Abstract

This study aims to examine the actualization of general principles of good governance in the government administration system at Bone Regency. The type of research used is empirical research. Data collection techniques used in this study were interviews and literature study. The research data were analyzed quantitatively and then presented descriptively. The results showed that the actualization of general principles of good governance in the government administration system at Bone Regency is still not implemented. One of the main reasons is that the professionalism and competence of SCA resources in Bone Regency are still low. Furthermore, the factors that influence realizing the general principles of good governance in the government administration system at Bone Regency include leadership capability, supervision, SCA resources, and consensus between government and citizens. Therefore, substantial efforts are needed to improve the professionalism and competence of SCA resources through education and the provision of special training. In addition, leadership capability, supervision, and consensus between government and citizens also need to be improved and carried out consistently so that the actualization of general principles of good governance in the government administration system at Bone Regency can be carried out well in the future.

Abstract

This study aims to determine the juridical fundamentals and analyze the constitutionality of the provisions of the Presidential Threshold against the 1945 Constitution. The type of research used is normative or doctrinal legal research using a comparative law approach. The method of analysis in this study is to use qualitative analysis. The study results indicate that the Presidential Threshold mechanism in Indonesia has had juridical fundamentals from 2004 until now. In this case, it includes Article 6A section (2) and section (5) of the 1945 Constitution, Article 5 section (4) and Article 101 of Law No. 23 of 2003, Article 9 of Law No. 42 of 2008, to Article 222 of Law No. 7 of 2017. However, Article 222 of Law No. 7 of 2017 is a closed legal policy and not an open legal policy. Therefore, the Presidential Threshold mechanism regulated in Articles of Law up to Article 222 of Law no. 7 of 2017 can be judged unconstitutional or contrary to the 1945 Constitution. Based on this conclusion, it is suggested that the Constitutional Court consider the juridical language of Article 6A section (5) of the 1945 Constitution. In this case, Law No. 7 of 2017 does not contradict the 1945 Constitution. In addition, it is also recommended for Legislators to make amendments to Law No. 7 of 2017. Furthermore, it is hoped that Legislators will consider increasing the Parliamentary Threshold as an effort to strengthen the presidential system in Indonesia.

Abstract

A rule of law is a state that places the law, the principle of an independent and partial judiciary, as supreme command in the governance order, so that the executors of the functions of government positions do not have free will. By literature research, The urgency of authority as an instrument of government in the administration of a rule of law is that it must adhere to, develop, and practice the principle of a rule of law, which is based on the principle of legality, so that the legal authority of government originates from law. In a rule-of-law state, authority is used as an instrument for administering government, so that the basis for taking action is clear; therefore. So that authority as a legal instrument is measured by whether or not there is legal authority as governmental authority.

Abstract

The activity of community dedication which is done at MA DDI Padanglampe to increase the legal awareness about bullying impacts by using need sssessment methods, legal counseling, accompaniment, and evaluation for the students of MA DDI Padanglampe. The purpose of this activity is to understand the dangers of bullying for the victims and perpetrators. Therefore, the activity of legal counselling and accompaniment were programmed for the students of MA DDI Padanglampe and the results were, they learned about various forms of bullying; they learned tips to avoid bullying and ready not to become part of the bullying perpetrators; and be aware of the bullying impacts.

Abstract

This study aims to analyze the juridical implications of Decision Number 85/PUU-XX/2022 for the dispute resolution of Regional Head Election results in Indonesia and examine the position and authority of the Constitutional Court following the decision. This research employs a normative legal research method with statutory and conceptual approaches. The analytical techniques used are qualitative-descriptive and interpretative analysis techniques to examine and interpret legislation, Constitutional Court decisions, and relevant legal literature. The results show that Decision Number 85/PUU-XX/2022 has re-established the Constitutional Court’s permanent authority to adjudicate disputes over Regional Head Election results, previously annulled through Decision Number 97/PUU-XI/2013. Decision Number 85/PUU-XX/2022 is based on a constitutional interpretation that there is no distinction between the General Elections regime and the Regional Head Election regime within the framework of the 1945 Constitution. The juridical implication of this decision is the establishment of legal certainty regarding the institution authorized to resolve disputes over Regional Head Election results, namely the Constitutional Court, with definitive authority that is no longer ad hoc. In addition, this decision can potentially increase the effectiveness of the dispute resolution of Regional Head Election results and strengthen the electoral democratic system at the local level. To strengthen the position and ensure the continuity of the Constitutional Court’s authority, it is recommended to amend Law Number 48 of 2009, Law Number 10 of 2016, and the 1945 Constitution to explicitly mention the Constitutional Court’s authority in adjudicating disputes over Regional Head Election results.

Abstract

This study aims to analyze the voting rights of members of the Indonesian National Army (TNI) and the Indonesian National Police (Polri) in general elections in Indonesia from the perspective of human rights (HAM). Constitutionally, the right to vote is part of human rights regulated in various national and international legal instruments. However, in Indonesia, members of the TNI and Polri are restricted from active and passive voting rights in elections on the grounds of maintaining institutional neutrality and professionalism. This study uses a normative juridical method with a legal approach and literature studies related to human rights theory and democratic principles. The results of the study show that there is a dilemma between the protection of human rights for members of the TNI and the National Police and the need to maintain political stability and neutrality in the Indonesian democratic system. This study recommends the importance of policy evaluations that provide a balance between respect for human rights and the institutional functions of the TNI and the National Police. This study is expected to contribute to the formulation of more inclusive policies without ignoring the basic principles of democracy and human rights.

Abstract

The revision of the Corruption Eradication Commission Law explicitly places it as a government institution within the executive branch. Additionally, the establishment of a Supervisory Board with the authority to grant permits for wiretapping, searches, and seizures has sparked debate regarding the limits of the KPK's independence. The issues raised in this study relate to the KPK's position after the amendment of the KPK Law and the KPK's independence as an executive body after the amendment of the KPK Law. The method used in this study is the normative legal method. The research results show that the position of the KPK after the amendment to the law falls within the executive branch of power, while the KPK's independence as an executive institution is now limited because its institutional position is under the administrative control of the government. the KPK can be restored as an independent institution free from interference by any power. In addition, strengthening institutional aspects, proportionate supervision, employe professionalism, and public transparency are key to maintaining the KPK's credibility as the front line in eradicating corruption.

Abstract

Rights and obligations are inherent in human beings and Indonesian citizens. In the school environment, rights and obligations are increasingly inherent for students as citizens. The UMI PKM team had the opportunity to visit one of their partners located in Sanrobone Village, Takalar Regency, namely MA Mizanul Ulum. Before the Community Service activity was carried out, the PKM team found various problems occurring with the partners, such as some students still frequently skipping school, not doing their homework, being late often, and violating other rules. Therefore, the PKM Team conducted legal counselling activities with the aim of helping students understand the importance of raising awareness of rights and obligations regarding rules and regulations as the basis for creating order and justice in the school environment. This activity is conducted thru lecture and discussion methods. The results of the activity show an increase in awareness of the rights and obligations of students at MA Mizanul Ulum. The implications of this activity are that it can cultivate legal awareness from an early age, instill discipline and a sense of responsibility, and shape students' characters to be integrated and well-rounded.
