Abstract

Perceraian dalam hukum yang digunakan untuk menjelaskan kondisi berakhirnya suatu hubungan antara laki-laki dan perempuan yang terikat dalam pernikahan. Perceraian dapat meliputi cerai gugat dan cerai talak. Cerai talak merupakan perceraian yang diajukan oleh pihak suami kemudian untuk cerai gugat merupakan perceraian yang diajukan oleh pihak istri. Setelah suami dan istri secara sah bercerai, aka nada masa iddah bagi pihak perempuan. Istri yang diceraikan oleh suaminya memiliki hak yang wajib dipenuhi oleh laki-laki, yaitu mut’ah dan nafkah iddah. Dengan menggunakan metode penelitian dengan pendekatan secara hukum normatif dan menggunakan sumber data sekunder, artikel ini akan membahas tentang bagaimana implikasi cerai talak pada para pihak yang bercerai serta bagaimana pertimbangan hakim terkait pembebanan Mut’ah dan Nafkah iddah dengan menganalisa putusan perkara nomor 2143/Pdt.G/2022/PA.Btm berdasarkan Kompilasi Hukum Islam. Di mana dalam penelitian diperoleh hasil bahwa apabila seorang istri yang mengajukan perceraian, maka istri wajib membayar biaya perkara di pengadilan dan biaya ganti rugi yang disebut iwadh. Sedangkan seorang suami yang mengajukan perceraian wajib memberikan mut’ah; memberikan nafkah, maskan dan kiswah; melunasi mahar yang terhutang apabila belum melakukan hubungan suami istri; dan memberikan biaya hadlanah kepada anak-anaknya yang belum mencapai umur 21 tahun.

Abstract

This research was conducted in August 2018 with the aim to determine the concentration of nitrate and phosphate in the waters of Nirwana Beach, find out the type and abundance of diatoms found in the waters of Nirwana Beach, and determine the relationship of nitrate and phosphate concentrations to diatoms in Nirwana Beach waters. Determination of sampling location using purposive sampling, namely by taking into account the conditions and conditions of the research area. Sampling of nitrate and phosphate using a sample bottle measuring 100 ml then given preservatives and diatom samples using a bucket and filtered with plankton net no.25 and preserved with 4% lugol solution as much as 3-4 drops and analysis was carried out at the Marine Chemistry and Marine Biology Laboratory , Faculty of Fisheries and Marine Affairs, University of Riau. The results showed nitrate concentration in Nirwana Beach waters ranging from 0.5 mg / l - 0.3 mg / l. And phosphate concentration in the waters of Nirwana Beach ranges from 0.19 mg / l - 0.08 mg / l. In the coastal waters of Nirvana there are 16 species of diatoms found. The highest abundance of diatom species from all species found was Cosconidiscus sp with an average of 4263 ind / l per station. While the lowest abundance of species is Melosira sp, Thalassionema sp, Neodelphinies sp, Rhizossolenia sp and Cocconeis sp with an average of 73.5 ind / l. Diatom diversity index (H ') in Nirwana Beach waters is classified as moderate and community stability is categorized as moderate, there is no type that dominates the uniformity index (E) Nirwana Beach waters are still balanced and there is no competition for food or places. and phosphate with an abundance of diatoms which in this case means that the higher the concentration of nitrate and phosphate, the more abundance of diatoms.

Abstract

Local cultural heritage is a Traditional Cultural Expression, which is an important asset and needs to be protected to ensure the continuity and diversity of human cultural heritage. However, this practice is considered to face serious threats due to the rapid development of the modern tourism industry and minimal attention to the preservation of traditional culture. This research will clearly illustrate the urgency of legal protection and preservation of the Ngarong Fishing Culture as an inseparable part of the local cultural heritage which is rich in traditional values. This research uses empirical juridical research with statutory, conceptual and ethnographic approaches. The research stages consist of problem formulation, data collection, data analysis, correlation discovery, preparation of recommendations and preparation of research outputs. The data sources used are primary and secondary data with qualitative descriptive analysis techniques. The research results show that the Ngarong Fishing Culture is not just an ordinary fishing activity, but rather a ritual passed down from generation to generation by the local community. One of the main obstacles in efforts to preserve the Ngarong Fishing Culture in Teluk Mata Ikan Village is that there is no recognition as a Communal Intellectual Property Right at the Directorate General of Intellectual Property (DJKI), so there is a large potential for loss due to intellectual property violations. Therefore, legal protection is needed, interpreted as an effort to protect legal subjects by using positive law which is enforced by its implementers and given sanctions for violators. In traditional expression, this can be done with preventive protection efforts or prevention efforts by registering communal intellectual property rights with the Directorate General of Intellectual Property (DJKI) by the Regional Government with local traditional stakeholders.

Abstract

Human trafficking remains a major humanitarian crime problem worldwide. Indonesia has made efforts to combat human trafficking by establishing various regulations that serve as the main foundation in this fight, one of which is Law No. 21 of 2007. The framers of the law used the Palermo Protocol as the foundation for its creation. As a transnational crime, human trafficking has also prompted ASEAN, as a regional organization, to take a stand. Since the 1990s, ASEAN has included human trafficking in its agenda to be collectively eradicated. However, human trafficking practices in Indonesia and ASEAN continue to increase, with various methods of operation. Unfortunately, the majority of the victims of this crime are women and children. This article aims to examine the formalization of national law and ASEAN's role at the regional level in combating human trafficking within the framework of international law. This research employs a normative legal approach. The findings indicate a disconnection between national regulations and the fundamental norms upon which they were based, as well as disharmony with other national regulations. Meanwhile, in the ASEAN context, the formation of hard law has not yet been fully implemented, a situation further compounded by the rigid principle of non-intervention in ASEAN.
