Abstract

Salah satu buah dari reformasi adalah terjadinya perubahan mendasar pada sistem ketatanegaraan Indonesia yang semula sentralistik menjadi desentralistik. Tidak dapat dipungkiri bahwa sistem desentralisasi membuka kran bagi munculnya Perda-Perda Syariah. Selain itu Perda-Perda ini muncul terkait dengan historisitas penerapan syrai’at Islam di Indonesia sejak Islam masuk ke bumi Nusantara. Sebagian dari muatan Perda-Perda syariah tersebut bertentangan dengan ketentuan dalam prinsip-prinsip Hak Asasi Manusia baik yang terdapat dalam HAM dalam perspektif Islam maupun HAM yang dimuat dalam konstitusi Indonesia. Prinsip utama dalam ajaran agama Islam adalah kemaslahatan bagi masyarakat yang di dalamnya tertuang dalam Al-Qur’an dan As-Sunnah. Pelaksanaan aturan perundang-undangan termasuk peraturan daerah yang merupakan tataran terendah dalam hierarki peraturan perundang-undangan harus mewujudkan tujuan dasar negara ini yaitu perlindungan terhadap hak-hak warga negara serta dalam konsepsi siyasah dusturiyyah pun demikian diatur bahwa peraturan haruslah menjamin kemaslahatan bagi masyarakat sebagai tujuan utama dalam nomokrasi Islam.Kata Kunci: Perda Syariah, Siyasah Dusturiyyah, Kemaslahatan

Abstract

Problems in electoral law are more complex than those in other legal regimes. The many types of problems and the large number of institutions involved in handling elections and general elections indicate the complexity of electoral law and election problems. There are six types of problems in election and general election law, namely violations of the code of ethics for election and general election organizers, electoral and electoral disputes, administrative and electoral violations, election and general election crimes, election results disputes and administrative disputes election and general election countries. Whereas various institutions involved in the election and general election law include the General Election Commission (KPU), Election Supervisory Body and general election (Bawaslu), Honorary Election and Election Organizing Board (DKPP), Indonesian Police, District Courts and High Courts, Courts State Administration and State Administrative High Court, Supreme Court, Constitutional Court and Indonesian Broadcasting Commission. The complexity of the electoral law and general elections is inherent in the realm of election and general election crimes. The regulation and law enforcement of election and general election are a separate problem, especially in terms of the mechanism for resolving election and general election crimes. Recently the Supreme Court has issued Regulations relating to the settlement of election and general election crimes. This study will examine the mechanism for resolving criminal acts in elections and general elections in the Supreme Court Regulation No. 1 of 2018 concerning the settlement of election crimes and general elections related to the politics of criminal law in Indonesia.

Abstract

Indonesia mengalami permasalahan yang kompleks terkait regulasi, yakni hiper regulasi. Selain hiper-regulasi, materi hukum ini tumpang tindih dan konflik di tingkat nasional dan lokal. Selain itu, ego sektoral yang kuat dari lembaga pembentuk regulasi menyebabkan masalah ini harus segera dicari solusinya. Penelitian ini merupakan penelitian hukum normatif yang menggunakan metode pengumpulan bahan hukum melalui studi pustaka atau studi dokumen. Pasca amandemen Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan, salah satu poin penting yang diatur dalam amandemen undang-undang tersebut adalah amanat untuk membentuk badan legislatif nasional dimana pembentukan badan khusus ini harus segera dilaksanakan agar. untuk mengatasi berbagai masalah regulasi yang selama ini dialami oleh Indonesia. Abstract

High employee performance makes it easier for employees to be promoted to higher positions. However, not all employees perform as well as expected by the company, as was the case at PT Adhimix RMC Indonesia. This study aims to model the effect of job rotation perspective variables, work discipline, and employee development on employee performance through job satisfaction mediation. This study employs quantitative research methods and causality analysis. It uses stratified random sampling to collect information. The data were collected using questionnaires, and the partial least square method was used for data analysis. Based on the results of the analysis, job rotation, work discipline, and employee development all have a significant effect on job satisfaction, and job satisfaction influences employee performance significantly. As a result of the analysis, it is also found that job rotation, work discipline, and employee development contribute to employee performance directly or indirectly through job satisfaction. .

Abstract

Ombudsman is a part of an auxiliary state institution or often referred to as an auxiliary state organ in Indonesia. One of the duties and functions of the Ombudsman institution is to supervise the running of the public service system in Indonesia, the presence of this institution is expected to be able to improve the protection of people's rights in order to obtain public services, justice, and good welfare. The ombudsman institution has the authority to monitor and examine various reports based on complaints given by the public regarding the state administration system through the whistleblowing system that the Ombudsman of the Republic of Indonesia has. For the duties and functions of this Ombudsman institution which is considered strategic, which has been reviewed from the perspective of theory (auxiliary state organs) and the theory of authority, it is hoped that this institution can maintain stability between various other institutions in Indonesia. The method used in this study is doctrinal legal research and normative juridical research approach because this research takes a legal issue as a form of normative system such as laws and regulations. The results of the research that have been carried out show that the Ombudsman institution is considered to have a very crucial role in supervising all forms of the government public service implementation system in Indonesia through the whistleblowing system mechanism, then it needs to be strengthened again regarding the position of the Ombudsman as an auxiliary state organ and its authority to hold on to the products that can be produced by this institution only in the form of recommendations, not sanctions that can be binding.

Abstract

The main objective of this research is to provide a deeper understanding of the relationship between the legislature and the executive in the implementation of oversight, as well as to identify the challenges faced by the legislature in carrying out the oversight function. This research uses a normative approach, descriptive analytical in nature. The results of the study the authority of the DPR in overseeing government policies, whether through working meetings, interpellation, the right of inquiry, and oversight of state financial management, is an integral form of oversight in ensuring government accountability and transparency. However, in practice, legislative oversight faces a number of significant challenges. One of the main challenges is the dominance of executive power in the presidential system of government, which often hampers the effectiveness of parliamentary oversight. Tensions between the legislature and the executive, as well as the politicisation of oversight influenced by the political interests of certain parties, are factors that reduce objectivity in carrying out legislative oversight functions. In addition, the capacity of human resources in the DPR is also an obstacle, where limited knowledge, skills, and a lack of competent expert staff prevent optimal oversight. To strengthen legislative oversight, efforts are needed to increase the capacity of human resources in the legislature, both through the recruitment of competent expert staff, ongoing training, and increased transparency in the management of the state budget. Strengthening the oversight functions of the DPR, as well as the involvement of the media and the public in oversight, are also solutions that can improve the effectiveness of oversight of executive policies. With these measures, it is hoped that the DPR can better perform its functions, ensure more transparent, accountable and pro-people government policies, and realise a more democratic and corruption-free government. Overall, despite the challenges in legislative oversight, the legislature still has an obligation to perform its oversight function optimally. Strengthening the capacity of the legislature as well as efforts to increase transparency in executive policies are key to realising better governance in Indonesia
