Abstract

Salah satu penyebab terjadinya banjir adalah akibat meluapnya sungai baik itu karena banyaknya sampah, atau terjadinya pendangkalan sungai. Jakarta merupakan salah satu kota di Jawa yang mempunyai masalah terjadinya banjir pada musim hujan. Banjir yang terjadi di Jakarta antara lain akibat meluapnya Sungai Ciliwung yang mengalir dari Bogor. Perlindungan daerah aliran Sungai atau DAS, dilakukan antara lain dengan melarang pendirian bangunan di sepanjang Sungai agar tidak terjadi longsor atau abrasi serta mengatur kegiatan di sekitar Sungai. Selain itu  larangan pembuangan sampah ke sungai merupakan beberapa cara yang dapat dilakukan untuk melindungi sungai agar tidak terjadi pendangkalan dan mengakibatkan air yang meluap. Terkait dengan hal tersebut, maka dilakukan penelitian dengan masalah bagaimana pengaturan perlindungan sungai khususnya di Bogor untuk melindungi Sungai Ciliwung agar tidak terjadi banjir. Metode penelitian dilakukan secara normatif yaitu mengkaji berbagai aturan tentang perlindungan lingkungan Sungai baik aturan tingkat nasional, maupun tingkat daerah Kotamadya Bogor. Dari kajian terhadap aturan yang ada, disimpulkan bahwa aturan tersebut antara lain UU No. 38 tahun 2011 tentang Sungai, UU No. 17 tahun 2019 tentang Sumber Daya Air dan PP No. 81 tahun 2012 tentang Pengelolaan Sampah Rumah Tangga Dan Sampah Sejenis Sampah Rumah Tangga sudah dapat melindungi Sungai, dan dapat dilaksanakan agar tidak terjadi luapan Sungai yang mengakibatkan banjir.

Abstract

Les Misérables adalah karya Victor Hugo yang mengandung nilai-nilai filosofis untuk menjadi bahan refleksi filsafat hukum. Kisah ini menceritakan Jean Valjean, seorang mantan narapidana yang hidup di Perancis pada abad ke-19. Kisah ini diceritakan dalam periode waktu mulai dari pembebasan Valjean dari penjara dan reformasinya sebagai seorang industrialis. Selama periode waktu tersebut, Jean Valjean terus-menerus dikejar oleh inspektur Javert. Tulisan ini menitikberatkan pada adaptasi film Les Misérables tahun 1978 dan 1998 dimana nilai-nilai filosofis keadilan hukum alam dan positivisme hukum tercermin dari karakter Jean Valjean dan Javert. Metode yang digunakan dalam penelitian ini adalah penelitian normatif yang berasal dari studi kepustakaan (library research) dimana hasil dari penelitian kepustakaan tersebut digunakan sebagai bahan analisis filsafat hukum. Karya ini memberikan suatu refleksi bahwa dalam penegakan hukum, positivisme hukum yang menitikberatkan pada kepastian hukum idealnya tidak terlepas dari keadilan dan moralitas.

Abstract

Abstract  This article analyses issues related to the implementation of fee liberalization by the ASEAN Economic Community (AEC) and its effect to the legal service business sector. Indonesian lawyers, as a consequence, will then have to compete with foreign legal service providers. It is assumed that through fair and transparent competition a more accountable business atmosphere can be created. However, a number of legal regulations at the national level establishes non-trade barriers, effectively obstructing the AEC’ market liberalization project. The authors standing here is that the policy of protecting domestic lawyers or advocates should be rescinded and to that purpose Indonesia should amend the prevailing Law on Advocate.

Abstract

One of the biggest economic supports of a country is from credit activities, including corporate credit which is a business relationship to obtain business capital for business. Corporate credit agreements are made with a standard agreement originating from the agreement maker's good faith. In connection with this, the Financial Services Authority has made regulations to provide supervision or known as market conduct. However, when referring to POJK 22/2023, it is found that this regulation is still not specifically regulated, especially for standard corporate credit agreements. This research used conceptual approach. This research found that POJK No. 22/2023 has upheld the principles of transparency, fair treatment, and good faith, ensuring consumer protection and responsible business practices. The regulation focuses on clear communication, standardized agreements, and fair dispute resolution to create a fairer environment, but still needs to be refined. By learning from international best practices and refining the regulations, Indonesia can increase trust, protect consumers, and foster a more sustainable financial system through stakeholder collaboration and better oversight.

Abstract

The issue of the "Land Mafia" in Indonesia reflects legal uncertainty and structural inequality in land ownership. The establishment of the Land Bank Agency through Law Number 6 of 2023 concerning the Stipulation of Government Regulation, instead of Law Number 2 of 2022 concerning Job Creation and Government Regulation Number 64 of 2021, is a government effort to address this issue. However, the existence of this agency has sparked public concerns about the potential for abuse of authority and the return of discriminatory legalistic practices, similar to the principle ofdomain declaration, as revealed in the case of farmers in Konawe, Southeast Sulawesi.1The main problem faced is the absence of a holistic, transparent, and accountable regulatory model that can guarantee that the Land Bank truly functions for the greatest prosperity of the people, not for the interests of certain groups. This study aims to analyze, compare, and formulate a more effective manual regulation of the Land Bank. The research method used is normative juridical with a comparative approach to the Land Bank models in the Netherlands and France. The comparison shows fundamental differences: Indonesia applies a centralized model, while the Netherlands uses a decentralized model integrated with spatial planning, and France operates a semi-private hybrid model (SAFER) that has preferential rights and is supervised by a multi-stakeholder committee.1These findings highlight the advantages of the Dutch model, namely its adaptation to local contexts and efficiency in land consolidation, and the French model, which offers operational efficiency and robust oversight mechanisms. Based on these findings, this report proposes a "Hybrid-Decentralized Land Bank Regulatory Model." This model combines Dutch-style decentralization principles with a French-style multi-stakeholder oversight structure, grounded in fundamental theories of good governance. The success of Land Banks in Indonesia ultimately depends on institutional reforms that ensure transparency, accountability, and public participation, going beyond the mere formulation of formal regulations.
