Abstract

Peraturan daerah merupakan penjabaran lebih lanjut dari peraturan perundang-undangan yang lebih tinggi serta merupakan peraturan yang dibuat untuk melaksanakan peraturan perundang- undangan yang ada di atasnya dengan memperhatikan ciri khas masing-masing. Pembentukan Peraturan Daerah Kota Manado Nomor 11 Tahun 2012 tentang Tata Letak Penempatan Reklame tidak dapat dilepaskan dari tujuan pengaturan tentang reklame agar senantiasa berjalan dalam koridor peraturan perundang-undangan dan kepentingan masyarakat  namun   sampai saat ini ternyata masih banyak reklame yang terpasang tidak sebagaimana substansi pengaturan Peraturan daerah No. 11 tahun 2012 tersebut sehingga hal ini menarik untuk dikaji khususnya berkaitan dengan penegakan hukum atas peraturan daerah tersebut. Hasil penelitian menunjukkan bahwa penegakan hukum Peraturan daerah reklame reklame di Kota manado pada saat ini belum efektif karena  fungsi koordinasi dengan instansi-instansi terkait yang berhubungan dengan izin reklame kurang berjalan dengan baik, sosialisasi yang belum dilaksanakan secara optimal dan pelibatan masyarakat atau partisipasi masyarakat belum sepenuhnya dilaksanakan sehingga perlu dilakukan upaya untuk  mengatasi kendala  terhadap pelanggaran izin reklame di Kota manado yaitu koordinasi dengan instansi lain terkait dengan penindakan pelanggaran izin reklame, melakukan sosialisasi kepada  masyarakat tentang perizinan reklame, merumuskan suatu kebijakan mengenai  tempat-tempat yang diperbolehkan dipasangnya reklame serta meningkatkan kesadaran hukum masyarakat terhadap ketertiban dalam perizinan reklame. Kata Kunci : Koordinasi, Sosialisasi, Reklame

Abstract

Introduction: Coastal reclamation has become a controversial issue with significant impacts on the lives of local fishermen. Reclamation activities aimed at regional and economic development often neglect the rights of traditional fishermen who depend on the sea for their livelihoods, leading to conflicts between development interests and the protection of human rights, particularly the rights of local fishermen.Purposes of the Research: This study aims to analyze the legal protection of fishermen in the context of reclamation in North Sulawesi, focusing on a human rights perspective.Methods of the Research: The research employs a normative juridical approach, examining relevant legislation related to reclamation and fishermen's rights, as well as analyzing the implementation of laws in practice.Results of the Research: The findings reveal that reclamation in North Sulawesi presents two conflicting sides. On one hand, it offers significant economic benefits to the state, but on the other hand, it poses a risk of human rights violations, particularly for coastal fishermen. The negative impacts of reclamation are evident in the decline in fishermen's income and the increase in living costs since the project was implemented. Legal protection of fishermen's human rights must be enforced through strict sanctions, including substantial fines, against parties who fail to fulfill their obligations to the fishermen.

Abstract

Manado is a city that has a large population, high population mobility and activities in all fields that are increasingly complex. However, actually it does not have a legal product that regulates population administration technically. This paper aims to analyse the population administration policies in the city of Manado and propose an ideal policy that can be pursued to establish an appropriate population administration service in this region. The research is a socio-juridical research. The method used is descriptive by giving a systematic, factual and accurate description of the issues of research.The results indicated that population administration services in the city of Manado were still minimal and not optimal because there were no local regulations which accommodate all the typical conditions of communities. The lack of human resources both in quality and quantity in providing the population administration service to the community and the lack of attention the public to the importance of population administration for their lives, have made inappropriate populatuion administration service. Thus, it is argued that the existence of local regulations are needed to regulate population administration which can accommodate the conditions of the communities in Manado and can be a reference for the implementers in providing optimal services to the community.
