Abstract

The rapid development of international business can drive good economic growth for a country; on the other hand, the potential for business disputes is also increasing. One of the legal instruments used by subjects of international law is arbitration, whether established by international institutions or states. To conduct international arbitration, it should be under the framework or scheme of international arbitration. The purpose of this research is to compare Indonesian arbitration law with Malaysian arbitration law, which has been adjusted to the framework or scheme of international arbitration. The research results show that Malaysian arbitration law, as regulated in Arbitration Law Number 646 of 2005, is more in line with the international arbitration scheme except in the matter of annulment of international arbitration awards, while Indonesian arbitration law, as regulated in Law Number 30 of 1999, is not yet in line with the international arbitration scheme. Based on this reality, changes are needed to Law Number 30 of 1999, specifically the formation of a law that regulates arbitration and is in line with the framework or scheme of international arbitration.

Abstract

Sungai Cikapundung di Kota Bandung mengalami degradasi lingkungan serius akibat pencemaran limbah domestik dan industri, yang berdampak pada kesehatan masyarakat dan ekosistem air. Kondisi ini memicu lahirnya inisiatif konservasi berbasis komunitas, salah satunya Serlok Bantaran, yang memanfaatkan komunikasi digital sebagai strategi advokasi lingkungan. Penelitian ini bertujuan untuk menganalisis dinamika komunikasi digital dalam advokasi kesehatan lingkungan, dengan fokus pada tiga aspek utama: penyebaran informasi, partisipasi masyarakat, serta kolaborasi dan dukungan. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi kasus. Data dikumpulkan melalui wawancara mendalam, observasi lapangan, dan analisis konten media sosial komunitas Serlok Bantaran. Hasil penelitian menunjukkan bahwa media sosial seperti Instagram, Facebook, dan YouTube berperan signifikan dalam mengedukasi masyarakat, memobilisasi relawan, serta membangun jejaring kerja sama dengan berbagai pihak, termasuk akademisi, LSM, dan pemerintah. Komunikasi digital memungkinkan interaksi dua arah yang memperkuat keterlibatan publik dan memperluas jangkauan pesan kampanye. Kesimpulan dari penelitian ini menyatakan bahwa strategi komunikasi digital yang terencana, konsisten, dan berbasis lokal mampu meningkatkan efektivitas advokasi lingkungan serta memperkuat kolaborasi lintas sektor dalam pelestarian Sungai Cikapundung. Abstract

The decision of the board of directors in managing the company related to its core business is required to be able to manage the company with good integrity, full of caution, in order to obtain profits. Directors running the company's activities can prove that the decisions taken are not based on personal interests but for the benefit of the company. BUMN companies in carrying out their business are not only in the field of private law, but their business is also carried out in the field of public law.  The purpose of this research is to find out whether the new BUMN Law can create impunity loopholes, especially in cases of corruption that are neatly structured within BUMN. The results showed that BUMN companies not only run the core business, but are also given the mandate to carry out government functions to provide public services or as PSO implementers such as subsidized fertilizers to support food self-sufficiency programs.  As a PSO Executor, it is certainly oriented in handling direct state financial flows, for that there must be administrative separation and its implementation must be open. if studied administratively and referring to Law Number 28 of 1999, this policy cannot be ignored, even so the directors are included as State Officials. Why is this so, directors can be convicted in corruption cases if the elements of state losses are met, if proven negligent in making decisions that have an impact on state losses. In the new BUMN Law, directors are given the freedom to manage the company through the principle of Business Jugement Rule, this principle does not mean that the actions of directors become immune to the law or cannot be a shield for corrupt practices that harm the state.

Abstract

The development of the digital economy has fundamentally transformed global economic interactions, enabling foreign digital companies to generate profits from Indonesia without having a physical presence. This situation poses challenges in collecting Income Tax, particularly concerning base erosion and tax leakage. This study aims to analyze Indonesia's tax law reform in strengthening the digital nexus through the implementation of the Significant Economic Presence (SEP) concept and to identify normative and practical obstacles in its implementation. The research employs normative legal methods with statutory, conceptual, and comparative approaches. The results indicate that the SEP broadens the nexus criteria from physical presence to significant economic presence, thereby strengthening Indonesia’s taxing rights and preventing cross-border profit shifting. However, SEP implementation faces normative obstacles, including conflicts with Double Tax Avoidance Agreements (DTAAs), the absence of a global consensus, and limited technical parameters. Practical obstacles include restricted access to transaction data, difficulty in enforcing tax obligations on entities without legal presence in Indonesia, low compliance from digital companies, and limited international cooperation. The study recommends strengthening the legal framework and international harmonization, as well as enhancing digital tax administration capacity through technology and cross-border collaboration.
