Abstract

Peralihan tanah yang belum bersertifikat rawan menimbulkan sengketa apabila PPAT tidak menerapkan prinsip kehati-hatian. Penelitian ini menganalisis, pertama, apakah Peraturan Jabatan PPAT telah menerapkan prinsip kehati-hatian? Kedua, bagaimana prinsip hehati-hatian PPAT dalam peralihan tanah yang belum bersertifikat. Metode penelitian yang digunakan adalah penelitian hukum normatif. Dari penelitian ini disimpulkan bahwa: pertama, Peraturan Jabatan PPAT telah menerapkan prinsip kehati-hatian. Kedua, prinsip kehati-hatian PPAT dalam peralihan tanah yang belum bersertifikat direfleksikan dalam kewajiban PPAT menolak membuat akta apabila tidak disertai data formil.

Abstract

Increased opportunities for trade in goods and services in the global sphere in the era of the ASEAN Economic Community (MEA) must be responded with the ability of the state to provide legal protection for the people of Indonesia who are involved in the MEA free market. The notary is expected to be able to provide services not only at the regional level but also nationally and even globally. This gave birth to the idea of optimizing the role of the Notary. This study uses normative legal research methods conducted to find solutions to existing legal problems. The research approach used is the statute approach and the conceptual approach. The results of this study analyze the political, philosophical and sociological foundations in the notion of expanding the area of notary public office and the concept of globalization of the implementation of notary office duties in the extraterritorial jurisdiction.

Abstract

Management Rights Title is the right to control over the land from the state authority delegated to the holder partial implementation. Land with Management Rights Title may be granted to another party one through Building Rights Title. The whole provisions governing Building Rights Title generally applies to Building Rights Title on the land Management Right Title. No Regulation Legislation that specifically regulates the building standing on the Management Rights raises the issue of how if Building Rights Title will serve as collateral and then how protection for creditors at the time of going to execute if the party becomes the debtor defaults.

Abstract

Witness Notary deed are the witnesses who participated in the making of the deed (instrument), Task instrumentarir witness is his signature, bear witness of the truth of the deed and the fulfillment of the formalities required by the Act. In the manufacture of authentic deed Notary often use employees to witness the deed given witness notary deed should have been known, especially to do with confidence. Generally occurs when there are people who have become former employees, or did not work in places where he used to work would have thought that any liability related to previous work has been completed because there is no relationship of interdependence in such work. This resulted confidentiality deed known by former employees who witnessed the deed leaked to unauthorized parties. Until now Notary Public Functional Position (Undang-Undang Jabatan Notaris) has not been set on the responsibility of the witness and former employee of the notary deed as witnesses deed

Abstract

The Law on Notary Position authorizes Notaries to provide legal advice to parties related to deeds. Through this legal counselling, it is hoped that conflicts can be avoided in the future. This study analyzes the benefits of legal counselling provided by a notary. The research method used is normative legal research using a statutory approach and a conceptual approach. The results show that the notary public has the authority to provide legal counselling to parties related to deed making, especially those related to agreements. The role of the notary, in this case, is to provide counselling so that the agreement made by the parties is balanced and the parties understand their respective rights and obligations.

Abstract

Asas pemisahan horizontal yang berlaku dalam Hukum Tanah di Indonesia melahirkan permasalahan khususnya yang berkaitan dengan Hukum Jaminan. Adanya pemisahan yang memungkinan tanah dan bangunan yang berdiri di atasnya dimiliki oleh subyek hukum yang berbeda. Kondisi tersebut dapat menyulitkan posisi kreditur untuk melakukan eksekusi apabila debitur sebagai pemilik tanah atau sebagai pemilik bangunan yang ada di atas tanah tersebut wanprestasi. Penulis dalam penelitian ini ingin menelaah dan menganalisa lebih lanjut tentang karakteristik kepemilikan bangunan yang terpisah dari kepemilikan tanah berdasarkan asas pemisahan horizontal dan bentuk perlindungan hukum bagi kreditur atas obyek jaminan berupa bangunan yang terpisah dari kepemilikan tanahnya. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan pendekatan masalah dilakukan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pemberlakuan asas pemisahan horizontal di dalam hukum pertanahan Indonesia memberikan pemisahan antara kepemilikan tanah dan bangunan yang melekat di atas tanah tersebut yang memiliki status hukum terpisah satu sama lainnya dan dibuktikan dengan sertifikat kepemilikan tanah atau sertifikat kepemilikan bangunan. Perlindungan hukum kepada kreditur atas obyek jaminan berupa bangunan yang kepemilikannya terpisah dengan tanah dapat diperoleh dari surat pernyataan yang dibuat oleh dari pemilik tanah bahwa yang bersangkutan tidak akan menjaminkan tanah dimaksud kepada kreditur lain selain penerima jaminan fidusia yang menerima jaminan berupa fidusia bangunan di atas tanah dimaksud.

Abstract

A handwritten signature on an authentic deed serves a fundamental legal function as an identifier and acknowledgment to legalize all rights and obligations outlined in the deed. According to the regulation concerning the Notary Public Functional Position (Undang-Undang Jabatan Notaris), an authentic deed must contain the signatures of all parties involved (the notary public, witnesses, and the first and second parties) as mentioned in the deed. However, this regulation can create issues when one of the parties is unable to provide a signature on the authentic deed. This research analyzes how notarial deeds are signed for people who cannot sign. This research is normative legal research using a statutory approach and a conceptual approach. The results of this study show that there are three procedures for using a Surrogate in authentic deeds First procedure: If the individual cannot read or write but has no physical disabilities (they have all their fingers and can make a signature), a fingerprint will be used as the Surrogate. This should be noted and attached to the last page of the authentic deed; Second procedure: If the individual can read and write but has issues with their fingers (due to an injury or the absence of fingers), the Surrogate can be used, but it must be accompanied by an official medical letter from a doctor or hospital. This should also be noted and attached to the last page of the authentic deed. Third procedure: If the individual has visual impairments (is blind), the Surrogate can be used, but it must be accompanied by an official medical letter from a doctor or hospital. This should be noted and attached to the last page of the authentic deed.

Abstract

In the 5.0 era, which is supported by the birth of new habits after the Covid-19 pandemic, which has accustomed people to activities using cyber technology. makes demands on Notaries to be able to adapt their services in making authentic deeds using cyber technology or what is known as e-Notary. Currently, e-Notary is difficult to implement because it is considered that there is no legal basis. This research analyzes the legal construction of the application of e-Notary based on the discretionary authority of the Notary and the application of e-Notary in context Ius Constitutum. This research is normative legal research using a statutory approach and a conceptual approach. The research results show that Notaries are part of public services. A notary is an official who carries out government functions to meet the needs of the public who need authentic deeds. Notaries are Government Officials so Notaries can use their Discretionary authority to carry out e-Notary. e-Notary can be implemented at this time by reinterpreting the provisions of Article 1868 of the Civil Code and the procedures for making authentic deeds as regulated in the Notary Position Law. The implementation of e-notary represents an adaption of the notary role in the digital age. The advantageous aspect of e-notary implementation is the convenience it offers the public in engaging with a notary for the creation of authentic deeds.
