Abstract

Bogor City has established regulations on LGBT by issuing Regulation Number 10 of 2021. It is necessary to conduct research on the regulation in order to avoid human rights violations. This research focuses on examining the local regulation of Bogor City on LGBT people from a human rights perspective. This research uses normative legal research. The purpose of this study is to determine the conflict of norms that occur between the Bogor City bylaw and the Human Rights Law, identify human rights violations against LGBT people and determine the efforts of judicial review of the bylaw. Regulation No. 10 of 2021 contradicts the basic rights of citizens stipulated in the Human Rights Law and the rights violated in the regulation include the right to human dignity, the judicial review can be done in two ways. Therefore, it is hoped that there is a need for rule reform so that in the basis of formation there are no conflicts of norms that have implications for violations of human rights.

Abstract

One of the biggest challenges to a democratic state under the rule of law today is rising populist movements that endanger the independence of the judiciary. In Indonesia, the religious populist movement led by hardliner Islamic groups continues to try to enter courtrooms to advocate for religious interpretations of court decisions, such as when the Indonesian Constitutional Court reviews the 1965 anti-blasphemy law. This socio-legal research examines empirical data from key resource interviews and secondary data from related Constitutional Court judgements, pertinent legislation, and public policies to determine the socio-political backdrop of the Court decision. This technique enables the author to evaluate religious populism and how it affects Constitutional Court rulings. Political pressure may weaken the court, according to this research, encourage the religious populism of the former of Islamic Defenders Front to impose its will by stating that the repeal of the Anti-Blasphemy Law shows strong indications of corruption within the Court. Religious populism in the justice system raises concerns about political or religious decision-making, thereby undermining the rule of law. This research shows that the pattern or tendency of religious populism shows the Court’s compromise of the legal system towards democratic government in Indonesia, eroding the independence of the judiciary, endangering the right to religious freedom, and weakening public confidence in the justice system and democracy.

Abstract

The issue of nickel mining has long been intertwined with legal norms and environmental ethics. The dispute involving PT. Gag Nickel on Gag Island underscores critical legal challenges. PT. Gag initially operated under a 1998 Contract of Work authorized by Soeharto, allowing nickel mining on Gag Island in Raja Ampat Regency. However, Law 41/1999 prohibited mining in protected forests, halting PT. Gag's operations. This was reversed in 2004 when Presidential Regulation 41/2004 granted exemptions to 13 companies, including PT. Gag, for operations predating the law. In 2007, Law 27/2007 further restricted mining on islands smaller than 200,000 hectares, including Gag Island, which spans only 6,069 hectares. Despite this, PT. Gag obtained IPPKH and IUP permits in 2017 from the Ministries of Environment and Energy and Mineral Resources, allowing the resumption of mining activities in violation of both Laws 41/1999 and 27/2007. The controversy escalated in 2024 when the Constitutional Court reaffirmed the prohibition of mining on small islands under Law 27/2007. These regulatory conflicts undermine legal certainty. This study, guided by legal positivism, emphasizes the need to revise conflicting regulations and ensure alignment between local and higher laws. The research adopts a normative juridical methods, statute approach, case approach, and conceptual approach.

Abstract

Penelitian ini menganalisis dinamika forum shopping dalam penyelesaian sengketa izin lingkungan melalui pendekatan socio-legal berdasarkan pemikiran Adriaan W. Bedner. Fokus utama kajian ini adalah menelaah kesenjangan antara norma hukum tertulis dengan praktik pelaksanaannya dalam sistem peradilan tata usaha negara (PTUN) dan lembaga hukum lainnya. Dalam praktiknya, forum shopping menunjukkan kecenderungan para pihak untuk memilih jalur hukum yang paling menguntungkan, sehingga mengindikasikan lemahnya daya kerja hukum formal dalam menjamin keadilan substantif. Pendekatan socio-legal digunakan untuk mengungkap relasi kuasa, pluralisme hukum, dan keterbatasan kelembagaan yang menjadi hambatan dalam pelaksanaan hukum lingkungan di Indonesia. Studi ini menyimpulkan bahwa efektivitas hukum tidak cukup diukur dari keberadaan regulasi, tetapi harus mempertimbangkan realitas sosial, ekonomi, dan politik yang memengaruhi pelaksanaannya. Oleh karena itu, integrasi antara pendekatan normatif dan empiris menjadi penting dalam merancang reformasi hukum yang responsif dan berkeadilan.
