Abstract

Bullying merupakan masalah serius yang harus segera diselesaikan karena memberikan dampak negatif dan trauma berkepanjangan dalam kehidupan seseorang. Kasus bullying di sekolah banyak ditemukan di Indonesia maupun internasional, pengabdian ini dilakukan di MA Nurul Firdaus dengan menggunakan metode penyuluhan hukum terkait fenomena bullying dampak bullying, pengertian dan ruang lingkup traditional bullying dan cyberbullying, persamaan traditional bullying dan cyberbullying, dan tindakan prevensi dan intervensi terhadap bullying. Hasil program pengabdian ini memberikan pengetahuan kepada siswa di terkait bahaya dan dampak dari bullying.

Abstract

Corruption is an extraordinary crime that can damage the joints of the life of the nation and state. Corruption can cause various negative impacts, such as: reducing state revenues from the tax sector, reducing government spending in the education sector, resulting in low-quality infrastructure being built, slowing economic growth, causing government instability. The aims of this study is to find out about the injustice in the regulation of criminal guidelines for corruption crimes which makes the enforcement of corruption laws less strict in their punishment. The research method used normative juridical. The results of the study state that the Criminal Guidelines for Articles 2 and 3 of the Corruption Eradication Law in order to better cover other articles of corruption crimes and must change the criminal guidelines for very large losses must consider implementing maximum punishment in accordance with the criminal guidelines, the novelty produced for the criminal guidelines for corruption crimes must be regulated regarding the highest loss value must be adjusted to the heaviest punishment in accordance with the criminal guidelines in the Criminal Code.

Abstract

The phenomenon of criminalization of civil disputes involving state finances has created controversy in Indonesian legal practice. The unclear boundary between administrative-civil state losses and corruption has led to law enforcement practices that often exceed the principle of ultimum remedium. This paper aims to analyze the legal application of criminal charges in civil cases impacting state finances by examining the normative framework, court decisions, and the practice of calculating state losses by state auditors. This research uses a normative-doctrinal approach through analysis of laws, decisions of the Constitutional Court and the Supreme Court, and concrete case studies. The results of the study indicate that inconsistent definitions of "state losses" and the absence of standard calculation methods increase the risk of criminalization of acts that should be resolved administratively or civilly. This article recommends the need for standardization of audit methodology, strengthening the mechanism for claiming compensation for state losses in the administrative realm, and affirming the principle of ultimum remedium in prosecution policy.
