan pada itikad dan alasan-alasan yang telah diberikan oleh pihak pemohon. Penetapan pemberian dispenasi kawin harus mempertimbangkan kepentingan terbaik bagi anak. Untuk itu disarankan kepada orang tua agar bersikah tegas kepada anak terutama anak perempuannya, batasi pergaulan anak dan jangan terlalu menuruti keinginan anak. Kepada Masyarakat hendaknya masyarakat agar lebih sadar dan mengertikan adanya hukum yang berlaku di Indonesia, kepada Pengadilan Agama atau Majelis hakim, agar betul-betul memperhatikan aspek-aspek yang berkenaan dengn hukum materil dan formil dalam mengeluarkan penetapan dispensasi kawin.

Abstract

Based on Law of the Republic of Indonesia Number 6 of 2023 concerning the Stipulation of Government Regulations instead of Law Number 2 of 2022 concerning Job Creation into Law, in Chapter IV Employment Part Two Article 56 which states as follows: paragraph (1) Work agreements are made for a certain time or for an indefinite time. The problem in this research is how the legal arrangements regarding fixed-term work agreements are to realize legal protection efforts for workers (Research study at PT. This research aims to find out the legal regulations regarding fixed-term work agreements, to realize legal protection efforts for workers (Research study at PT. Delta Bridge Foods in Batam City), to find out the implementation of the law regarding Specific Time Work Agreements (PKWT) to Realize Legal Protection Efforts (Research Study at PT. Delta Bridge Foods in Batam City), to find out what factors are obstacles /obstacles and solutions in certain time work agreements to realize legal protection efforts for workers (research study at PT. Delta Bridge Foods in Batam City). Research at PT. Delta Bridge Foods in Batam City) is regulated and established but in its implementation, there are still obstacles in the field.

Abstract

The purpose of this study is to determine the regulation of obligations, the implementation of doctors, as well as to find out the constraints and solutions to the implementation of doctors' obligations to informed consent in medical practice to realize legal protection for patients. This research is normative juridical and supported by sociological / empirical research This research is normative and empirical juridical. Normative juridical research refers to laws and regulations, while empirical research is obtained in the field. The results of the study that the regulation regarding the approval of medical actions originated from the relationship between doctors and patients. The implementation of doctors' obligations to informed consent at Dentic Clinic is known that the provision of information in the form of informed consent began to be pursued earlier, but these efforts have not been carried out optimally. This is influenced by the large number of patients so that it is felt that it is necessary to take action quickly and it is considered that the patient has understood what is conveyed by the doctor, the information submitted by the health worker is not understood by the patient, the provision of information to ask for a signature on the consent sheet is sometimes done by the nurse even though it is the authority of the doctor, the patient is often not given the opportunity to re-read the form given, so that patients feel that they have never been given information before medical treatment, as well as inadequate Human Resources.

Abstract

Abstrak: Legal Protection of Outsourcing Labor in Indonesia Employment Act Number 13/2003 and Islamic Law. This article compares the concept of outsourcing labor protection of or as stipulated in Employment Act Number 13/2003 to the Islamic law. The goal is to find similarities and differences in both legal systems which can be used as a source in refining the existing legal rules. The analysis used here is descriptive qualitative comparative, describing the issue of labor protection both in the positive law and Islamic law. In Islam, the outsourcing mode of employment is similar to syirkah ‘abdan and ijârah. On account that the outsourcing it self contains two agreements/contracts, first, the contract between the provider of employment and the using company and second between the company providing employment with the workers. The Islamic law shows positive attitudes towards the outsourcing employment relations to the extend that both parties fulfill all the rights and obligations among themselves.Abstrak: Perlindungan Hukum Tenaga Kerja Outsourcing Menurut Undang-Undang RI Nomor 13 Tahun 2003 dan Hukum Islam. Artikel ini membandingkan konsep perlindungan tenaga kerja outsourcing atau alih daya sebagaimana diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Hukum Islam. Tujuannya adalah untuk menemukan persamaan dan perbedaan perlakuan dari kedua sistem hukum yang dapat dijadikan sebagai bahan dalam menyempurnakan aturan hukum yang telah ada. Analisis yang digunakan adalah deskriptif kualitatif komparatif, yang menguraikan secara jelas dan ringkas terhadap perlindungan tenaga kerja outsourcing atau alih daya dalam hukum ketenagakerjaan dan hukum Islam. Outsourcing diqiyaskan ke dalam dua konsep dalam Islam, yaitu syirkah ‘abdan dan ijârah. Karena dalam outsourcing sendiri memang terdapat dua perjanjian/akad, yaitu antara perusahaan penyedia pekerjaan dengan perusahaan penyedia/penyalur jasa tenaga kerja dan antara perusahaan penyedia jasa tenaga kerja dengan karyawan/pekerjanya sendiri. Abstract

Implementing the Autogate system at the Batam Centre Immigration Checkpoint (TPI) is part of the modernisation of the immigration service system that aims to improve efficiency and security in monitoring the entry and exit of people in border areas. However, the effectiveness and reliability of this system still leave legal and technical issues, such as biometric data verification gaps, the absence of specific technical regulations, and limited human resources and infrastructure. This study aims to analyse the legal arrangements and implementation of the Autogate system in supporting the immigration inspection process, evaluate its security in preventing immigration law violations, and examine the obstacles and implications for law enforcement and protection of state sovereignty in border areas, especially in Batam City. The methods used are normative juridical and empirical juridical approaches, with data collection techniques through literature studies and direct interviews with immigration officers at TPI Batam Centre. The analysis was conducted using the framework of justice theory (John Rawls), legal system theory (Lawrence M. Friedman), and legal certainty theory (Sudikno Mertokusumo). The result shows that normatively, the Autogate system has a legal basis in Law No. 6 of 2011 and Minister of Law and Human Rights Regulation No. 9 of 2024. However, there is still a lack of technical operational regulation. Empirically, the system has been proven to improve inspection efficiency, but faces security challenges such as the risk of identity forgery and technical glitches. The research recommends regulatory harmonization, technology strengthening, and officer capacity building so that Autogate truly becomes an effective and legitimate instrument in supporting immigration law enforcement and maintaining state sovereignty.

Abstract

The Golden Visa policy is one of the strategic instruments within Indonesia’s immigration system, aimed at attracting foreign investors by granting long-term residency rights based on a particular investment value. Its implementation is regulated by Law No. 6 of 2011 on Immigration, Government Regulation No. 40 of 2023, Ministry of Law and Human Rights Regulation No. 22 of 2023, and Ministry of Immigration Regulation No. 3 of 2025. This research is motivated by the importance of examining the effectiveness of the policy in increasing compliance with immigration regulations, especially in Batam City, a strategic border area with high foreign investor mobility. This research aims to analyze the Golden Visa policy's legal regulations, assess the effectiveness of its implementation in improving compliance with immigration regulations from a legal and administrative perspective, identify obstacles, and formulate relevant solutions. The methods used are normative and empirical juridical approaches, supported by primary data from interviews and observations at the Batam Immigration Office and secondary data from legal literature and relevant regulations. The research results indicate that although the legal framework for the Golden Visa has been systematically established, there are still weaknesses in the synchronization of norms and the technical guidelines for its implementation. On the implementation side, this policy has contributed to improved administrative compliance by foreign investors; however, challenges remain in the form of structural obstacles, legal culture, and supervisory capacity. Therefore, regulatory improvements, enhanced legal literacy for visa holders, administrative service reforms, and synergy among relevant agencies are needed to ensure that the effectiveness of this policy operates optimally within the corridors of justice, certainty, and legal benefit.
