Penelitian ini bertujuan untuk mengetahui Penerapan Keadilan Restoratif (Restorative Justice) Dalam Kasus Persetubuhan Terhadap Anak (Putusan Nomor : 31/Pid.Sus/2018/PN.Lbto dan Hambatan-Hambatan Penerapan Retorative Justice Dalam Perkara Nomor 31/Pid.Sus/2018/PN Lbto. Jenis penelitian yang digunakan dalam kajian ini adalah metode penelitian normatif empiris merupakan penggabungan antara pendekatan hukum normatif dengan adanya penambahan berbagai unsur empiris. Hasil penelitian menunjukan bahwa konsep keadilan restorative justice sudah seharusnya dapat diterapkan dalam putusan hakim Nomor : 31/Pid.Sus/2018/PN.Lbto karena terdakwa dalam hal ini mau untuk bertanggung jawab untuk menikahi korban dan korbanpun dalam hal ini tidak dirugikan. Kemudian dari sisi hambatan yang dialami yaitu hambatan dari segi social dan hambatan dari segi politik hokum pidana di Indonesia.

The purpose of the research is to know and analyze the criminal liability of the perpetrator in the case of illegal mining in the Marisa District Court of Pohuwato Regency has been in accordance with the objectives of the law (certainty, benefit, and justice) and to know and analyze the factors that influence the consideration of judges in examining, adjudicating, and deciding cases of illegal mining in the Marisa District Court of Pohuwato Regency. The type of research used in this legal writing is socio-juridical legal research. Criminal responsibility of the perpetrator in illegal mining cases is very important to maintain legal certainty, expediency, and justice. Courts need to ensure that perpetrators are given sanctions appropriate to the level of offense they commit and that the sanctions are effective in preventing similar acts in the future. In addition, fair and proportional treatment of perpetrators must also be ensured to maintain the integrity of the justice system and the judge's consideration in deciding Case No. 37/Pid.Sus/2023/PN Mar was in accordance with Article 184 of the Criminal Procedure Code, namely based on legal facts, witness testimony, testimony of the defendant and instructions in the form of evidence, so that the judge's consideration in his verdict had fulfilled the elements and conditions of the defendant's conviction.

Penelitian ini bertujuan untuk mengetahui Penerapan Prosedur Tetap Nomor 1 Tahun 2010 Tentang Penanggulangan Anarkis dan mengetahui Faktor yang menghabat Penerapan Prosedur Tetap Nomor 1 Tahun 2010 Tentang Penanggulangan Anarkis. Jenis penelitian yang digunakan adalan penelitian normatif empiris. Penelitian hukum normatif empiris adalah penelitian hukum mengenai pemberlakuan ketentuan hukum normatif (kodifikasi, undang-undang) secara in action pada setiap peristiwa hukum tertentu yang terjadi dalam masyarakat. Dari penelitian ini ditemukan bahwa Penerapan prosedur tetap nomor 1 tahun 2010 tentang penanggulangan anarkis di satuan brimob polda gorontalo setelah melalui tahapan penelitian ditemukan bahwa ternyata masih kurang efektif karena masih terdapat beberapa aspek yang menjadi penghambat dalam rangka menunjang tugas dan fungsi dari satuan brimob dan factor yang menghambat Penerapan Prosedur Tetap Nomor 1 Tahun 2010 Tentang Penanggulangan Anarkis Di Satuan Brimob Polda Gorontalo yaitu factor sumber daya manusia, factor sarana dan prasarana dan factor angggaran.

Penelitian ini merupakan respon terhadap kekosongan norma yang mengatur tugas dan kewenangan Kuasa Pengguna Anggaran (KPA) dalam Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum sehingga menyebabkan ketidakpastian hukum di kalangan KPA yang melaksanakan pembayaran ganti keruagian objek pengadaan tanah. Nihilnya jaminan kepastian hukum tersebut membuat aparat pemerintah enggan untuk menjadi KPA Program/ Kegiatan pengadaan tanah bagi pembangunan untuk kepentingan umum. Kondisi ini secara langsung menjadi faktor penyebab inefektifitas penyelenggaraan pemerintahan karena program dan kegiatan tidak dapat direalisasikan baik secara fisik maupun keuangan. Penelitian ini secara spesifik akan menganalisa kedudukan dan kewenangan KPA pada penyelenggaraan pengadaan tanah serta bagaimana beban pertanggung jawabannya sebagai pejabat pengelola keuangan.

This study aims to determine and analyze the process and mechanism for resolving State Financial Losses in the Perspective of Criminal Law and to determine and analyze the application and legal settlement of the findings of the Supreme Audit Agency of the Republic of Indonesia (BPK RI) on the occurrence of state financial losses in state financial management. This research uses library data (library research) to obtain theoretical or doctrinal conceptions, opinions or conceptual thoughts from previous research related to the objects examined in this study which can be in the form of laws and regulations, books, scientific works, papers and other works. The results of the research show that the existence of Article 4 of the PTPK Law as the basis for law enforcement of corruption that harms state finances is to emphasize that when state financial losses have switched or entered the realm of criminal law, the return of financial losses does not eliminate the criminal liability of the perpetrators of corruption that harms state finances and the Supreme Audit Agency Regulation Number 3 of 2007 concerning Procedures for Settling State Losses Against Treasurers starts from handling initial information, which starts with information on state / regional losses then proceeds with the formation of the State Loss Settlement Team (TPKN); then Examination by the Supreme Audit Agency; Settlement through Certificate of Absolute Responsibility (SKTJM); Settlement through Decision Letter of Deadline Determination (SKPBW); and Settlement through Encumbrance Decision Letter (SKP).

To Analyze the Regulation of Fish Theft and FAD Settlement According to the Provisions of Indonesian Legislation. To Analyze the Criminological Review of the Enforcement of Theft and Damage to FADs.In this study the author, using Empirical research methods. The data sources used in this research are primary and secondary data. The author uses direct observation and interview data collection techniques. In this research, the author analyzes the data using quantitative methods, namely analyzing the data and providing relevant explanations, the problem is discussed further research and analysis is carried out and makes it a conclusion. The problem in Gentuma Subdistrict is that some fishing boats have more FADs than the regulations stipulated in the Regulation of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia Number 18 of 2021 so that when there is a problem of fish theft, it cannot be processed because the procedure for releasing fishermen's FADs has violated the rules. Facts have shown that fisheries crime has become a very threatening act to Indonesia's natural resources because it has a detrimental impact on society and the state. This is a threat to the survival of the community and the state because it can damage the environmental ecosystem and also damage the existence of living things in the sea.

The purpose of the research is to find out the causes of differences in interpretation between the Gorontalo Regency KPU and Bawaslu Gorontalo Regency regarding administrative violations of the 2020 elections in Gorontalo Regency and how the process of resolving administrative violations of the 2020 elections in Gorontalo Regency by the Gorontalo Regency KPU and Bawaslu Gorontalo Regency. This research uses two legal research methods, namely: Normative and empirical legal research to find answers to the differences in interpretation between the KPU and Bawaslu Gorontalo Regency regarding administrative violations of the 2020 Pilkada in Gorontalo Regency. The difference in interpretation between the Regency KPU and Bawaslu Gorontalo Regency regarding administrative violations is caused by overlapping statutory provisions. Where in Law Number 10 Year 201 concerning Pilkada, the two institutions are given the authority to examine and decide administrative violations, then the two institutions in deciding administrative violations have their own guidelines where Bawaslu is guided by Perbawaslu while the KPU itself is guided by KPU Regulations. This certainly does not provide legal certainty for justice seekers in election administration violations and the process of resolving administrative violations in the 2020 Pilkada in Gorontalo Regency, namely through DKPP and Constitutional Court decisions. We do not have to face different decisions between the two institutions because DKPP is an ethical judicial institution while the Constitutional Court is a legal judicial institution. Although there has been a decision from the Constitutional Court, it does not change the DKPP's decision because until now there has been no ethics court to appeal the DKPP's decision.

With effective land dispute resolution, agricultural productivity and the welfare of village communities can increase. Non-disputed land can be optimally utilized for economic activities that benefit the community. The method of implementing this service activity is in several stages: coordination with the village community, literature study, and face-to-face socialization. The results of community service on paralegal training where the presence of deme dua village paralegals can help minimize the occurrence of land cases in the village, existing cases can be handled more effectively and efficiently. The presence of village paralegals is one of the alternatives to researching local village conflicts. It can also help in resolving disputes peacefully and effectively before the problem becomes bigger. The settlement of land disputes that have not been certified is regulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 21 of 2020 concerning the Handling and Settlement of Land Cases. Paralegals act as mediators, the duties of mediators are based on article 14 of Perma no. 1 of 2016 concerning mediation procedures.

This study examines the criminal law aspects of business activities required to have an Environmental Impact Analysis (EI) based on Law No. 32 of 2009 on Environmental Protection and Management and Government Regulation No. 27 of 2012 on Environmental Permits. EI is mandatory for activities with significant environmental impacts, aiming to identify environmental risks, accommodate public aspirations, and ensure proper impact management. Criminal sanctions are applied as a last resort (ultimum remedium) when administrative sanctions are ineffective. These sanctions aim to educate business actors, protect public interests, and prevent similar violations. The principle of legality is upheld, requiring actions to be based on existing laws and proven wrongdoing. However, the enforcement of environmental criminal law faces challenges, including a lack of understanding among law enforcers about the essence of environmental crimes. This study that strengthening regulations, enhancing law enforcers' capacity, and consistently applying criminal sanctions are necessary to support the successful enforcement of environmental law. These measures are crucial to preserving the environment and ensuring compliance with EI obligations by business actors.

The study evaluates the performance of the Gorontalo Regency Election Supervisory Agency (BAWASLU) in overseeing campaign activities during the 2020 simultaneous Regional Head Elections (PILKADA). It scrutinizes the responsibilities placed on BAWASLU and its personnel, aiming for proficient enforcement of election laws to ensure equitable and transparent elections. Employing an empirical juridical approach, the research examines the community's legal frameworks and practical realities. Results indicate that BAWASLU's supervision of campaign activities, spanning traditional and social media platforms, fell short of expectations. Factors contributing to this shortfall include regulatory challenges and deficiencies in infrastructure and resources. Recommendations entail strengthening BAWASLU's oversight in alignment with existing regulations, emphasizing clarity in governmental directives, and ensuring sufficient resources. Moreover, community engagement and awareness initiatives are suggested to bolster electoral integrity and public trust..
