Abstract

The Stages in the criminal justice process, starting from the investigation, prosecution, examination before the court, to the implementation of the court decision or execution. At each stage there are several actions that must be taken to be able to enter the next stage. Fingerprints are lines found on the skin of the fingertips of a person's right and left hands. The fingerprints of criminals are often left at the crime scene. Inquiries and investigations as one of the stages in the criminal justice process are intended to make clear and clear a criminal case in order to find the perpetrator. In carrying out inquiries and investigations, it is necessary to secure the place where the crime occurred to carry out fingerprint identification of the victim or perpetrator of the crime. This research uses a normative juridical research type with a statutory approach, concept approach and case approach. Using secondary data as main data through: statutory regulations, literature books, and criminal cases. Analysis uses qualitative analysis. The aim of this research is to analyze the urgency of fingerprints as evidence in the criminal justice process. The results of the research show that: The urgency of fingerprints in the criminal justice process is that apart from having an important function in the inquiry and investigation stages, they are also important as evidence for expert testimony, documentary evidence and indicative evidence in the evidentiary process at court hearings. Apart from being a piece of evidence, the perpetrator's fingerprints also function as evidence at trial, because the fingerprints on the tools used to commit the crime are accurate evidence regarding who the perpetrator was.

Abstract

Partai politik adalah suatu kelompok politik yang mengikuti pemilihan umum dan melalui pemilihan umum itu mampu menempatkan calonnya untuk menduduki jabatan - jabatan politik. Untuk menempatkan jabatan-jabatan strategis tersebut maka pemilihan umum menjadi kunci sarana demokrasi, yang esensinya adalah pemilihan pemimpin dari rakyat, oleh rakyat untuk rakyat. Pemilihan umum adalah perwujudan kedaulatan ditangan rakyat hal ini dituangkann dalam pasal 1 ayat (2) “Kedaulatan berada di tangan rakyat dan dilaksanakan menurut Undang-Undang Dasar” Pemilihan umum dalam sistem ketatanegaraan Indonesia adalah untuk memilih anggota Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Presiden dan wakil presiden dan Dewan Perwakilan Rakyat Daerah (pasal 22E ayat (2). Pelaksanaan pemilihan umum tidak lepas dari keberadaan partai politik, karena partai politik adalah peserta pemilu sekalipun tidak semua parpol pasti peserta pemilu. Namun bagaimanakah mencari sosok pemimpin negarawan. Metode penulisan ini menggunakan tipe penelitia normatif dengan sumber data sekender. Subjek yang diteliti adalah fenomena tentang mencari sosok pemimpin negarawan korelasinya dengan Partai Politik, demokrasi, pemilihan umum dan sistem ketatanegaraan Indonesia. Hasil penelitian menyimpulkan bahwa secara normatif tidak ada ketentuan secara explisied bunyi persyaratan dalam pencalonan anggota DPR, DPD, DPRD maupun Presiden dan Wakil Presiden, yang secara tegas mensyaratkan seorang pemimpin yang dipilih dalam pemilihan umum adalah negarawan. Dalam Undang Undang Dasar Negara Republik Indonesia tahun 1945 satu-satunya syarat yang secara tegas dengan ketentuang sorang negarawan hanya syarat untuk diangkat menjadi Hakim Konstitusi, itupun tidak dipilih secara langsung melalui pemilihan umum.

Abstract

Indonesia sebagai Negara yang berpenduduk muslim terbesar di dunia mempunyai problematika yang unik. Dalam kehidupan masyarakat ada sebagian orang yang menggunakan sistem kewarisan adat, hukum kewarisan barat dan ada pula yang menggunakan kewarisan Islam. Dalam pembentukan hukum waris nasional di Indonesia, kiranya kita tidak dapat memungkiri bahwa bangsa Indonesia adalah bangsa yang kaya akan adat istiadat yang sangat bermacam-macam dan dalam hukum adat itu telah mempunyai aturan atau ketentuan-ketentuan mengenai hukum kewarisan juga, sehingga perlu dalam pembaharuan hukum kewarisan nasional di Indonesia hendaknya tidak mengesampingkan aturan kewarisan adat. Hal ini dikarenakan masyarakat Indonesia masih sangat menjunjung tinggi adat istiadat mereka yang merupakan warisan dari para leluhur mereka.

Abstract

In the Indonesian constitutional system, one of the manifestations of democracy and popular sovereignty is the freedom of opinion and expression guaranteed by the 1945 Constitution, freedom of opinion and expression is a human right (Article 28). This right is regulated by international law and national law. However, the fact is that the implementation of freedom of opinion and expression in social media causes a lot and does not pay attention to human rights and the legal interests of others. In this research, the research approach used is normative juridical using secender data as the main data (primary legal materials, secender legal materials, tertiary legal materials) supported by primary data (observations and interviews), the research data is analyzed descriptively qualitative. The results showed (1) Freedom of opinion and expression in social media in Indonesia in the form of digital platforms such as social media has many misunderstandings in its implementation (2) The implementation of freedom of opinion in social media in Indonesia must be limited by the responsibility to maintain ethics, not harm others, and conflict with applicable laws in Indonesia.

Abstract

Implementing this Community Service Program strengthens the digitalization of tourism by accelerating the herbal medicine village tourism village based on the language variations of content creators.  Currently, not many tourists and enthusiasts come to buy herbal medicine at Kampung Jamu Wonolopo. Based on this description, the Community Service Team of the University of 17 Agustus 1945 Semarang assists Mitra Pokdarwis Manggar Selaras, which includes activities: Socialization and Program Coordination with Partners, Motivation and Strengthening HR Capacity, Training and Practice in Using Tools for Creating Digital Content, Workshop on Creating and Editing Video Content, Workshop on Using Various Languages for Content Creators, Handing Over Appropriate Technology Tools. As a result of this service, it is hoped that the residents of Jamu Wonolopo village will be able to improve the quality of human resources through digital skills to manage the development of the tourism potential of Jamu village by optimizing the preservation of nature and culture through interesting language variety content, to improve the quality of life for economic growth, job creation so that The results can improve community welfare.

Abstract

The presence of data innovation in the current era of globalization has progressed rapidly. This development can be seen from the proliferation of electronic commerce (e-commerce) in the trade, government, health, education, and mobile internet sectors. Personal Data is certain individual data that must be treated, then stored and kept true for all important data and must be kept confidential. Also, everyone has the option of obtaining legal guarantees against protection and mediation relating to individual matters. The development of information technology indirectly changes the mindset, including territorial boundaries, time, logic of thinking, work patterns, to manual behavior towards digital demands. The era of digitalization so far has not been able to provide definite legal protection. This is indicated by the rise of leaks because they have reaped logical consequences in the form of technologybased crimes because the existence of a computerized or digitized system has not been able to be prevented properly. This article uses normative juridical research methods, namely library research related to applicable laws and regulations, legal principles and relevant library sources. Everyone has the right to guarantee the protection of personal data. The ratification of the Personal Data Protection Bill into a law and the establishment of an independent institution must be carried out immediately so that the public feels more secure about their right to privacy. In addition, the lawsuit mechanism against the acquisition of personal data without the consent of the relevant parties can be made clearer along with the compensationprocess.

Abstract

Building the character of millennials in the era of revolution 5.0 in filling independence is an obligation as a large-populated country such as the Unitary State of the Republic of Indonesia. In facing it, it is necessary to prepare a resilient and characterful generation facing the challenges in revolution 5.0, which is growing at this time, namely applying Pancasila values for the younger generation that can be implemented in the right momentum. In reality, some young people are now damaged by morals because of various things that affect them. Influences include the adverse effects of globalization, friends, increasingly sophisticated electronic media, drugs, liquor, and other harmful things. This research aims to direct the younger generation in building the nation. Research methods using literature studies are data collection techniques by conducting study studies of books, literature, and others. The results of this research confirm that the younger generation at the time of revolution 5.0 still needs direction and understanding in the life of the nation and state. The conclusion is that the younger generation, as the holder of the leadership relay, needs to be equipped with a national character with Pancasila spirit. So that the relay of the continuity of the nation to be maintained by the republic will be the unity and unity of the country and the realization of our national goals.

Abstract

Information technology has a very important role, both now and in the future. In reality, although there are a number of laws and regulations that prohibit hate speech in public spaces, there are still few people who realize that this act is a violation of the law, not only the perpetrators but also the victims and even the officers. This journal aims to find out the implementation of Law No.19 of 2016 concerning Information and Electronic Transactions in the development of criminal crimes that occur in Indonesia, especially in cybercrimes. The author intends to directly describe social phenomena based on indicators whether or not the phenomenon under study regarding the implementation of the Law on Information and Electronic Transactions and Pancasila regarding law enforcement related to cybercime in Indonesia is currently happening. Therefore, it is the joint responsibility of the government, law enforcement officers/Polri and TNI as well as all elements of society to combat the turmoil of cyber crime, SARA, etc., based on relevant legal materials, namely primary legal materials, secondary legal materials and tertiary legal materials. The basis for law enforcement that can answer the demands of society must be responsive law, otherwise the law will lose its spirit. Morals and justice are the spirit of the law. Legal reform must look back at the solidity of morality that lives, grows and develops in society. Against this note, the author views that the choice of revision of the Law on Information Electronic and Transactions does not have to come from the DPR. The President as one of the law-forming institutions, based on the provisions of Article 5 paragraph (1) of the 1945 Constitution of the Republic of Indonesia is also authorized to propose revisions to the Law Information and Electronic Transactions which urgently needs to be carried out.
